362 ORDINANCE NO. 788. AN 0RDIN~JCE OF THE CITY OF SANTA ANA DECLARING THE INTENTION OF THE BOARD OF TRUSTEES OF SAID CITY, TO WIDEN EAST FIRST STREET IN SAID ~TY; DESCRIBING THE IMPROVEI~NT AND THE LAND NECESSARY AND CONVENIENT TO BE TAKEN THEREFOR, AND IN GENERAL ~RMS DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID IMPROVEMENT, AND TO BE ASSESSED TO PAY THE EXPENSES THEREOF; &ND TO BE KNOWN AS THE ASSESSMENT IESTRICT; REFERRING TO A M~P APPROVED BY THE BOARD OF TRUSTEES INDIC,~TING BY A BOUNDARY LINE THE EXTENT OF THE TERRITORY TO BE INCLUDED IN SAID ASSESSMENT DISTRICT, SAID MAP ON FILE IN THE OFFICE OF THE ENGINEER OF SAID CITY; DIRECTING THE POSTING, PUBLIC&TION AND MAILING OF NOTICES, AND DESIGNATING A NEWSPAPER 'FOR SAID PUBLICATION. The Board of Trustees of the City of Santa Ana do ordain as follows: SECTION I. That the public interest and convenience require, and it is the intention of the Board of Tr6stees of said City of Santa Ana to order an improvement in said City, which improvement is described as follows: (a) The widening of East First Street in. the City of Santa Ana from the East line of Main Street in said City to the West llne of the Southern Pacific Right of Way extending across said First Street. The use of the work "improvement" in this ordinance means and shall be held and construed to mean the widening of said street as here- inbefore set forth and described. SECTION II. It is necessary to take land in the widening of said Street, and the land necessary to be taken therefor is described 'as follows: Located in the City of Santa Aha, County of Orange, State of California, and more particularly described as follow~, to-wit: The South five feet of lots 1 and 2 of Block 2 and lots 1 and 2 of Block I of the Town ~f Santa Ana as per map thereof on file in Miscellaneous Records, Book 2, page 51, Records of Los Angeles County, California. SECTION IV. Upon the passage of this Ordinance, the Street Superintendent of the City of Santa Ana, shall cause to be conspicuously posted along all streets and parts of streets and public places and rights-ofLway where any property is to be taken, and along and upon any private unimproved property which is to be taken for the widening of said street, at not more than three hundred (300) feet in distance apart· but not less than three in all, notice of the passage of said ordinance headed "NOTICE OF PUBLIC WORK", the heading to be in letters not less than one inch in length and legible characters; said notice shall state the fact and the date of the passage of this ordinance, and briefly describe the improvement proposed, and refer to this Ordinance of Intention for a description of the assessment district and of the land to be taken· and for further particulars. SECTION V. The Street Superintendent shall also cause a no- tice similar in substance to be published by two insertions in the Santa Aha Daily Evening Register· a daily newspaper published and circulated in the City of Santa Aha, which paper is hereby designated as.the paper to be used by the Street. Superintendent for that purpose. SECTION VI. The Clerk of the City of Santa Aha shall immedi- ately upon the publication of said notice mail postage prepaid to each of'the property owners in the assessment district at his las known address, as the same appears upon the tax rolls of the City of Santa Aha, and where no address so appears, to the General Delivery at santa Aha, California, a postal card containing a notice ,,hich shall be sub- stantially in the following form: ."You are hereby notified that on the day of 1926, the Legislative Body of the City of Santa Ana, California, by vir- tue of the Street Opening Act of 190~, passed an Ordinance of Intention No. , for the widening of East First Street between the East line of North Main Street and'the West line of the Southern Pacific Railway Company's right of way e~tending and extended across East First Street, all in said City. "Written protests may be filed with the City Clerk within thirty (30) days after the day of , 1926. Your property is in the district to be assessed for this improvement. E.L. This Ordinance shall be signed by the President of the Board of Trustees, attested by the Clerk of the City of Santa Aha, and published three (3) times in the Santa Aha Daily Evening Register, a newspaper of general circulation published in s~d City, and thirty (30) days after its fl~st publication shall be in full force and effect. AN ORDINANCE 0F THE CITY OF SANTA ANA PROVIDING FOR THE CREA- TION OF A PLANNING C C~MISSION; DEFINING THE DUTIES OF SAID COMMISSION; PROVIDING FOR THE SALARY OF THE SECRETARY THEREOF; AND DECLARING THE NECESSITY FOR SUCH A B0~Y.