TO RESTORE TO LOCAL AGENCIES LEGISLATIVE CONTROL OF
OFFENSES THAT OUTRAGE PUBLIC DECENCY
WHEREAS, during the past eight years numerous court decisions
have held that the State Legislature has preempted the field of
control over sexual activity, pictorial and printed pornographic
material, and indecent exposure of the human body.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana firmly believes these matters to be maters of local
concern which should be subject to the legislative control of the
city councils and boards of supervisors.
BE IT FURTHER RESOLVED: That this City Council supports and
urges the adoption of a Cons~tutional amendment or legislative
enactment to return to the control of counties and cities the right,
by properly adopted ordinances,to regulate sexual activity and to
prohibit or regulate the distribution of pictorial or printed
pornographic material, and to prohibit the exposure of the human body
in a manner that would outrage public decency.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 15th day of November, 1965.
