SURPLUS RIGHT OF WAY AT THE SOUTHEAST CORNER
OF McFADDEN AVENUE AND SULLIVAN STREET AND
RESERVING AN OVERHANG EASEMENT THEREIN
WHEREAS, on recomzaendation of the Planning Department and
the Department of Public Works, Resolution 65-80 was adopted giving
notice of intention to vacate certain right of way and notice of a
public hearing thereon; and
WHEREAS, said public hearing was duly held on the question of
said street vacation on both published and posted notices as required
by law and, after hearing, the City Council determined that said
right of way should be vacated.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana does hereby find that the portion of street right
of way at the southeast corner of McFadden Avenue and Sullivan Street,
herein described, is unnecessary for present or prospective street
purposes and should be vacated, reserving therein a public service
overhang easement; and that that certain property in the City of
Santa Aha, County of Orange, State of California, described as:
Those portions of Lots 1 and "X" in Block "A" of Tract No. 604,
in the City of Santa Ana, County of Orange, State of California,
as per map recorded in Book 24, Page 19 of Miscellaneous Maps,
in the office of the County Recorder of said County, lying
northerly of the following described line:
Beginning at the intersection of the East line of said Lot 1
with the South line of the North 10.00 feet of said lots; thence
West along said South line to a point East 15.00 feet from the
West line of said lot "X"; thence southwesterly on a direct line
to a point on the West line of said lot "X" southerly 15.00 feet
from the northwest corner thereof.
EXCEPT that portion thereof lying northwesterly of a curve
concave southeasterly having a radius of 25.00 feet which is
tangent to the West and North lines of said land
be and the same is hereby vacated for street purposes.
BE IT FURTHER RESOLVED: That a public service overhang ease-
ment in and over said area is hereby reserved for the transmission
of electrical energy and electrical communication for the Southern
California Edison Company and its lessees.
PASSED ANU ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 21st day of June, 1965.