~ The Board of Trustees of the City of Santa Ana do ordain aa follows: SECTION I. The President of the Board of Trusteee of the City of Santa Aha, California, shall appoint five persons, which persons shall be and constitute a planning commission for the said City; one of said appointeee ehall be a member of the legislative body; and the City Attorney and City Engineer of said City ehall be ex-officio full mem- bers of said commission. The President of the Board of Trustees shall be an ex-officio member of the Commission, but shall vote only in case of ties. SECTION II. The said Commission shall meet regularly a~ least once each month at a time and place to be fixmd by Resolution, and shell hold such other meetings as from time to time shall be called in the manne~ and form rgquired by law. SECTION III. That one of the members of the planning commission shall be e~,cted Secretary, and shall receive as compensation for his or her work a sum to be fixed fro$ time to time by the Board of Trustees of the City. Ail other members of the Commission shall act as such without remuneration. SECTION IV. That the City planning commission shall have power, except aa otherwise provided by law: FIRST: To recommend to the pooper officers of the municlpa~- ity plans for the regulation of the future growth, developement and beautification of the municipality in respect to its public and private buildin~;s and works, streets, parks, grounds, and vacant lots; SECOND: To recommend to the proper office of the municipal- ity, plans, consistent with the future growth and development of the municipality in order to secure to the city and its inhabitants sani- tation, proper~service of all public utilities, harbor, shipping and transportation facilities; THIED: To make recommendations to any public authorities or any corporation or individuals of such city with reference to the location of any proposed buildings, structures or works; FOURTH: To recommend to the proper officers of the munlei- pality the approval or disapproval of maps or plats of subdivisions of lands. Every such map or plat shall, prior to its final approval or disapproval by the proper officers of the municipality be submit- 'ted to said commission for its recommendations thereon to such offi- cers. And such other things as shall be necessary to carry out the provisions herein authorized, and as is provided in Act 5211, General Laws of California 19~3 and amendments thereto. SECTION V. That the formation of such a commission is deemed necessary and advisable for the welfare of said City of Santa And, California. SECTION VI. The City Clerk shall cause this Ordinance to be published three times in the Santa Aha Daily Evening Register, a newspaper of general circulation, published and circulated in said City, and it shall take effect thirty (~0) days after the date of f~mt publica- tion thereof. ORDINANCE NO. 791/ AN OIIDINANCE OF THE CITY OF SANTA ANA, AMENDING ORDINANCE 731, BEING AN ORDINANCE PROVIDING FOR THE APPOINTMENT OF A PLUMBING INSPECTOR, DEFINING HIS DUTIES, AND FIXING HIS C C~PENSATION; REGULAT- ING THE METHOD OF CONSTRUCTING PLUMBING WORK, HOUSE DRAINAGE, GAS FITTINGS, BY THE ADDITION OF REGULATIONS FOR THE INSTALLATION OF WATER SOFTENERS. as as ~by the The Board of Trustees of the City of Santa Ana, follows, to-wit: SECTION I. That amended by Ordinance No. Ordinance No. 731 of the City 749 of the City of Santa Ana, do ordain of Santa Ana, be amended following corrections, additions, and insertions: That sub-section (c) be added to Section 26 as follows: (c) A Plumbing permit shall be required for all Water Sof- teners and Automatic Water Pumps or Lifts installed in the City of Santa Ana, and a notice of Inspection filed in the Plumbing Inspector's Office. No Water Softener or Automatic Water Pump o~ Lift now in use, or hereafter installed in the City of Santa Ana shall have any outlet, inlet, supply or waste pipes, or any part or parts thereof connected directly with the sewer system, but shall, when wasted into the sewer discharge its waters into an open approved plumbing fixture properly trapped, vented and supplied w~th water. SECTION 2. That all parts of Ordinances No~ 731 and No. 749 shall remain and be in full force and effect. SECTION 3. That the Board of Trustees declares that an emer- gency exists, to-wit; that there is a danger of a back up of refuse into the City Water System from improper connection on Water Softeners and Automatic Water Pumps or Lifts and therefore declares that this Ordinance shall be an Emergency Ordinance and effective for all pur- poses upon its first publication, as is hereafter provided. SECTION 4. Said notice must be given at least seventy-two hours before the pro- posed moving. SECTION III. No permit shall be issued to allow the moving of any building along any street, road, avenue, boulevard, alley, lane, public place or highway except as is hereinbefore in this 0~di- nance provided, and after the street superintendent has inspected applicants equipment and appr~ed same, subject to the following regulations: 1. No building shall be moved, the highest point of which at any time during operation of moving, extends to a height of more than twenty-fiwe feet above the surface of the street. 