HomeMy WebLinkAbout1930 (#908-934) ORDINANCE NO. 908 AN ORDINANCE GRANTING PACIFIC ELECTRIC RAILWAY COMPANY, A CORPORATION, AUTHORITY TO CONSTRUCT AND FOR A PERIOD OF FIFTY YEARS TO MAINTAIN AND OPERATE TROLLEY WIRES ~ND OTHER WIRES UPON POLES AND FIXTURES TO BE ERECTED ALONG THIRD STREET BETWEEN LACY STREET AND MAPI~E STREET IN THE CITY OF SANTA ANA, CALIFORNIA. WHEREAS, the Pacific Electric Railway Company~ a corporation, now main- tains an electric railroad system in the City of Santa Aha using as a motive power therefore electricity, which power is conducted on lines supported upon poles constructed on and along certain public streets in the City of Santa Ana, State of California, one of which pole lines is now maintained and operated along First Street between Lacy Street and Maple Street in the City of Santa Aha, State of California, and WHEREAS, it is the desire of the City of Santa Aha to have said pole line removed from First Street because of the widening and improvement of said First Street. NOW, THEREFORE, the Board of Trustees of the City of Santa Ana does ordain as follows: Section 1. That peEnission be and the same is hereby granted to Pacific Electric Railway Company to construct, and for a period of Fifty (50) years to maintain and operate its trolley wires, trolley suspension wires, trolley feeder cables, transmission wires~ telephone wires and other wires or adjuncts necessary and convenient for the operation of its railway, supported upon poles and fixtures to be constructed adjacent to and back of the south curb or curb line of Third Street over the following described route, to-wit: Beginning at the Westerly side of Lacy Street and running Westerly therefrom along the Southerly side of Third Street for a distance of 817 feet. Section 2. The above rights and privileges are granted upon the express condition that the work upon said pole line shall be begun w~t~hin~ ~our (4) months of the taking effect of this ordinance and continued diligently thereafter and in good faith and shall be completed within twelve (l~) months thereafter. ~ection 2- The grant of this franchise is effective only upon the further condition that the grantee within five (5) days after said franchise is awarded to it shall file with the said Board of Trustees a bond running to said Cit in the penal stun of One Thousand ($1,000.00) dollars with at least two good and sufficient su~eti~s~ to be approved by said Board of Trustees c~nditioned that sai~ grantee shall well and truly observe, fulfill and perform each and every term and condition of such bond the whole amount of the penal stun therein ns~ued shall be taken and deemed to be liquidated damages and shall be recoverable from the principal and sureties upon said bond. If said bond be not so filed the award o£ said franchise shall be set aside and any money paid therefore will be forfeite~ Section 4. That said grantee, its successors or assigns are hereby required to file a written acceptance of the terms and conditions thereof with the Clerk of said City within thirty (30) days after the passage of this Ordinance. Section 5. That the City Clerk shall certify to the passage of this ordinance and shall cause the same to be published once in the Santa Ana Daily Register, a newspaper published in the City of Santa Aha. Purinton President of the Board o£ Trustees of the City of Santa Anae 0RDINM~CE N0. 909 AN ORDINANCE OF THE CITY OF'SANTA ANA PROHIBITING THE ERECTION OR MAINTENANCE OF SIGNS UPON SANTA ANA BOULEVARD, FROM CHAP~N AVENUE TO MAIN STR~T AND FLO%%~R STREET BETV~EN SANTA ANA BOULEVARDAND SEVENTEENTH STREET, AND Ftt0VIDING A PENALTY FOR THE VIOLAT~0N THEREOF, The City'Council of the City ~f Santa Aha do ordain as follows: E~¢tion 1. That it shall be uhlawful for any person~ firm or corporatio to erect or maintain any advertising sky sign, electric sign or any other sign or device for advertising purposes, upon or along property adjoining Santa Ana Boulevard from Chapman Avenue to Main Street, or Flower Street from Santa Ana Boulevard to.Seventeenth Street. Section 2. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be subject to a fine of not more than Three Hundred Dollars ($500.00), or by imprisonment in the County Jail of the County of Orange for a term not 'exceed- ing sixty (80} days, or by both such fine and imprisonment. Section 3. That the City Clerk shall certify to the passage of this ordinance and cause the same to be published three (3) times in the Santa Ana Daily Evening Register, a daily newspaper printed, published and circulated in the City of Santa Ans. Section ~. That this is an emergency ordinance for the immediate preservation of the public peace, health or safety, in this, that certain persons threaten to erect or maintain certain signs upon and along property adjoining the above mentioned streets and unless this ordinance shall take effect immediately upon its final passage and adoption there is danger of the beauty of said streets being impaired by the erection of large and unsightly advertising signs along said streets prior to the time within which this ordinance would take effect, and for that reason this ordinance shall take effect and be in force immediately upon its final passage and adoption. Said election shall be held and conducted in accordance with an Act of the Legislature of the State of California entitled "~ Act to Provide for the Hecall of Elective Officers.of Incorporated Cities and Towns" (Statutes Ektra Session 1911, Page 128), and with the General Election Laws of the State of California, so far a~ the same may be applicable thereto. The poll~ shall be opened at six o~clock A.M. on the day of said election, and shall be kept open until seven o'clock P.M. of said day, at which time the polls shall be closed. Each of said election officers shall receive a compensation of $8.00 for his or her services. Section 4. That the City Clerk is hereby instructed to pr§pare and cause to be~printed in the manner provid~d~by l~w all supplies required for said election, and a sufficient number of ballots therefor, and to furnish and provide the