2. No building shall be moved upon any truck, having metal tires unless the total weight restlng upon the surface of the street shall not exceed six hundred (600) pounds upon any inch of width of tires. 3. No buildingwieghing more than nine (9) tons shall be moved upon any truck equipped with pneumatic or solid tires. A. No building shall be moved upon rollers unless planks are placed under ~aid rollers to such width and in such manner as to protect the surface of the street from damage. 8. No building shall be moved unless moved upon rollers as hereinbefore in this ordinance provided or upon a truck having wheels equipped with pneumatic or solid rubber or metal tires. 6. No building shall be moved unless there is at all times a clear space of at least five (B) feet between said building and the curb of the street. ?. No building shall be allowed to remain stationary on any street intersection, or upon any street in such manner as to obstruct the access to any fire plug, stand pipe or other fire fighting appli- ance located upon or adjacent to such street. 8. No building shall be moved or allowed to remain station- ary upon any public street during the period between thirty minutes before sunset and thirty minutes after sunrise, unless red lanterns are kept lighted ~uring said period at each corner of said building. 9. The Chief of the Fire Department shall be notified twice during each twenty-four (24) hours of moving of the exact loca- tion of the building. ' SECTION IV. Before the issuance o~ any peEnit hereunder, the applic~ant shall deposit the sum of $200.00 with the City Clerk provided however, that if the amount chargeable hereunder for issuance 373 of a permit is in excess of $50.00, the applicant shall deposit the sum of $100.00 in addition to the sum chargeable hereunder for the per- mit, and from said deposit the Superintendent of Streets shall deduct the sum of $10.00 for the ~ssuance of a permit for the moving of a building containing not ober fi~e hundred square feet of total floor space, including the floor space of any floor or part thereof above the first, and $10.00 for each addition ten square feet of floor space or fraction thereof~ and also the sum of $20.00 for each twenty- four (24) hours or fraction thereof during which the building occu- pies any portion of a public street in the operation of moving in excess of the first twenty-four (24) hours. In addition to the first deposit of $200.00 the applicant for the permit shall, before the issuance thereof, in the case of every building containing more than five hundred square feet of floor space, file with the Street Superintendent a bond in the sum of $1,000.00, issued by a surety company authorized to do business in the State of California, in a form approved by the City Attorney of the City of Santa Ana, conditioned that if the principal shall fail to fully pay any person, firm or corporation including the City of Santa Ana, who or which sahll suffer any damage that may be done to the streets or improvements thereon, or to any person or property of any description'as a result of the moving of such building, the amount of such bond. Such bond shall be so conditioned that it may be recovered upon at the suit and in the name of any person, firm or corporation so injured. The Superintendent of Streets shall also deduct from said deposit the cost of the service rendered by any employee of said City, in protecting, trimming or cutting any trees along the route of moving. In the event that it becomes necessary to move, or re- place or otherwise change any poles, conduits, standards, wires or other property of utilities, in the streets, which are placed and located acceding to law, franchise and the regulations of the Rail- road Commission of the State of Calif~ nia, governing such locations, the reasonable expense of removal and replacement of same shall be borne by the housemover and deducted ~rom the deposit made by the Street Superintendent, provided the person, firm or corporation owning or controlling said poles, wires, etc., shall have filed with the Street Superintendent an estimate of said work within 48 hours of the time of the service of the Notice of Application of Building Moving permit, as is hereinbefore provided. Wherever such poles, wires, etc., are placed with less clearance than that specified in the laws, and regulations pertain- ing to such matters, borne by the person, operating same. SECTION V. ~rdinance provided for be the expense of removal and replacement shall be firm, corporation or municipality owning or Should the cash deposit hereinbefore in this inadequate to pay the respective claims 374 then the Bond hereinbefore provided for shall be subject to said payment and shall insure the ame. The house-mover shall have the right to appeal to the City Counci$ if he believes that the estimate oF statement fur- nished by any utility o!r municipality for protecting their property on the streets is excessive, whereupon the City Council shall hear such matters and determine whether or not said estimate or statement is cessive and in case it find it so to be, then the City Council shall fix such sum as it deems adequate for said house-mover to deposit, and the sum so fixed by the City Council shall be deducted by the Street Superintendent from the money deposited by the applicant in lieu of tl~ estimate or statement and paid to the claimant. SECTION VII. After the co~pletion of said moving the Street Supe~intendent of said City shall refund to the applicant any remain- ing amount not chargeable hereunder. SECTION VIII. Any person, firm or corporation, as principal, officer, agent, clerk or employee, whether acting for himself or it- self or for another person, fi~ or corporation, who or which shall violate any provision of this ordinance shall be guilty of a misde- meanor, and upon conviction thereof shall be punishable by a fine not exceeding three hundred ($300.00) dollars or imprisonment in the City Jail not exceeding three months, or by both such fine and imprisonment. SECTION IX. It having been determined by Resolution No. 1644 of the City of Santa Aha that the public interest and also the public necessity demands the completion of the sewer system of the City of Santa Ana, including the outfall sewer, the completion thereof to consist of the acquisition and installation in the sewer treatment plant of additional sewer screens for screening sewage, the acquisi- tion and installation of a sewer pump, and the machinery and power to operate said pump for pumping sewage, the acquisition of sewer pipe, fittings, and appliances, and the installation and constr~c- tion of additional sewer pipeline for conveying sewage. The Board of Trustees of the City of Santa Ana propose to incu~ a bonded debt of the City of Santa Aha, and to issue and sell the bonds of said city to pay the cost of the completion of the sewer system of the City of Santa Ana, including the outfall sewer. The objects and purposes for which the indebtedness is proposed to be incurred is to pay the cost of the completion of the sewer system of the City of Santa Ana, ~cluding the outfall sewer, in order to make and have the sewer system of the City of Santa Ana, including the outfall sewer, adequate and sufficient to receive, treat, and dispose of the sewage accumulating therein and for the sanitation of the City of Santa Ana. The cost to the City of Santa Ana for the completion of the sewer system, including the outfall sewer, is estimated to be the sum of $182,000.00, and the amount of the principal of the in- debtedness to be incurred therefor is the sum of $182,000.00, which cost is and will be too great to be paid out of the ordinary annual income and revenue of the City of Santa Aha. Section 2. It having been determined by the said Hesolution No. 1644 of the City of ~anta Ana that the public interest and also the pub- lic necessity demands the acquisition of lands in the City of Santa Ana for the purpose ~ public parks. The Board of Trustees of the City of Santa Ana propose to incur a bonded debt Of the City of Santa Ana, and to issue and sell 382 the bonds of said City to pay the cost of the acquisition of land in the City of Santa Ana for the purpose of public parks. The objects and purposes for which the indebtedness is pro- posed to be incurred is to pay the ca t of the acquisition of land in the City of Santa Ana for the purpose of public parks of said City, in order to furnish and provide the inhabitants of the City of Santa Ana with adequate public places for recreation. The cost to the City of Santa Ana for the acquisition of land therein for the purpose of public parks is estimated to be the sum of $280,000.00, and the amount of the principal of the indebtedness to be incurred therefor is the sum of $250,000.00, which cost is and will be too great to be paid out of the ordinary annual income and revenue of the City of Santa Ans. The maximum rate of interest to be paid on any of the indeb- tedness in this Ordinance proposed to be incurred is hereby recited and fixed at five per cent. per annum, and the said rate of interest shall not be exceeded in the issuance of bonds for any of s aid indebtedness. Section 5. The Board of Trustees of the City of Santa Ana hereby orders the submission to the qualified voters of the City of Santa Ana the propositions of ~ncurring a bonded debt by the City of Santa Aha for each of the objects and purposes, and in the amounts of the principal of the indebtedness to be incurred therefor, as set forth in Resolu- tion No. 1644 and as above described and recited in this Ordinance. For that purpose a special election is hereby called and ordered to be held in and for the City of Santa Ana on the 26th day of May, 1926, which