same for the use of the voters at said election, and said City Clerk shall also cause to be printed such~sam~le ballots as may be required by law, and shall caus$ such sampl$ ballots to be mailed to the electors of said City within the time prescribed by law. Section S. That there shall be printed upon the sample ballot which sh~ be mailed as hereinbefore provided for by the City Clerk of said City, in not more than two hundred (200) words, the reasons set forth in the Recall Petition for demanding the recall of the members of the City Council named and designated said Petition, and upon such sample ballot there shall also be printed, in not more tha~ two hundred (200) words, a statement by each of said officers sought to be recalled whereby they justSfy Sheir c~ur~e in office. That in addition there shall be printed on the recall ballot, as to each officer whose recall is to be voted on there at, the following question: "Shall J. L. McBride be recalled from the Office of Trustee from the First ~'ard?" '~'Shall Stanley E. The City Council of the City of Santa Ana do ordain as follows: Section 1. That in accordance with the provisions of an Act of the Legislature of the State of California, entitled "An Act Requiring the Recordin~ of Maps of Subdivisions of land in certain cases; prescribing the conditions on 'which such maps may be recorded, etc.", approved June 1V, 1929, Statutes of 1929, Chapter 837, Page 1V90, the following subdivision regulations are hereby adopted, and the same must be complied with before any subdivision may be approved by the said City Council, City Planning Commission, or any officer of said City authorize or required to pass upon any tentative or final map of a subdivision coming under the Jurisdiction of said City: (a) In the event that the subdivision, or any part thereof, is subject to a special assessment which may be paid in full, the subdivider is authorized, in lieu of paying the same in full, to file a bond with the Board of Supervisors of the County of Orange, in an amount not less than the unpaid balance of the principal of said special assessment~ payable to the County of Orange as Trustee for the assessment bond. holders for the payment of such special assessments. Section 2. That all ordinances or parts of ordinances in conflict here with are to that extent hereby repealed. Section 3. That the City Clerk shall certify to the passage of this ordinance and cause the same to be published three times in the Santa Ana Daily Evening Register, a daily newspaper printed, published and circulated in the City of Santa Ana. That this is an emergency ordinance for the immediate preservation of the public peace, health or safety for the following reason: That there are several subdivision maps now ready for presentation to the City of Santa Aha for approval and it is necessary that subdivision regulations be adopted by said City, and in effect in order that the said subdivisions may be laid out and made to =onformwith the regulations herein provided, and as required by the State Law in order to protect the said City from allowing any subdividers to sell property by metes and bounds, or in any other manner than in accordance with the regulations herein set forth, and for that reason this ordinan shall take effect and be in force immediately upon the date of its final passage. Section 5. The office of Plaster Inspector of the City of Santa Aha is hereby created, such Inspector to have had five years practical experience as a Plasterer, and the appointment to such office shall be made by Resolution duly passed by said City Council. Said resolution shall also fix the salary or compensation to be paid the appointee therein named, and such appointee shall hold office during the pleasure of said City Council. It sb-ll be the duty of the Plaster Inspector to do all the inspection of buildings and structures, or parts thereof, required to be made by the terms of this ordinance. The Plaster Inspector shall be under the general supervision and control of the Building Inspector of the City of Santa Ans. Section 2. It shall be unlawful for any person to do or cause to be done any lathing or plastering, or any alteration of lathing or plastering, in or upon any building or structure unless such lathing or plastering is done in the manner and of the materials hereinafter specified in this ordinance and u~less all the In-pectioas thereof are had and done by the said Plaster Inspector as required herein. Section 3. The term "Plastering Contractor" shall include any person, firm or corporation, general contractors or builders or any one doing or causing to be done any plastering on any building or s~ucture in the City of Santa Aha. Section 4. Any person, firm, general contractor, corporation or any one building to sell, doing plastering in the City of. Santa Ana shall first before doing any plastering obtain a license so to do. Such license shall be issued by the City Clerk of the City of Santa Ana only to such person, firm or corporation as hereinbefore stated,. the holder of a State Contractor's license, upon the payment of a fee of twenty dollars ($20.00) per year or any portion of a year, payable ~uually in advance. It is hereby declared to be u~lawful for any person to engage in the business of plastering or to take a contract for plastering any building ~ to do any plastering for which a plaster permit i~ required without holding a plastering license. Section 8. This license may be revoked by the City Council if it is found that the contractor holding such license has deliberately and wilfully violated the provisions of the Plastering Ordinance, and no license shall be issued him during the period of twelve (12) months following the revocation of his license. Section 6. No license shall be issued as in Section No. A provided, for any plastering or lathing in or upon any building or structure, within the City limits of Santa ~na, until said persnm, association or corporation has made and executed a bond by a reliable bow~mg company in ~he amount of One Thousand ($1,0Q0.O0) dollars; payable to the City of Santa Aha, and