day is hereby fixed as the date on which such spec- ial election will be held. At the said special election there shall be and is hereby submitted to the qualified voters of the City of Santa ~na the two propositions to incur a bonded indebtedness by the City Of Santa Ana for the two objects and purposes and in the two amounts of the princi- pal of the indebtedness to be incurred. The manner of holding said special election and the voting for or against incurring such indebtedness shall be as follows: The two propositions of incurring a bonded indebtedness by the City of Santa Aha shall be submitted to the qualified voters of said City by means of a printed ballot; on the ballot the two propo- sitions together with the amount ~ the principal of the indebtedness 3S3 to be incurred therefor shall be separately staSed, each a distinct proposition, so that a voter at the special election may vote for or against each proposition separately. The bonds shall be issued in such denominations as the Board of Trustees may determine, except that no bond shall be of less denomination than $100.00, nor of greater denomination than $1000.00, and shall be payable on the day and at the place so fixed and designated in the bonds. The Board of Trustees of said City shall on the first Monday in September of each year, fix upon each One Hundred Dollars ($100.00) using as a basis the value of the property as assessed by the County Assessor and so returned to such Board by the County Auditor as required by said Act and by Section 3 of this Ordi- nance; which rate of taxation shall be mufficient to raise the amount of money so fixed by said Board of Trustees as required by Section 2 of this Ordinance; and all of which acts of said Board of Trustees, shall be and are hereby declared to be a valid assessment of said property , and a valid levy of said rates so fixed, and the Board of T~ustees shall transmit to the County Auditor of said County of Orange a statement of said rates immediately after they have been so fixed by said Board. Section 8. The County Auditor ~st then compute and enter in a separate column in the assessment book, to be headed "City Tax, City of Santa &ua", the respective sums in dollars and cents to be paid as a municipal or city tax on the property therein enumerated and assessed as being in said municipal corporation or city, using the rate ~ levy so fixed by such Board of Trustees of the City of Santa Ana, and the assessed value as found in such assessment book. Such taxes so levied shall be collected at the same time and in the same manner as state and county taxes; and when collected the net · amount as ascertained by Section 8 of this act shall be paid to the Treasurer of the City of Santa Ara under the general requirements and penalties provided by law for the settlement of other taxes. Section 6. The County Auditor and County Tax Collector shall file with the Board of Supervisors itemized statements showing the additional expenses to their offices of assessing and collecting the City taxes of the City of Santa Ana, and upon the filing of such statements the Board of Supervisors shall by an order spread upon the minutes, deduct such expenses from the taxes of said City of Santa Ara, while in the hands of the ~ounty Tax Collector, and transfer the same into the county salary fund; provided that not more than one per centum shall be charged for collecting the first Twenty-five Thousand Dollars ($25,000) so collected and one-fourth of one per centum for all sums over that amount. Section ?. Whenever the Board of Trustees of the City of Santa Ara shall have aviled itself o£ the provisions of this act, all duties, other than the assessing'of the property of said city, belong 898 to the office of the City Assessor shall be transferred to and per- formed by the Clerk of said City of Santa Aha; and all duties, other than the collecting of taxes, belonging to the office of City Tax Collector shall be transferred to and be performed by the City Marshal of said City, and thereafter the office of City Assessor and City Tax Collector may be by ordinance abolished. Section 8. Whenever any real property situate in the City of Santa Aha after it has aviiled itself of the provisions of this act has been sold for taxes and has been redeemed, the money paid for such redemption shall be apportioned by the County Treasurer to said City of Santa Aha in the proportion which the tax due to said city bears to the total tax for which such real property was ~old. Section 9. Ordinance No. 419 of the City of Santa Ana entit- led: "An Ordinance providing for the assessment of property and for the levy and collection of taxes in, by and for the use of the City of Santa Aha for municipal purposes", and all ordinances pr parts of ordinances in conflict with this ordinance are hereby repealed, provided however, that ~his ordinance shall not affect the collection and sale of property for taxes for the fiscal year 1914-15. The Board of Trustees of the City of Santa ~hua, do ordain as follows:- SECTION 1. That the right be and the same is hereby granted to Pacific Electric Railway Company, a corpo~'ation, its successors and assigns, to construct and for a period, of fifty years to maintain and operate, a single track electric railroad across and upon Fourth Street, and two single electric railroad tracks across Third Street, over the routes described as follows:- Co~encing at a point in the present constructed south track of the Pacific Electric Railway on Fourth Street, distant easterly thereon 224.0~ feet from the center line of French Street; thence easterly along a curve concave to the south and having a radius of 150 feet, a distance of 37.39 feet; thence southeasterly, tangent to said curve, S feet; thence southeasterly along a tangent curve concave to the southwest and having a radius of 175 feet, a distance of 66.95 feet; to a point in the south line of Fourth Street distant easterly thereon $28.29 feet from the center line of French Street. Said grantee, its successors and assigns, shall use in the construction of said work the best materlal~ including r~ Is weighing not less than sixty pounds per yard, and the grantee hereof shall pave or macadamize said road between the rails and for two feet on each side thereof with the same material used by the city upon the streets over which said tracks run, and keep the same in repair flush with the street, and shall make the roadbed conform at all times to the established grade of said streets, and all repairs and grades to be made un~er the instruction and to the satisfaction of the Street Superintendent of the Board of Trustees of said City; in case the said grantee fails to comply with the instructions given for said repairs for ten days after ser~dce of notice thereof, the City of Santa Ana may enter upon the road of said grantee and do the work and keep an itemized account thereof, which said grantee, by acceptance of this franchise, agrees to pay i~nediately on the presentation to said grantee of said account. Provided, however, that said grantee and its assigns shall comply with the provisions of all ordinances of said city now in 2orce or that may hereafter be enacted relative to the placing of all poles and wires, and making all excavations in public streets of said city for the placing of obstructions thereon. Provided, further, ti~at said grantee or as:~igns shall construct all necessary flumes and culverts for the Free passage of water under the tracks of said r~lway where and whenever necessary, and that all curves, aqueducts, turnouts and switches shall be constructed under plans and specifications approved by the City Engineer; or by the Board of Trustees of said City; and it is understood that said grantee or assigns shall have the right to excavate and remove portio~ of the street necessary to pro~ fly construct said roads, and to erect needful ap!:a, atus, boilers, engines, etc. to properly equip and run the same. It is further understood that the City, in making the grant of this franchise, expressly reserves the right to pave, macadamize, remove or sewer any of said streets, or lay gas and water or other pipes therein, such work to be done so ss to in.iure said roads as little as possible. ~ECTION 111. The above rights and privileges are granted upon the ex[~ess condition that work upon said tracks shall be begun within four months of the taking effect of this o~'dinance, and continue diligently thereafter and shall be completed within twelve months thereafter, it being unde~'stood that in case any portion of said tracks is unused and unoperated for six months after completion, then that part of the tracks shall become forfeited and all rights granted herein shall determine and cease as to the unused portion of said street. SECTION IV. The grant of this fr~mchise is effective only upon the further condition that the grantee, within five days after said ~ranchise is awarded to it, file with the Board of Trustees a bond running to said City in the penal s~n of One Thousand Dollars with at least two good and sufficient sureties, to be approved by said Board of Trustees, conditioned that said grantee shall well and truly observe, fulfill and perform each and every term and condition of said franchise, and that in case of any breanch of condition of said bond the whole amount of the penal sum therein named shall be taken and deemed to be liquidated damages, and shall be recoverable from the principal and sureties upon said bond. If said bond be not so filed the award of said franchise will be set aside, and any money paid therefor will be forfeited. SECTION V. That said grantee, its successors or assigns are hereby re~ired to file a written acceptance of the terms and conditions thereof with the Clerk of said City within thirty days after the passage of this ord'~nance.