approved by the Px~sident~,of the Board of Trustees of the City of Santa Aha, which bond shall be conditioned that the principal shall faithfully abide b~, and conform to the provisions of this ordinance and that any person suffering d-m-ge by reason of a violation of any of the conditions of this ordinance by the principal,,may sue~~ amd recover thereon imhis, its or their own name. Lathing con- tractors shall be bonded for five hundred ($800.00) dollars subject to the same ruling as plasterers' bonde 208 Section 7. PERMITS. It shall be unlawful for any person, firm or corporation to do or cause to be done any plastering or lathing in or upon any buildimg or structure, which work.exceeds twenty-five ($25.00} dollars in cost, unless a permit so to do has been first obtained as in this ordinance provided. Section @. FEES. The fees to be paid to the Building Inspector for th. issuance of a permit for each building on which work is to be done shall be one cent per yard to fifteen hundred (1500) yards; 1/2 cent per yard for the next fifteen hundred (1500) yards and all over three thousand (3000) yards 1/A cent per yard for interior and exterior plastering. There shall be a minimum charge of one ($1.00) dollar. Section 9. It shall be unlawful to lath, plaster, seal or in any m~nuer conceal any part of any building under construction until same has had a "Final O.K." by the Building Inspector. Section 10. That three copies of a Code in book form establishing rules and regulations for plastering in the City of Santa Aha have heretofore been filed with the Clerk of the City of Santa Aha, ~d said Code is hereby adopted and made a part of this Ordinance by reference the same as though set forth in full herein. Section 11. That any person, firm or corporation who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction 'thereof shall be punishable by a fine of not more than Three Hundred Dollars ($300.00), or by imprisonment in the County Jail of the County of Orange, for not more than six months or by beth such fine and imprisonment. Section 12. If any section, subdivision, sentence, clause or phrase of this Ordinance is for any reason held to be maconstitutional, such decision shall not affect the validity of the remaining portion of this ordinance. The City Council of the City of Santa Aha hereby declares that it would have passed this ordinance, and every section, subdivision, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, subdivisions, sentences, clauses or phrases be declared unconstitutional. , Section 13. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and the same are hereby repealed. Section 14.' The following terms are used as classifications of commercial signs. The term "ground sign" w~e~ used in th~s ordinance means any sign which is supported by uprights or braces, placed upon tha g~ound and not attached to an part of any building. The term "roof sign" when used in this ordinance means any sign erected, constructed or z,~intained upon the roof or firewall of any building. The term "wall sign" when use~d in this ordinance means any sign that is affixed to the front, rear or side wall of any building, or signs painted on walls of buildings. The term "projecting sign" when used in this ordinance means any sign projecting over the sidewalk or building line, ~ut. shall not be held to include an electric sign, sign or marquee on awning or electric globe. Tho term "marquee sign" when used in this ordinance moans any sign affixed to or a part of any hood o~ canopy over the entrance or extending wholly or in part across the sidewalk and supported by the building. The te~n "ten~ora~y sign" when used in this ordinance means a sign made of muslin~ or other cloth, mounted on suitable frmne and attached to exterior of the building. Section ~. No person, firm or corporation .shall engage in the business of painting, constructing or erecting co~nercial sig~s without first procuring a license to conduct such business, unless the painting, constructing or erecti~g of such signs shall be in connection with the business conducted by such person, firm or corporation painting, constructing or erecting the same and on the proper~y upon which such signs are painted, constructed or erected, provided, ~ow- ever, that this clause shall not be construed to except any person, firm or corporation who shall contract with th~ owner of the business upon the property where such sig~ns are painted, constructed or erected from procuring the license herein required. The license fee herein required shall be twenty-five dollars, (i~o.00) per year, payable in advance on the 1st day of January of each year, or prorated on that basis for any person co~mnencing business during the year for the unexpired balsmce of such year. In ordsr that this ordinanc$ may be enforced the City Clerk or License Collector may demand to see a copy of the City License granting permission to transact the busi~ess of painting, erecting or constructing signs herein required from any individual found painting, constructing or erecting signs in the City of Santa ~ma, or upon refusal to produce such license the City Clerk or License ColIector shall stop further work zmtil such license is presented. That nothing in this section shall be construed as applying to the holder of a business license ~vho employs a card writer regularly to paint cards or placards for thei~ O~V~l use. Section Z. That all ground si~ns must be erected in a substantial manner to withstand a wind pressure of twenty (20) pounds to the square foot. All roof signs must be of metal, but may have a wood frame or band, and must be erected to withstand a wind pressure of twenty (20) pounds to the square foot. All projecting signs shall not project more than twenty-four inches over the sidewalk or property line and shall be substantially placed and erected so as to withstand a wind pressure of twenty (B0) pounds to the square foot of surface, and the lower part shall clear the sidewalk at least eight feet. That nothing in this section shall be deemed or construed as prohibiting the painting or erecting of commercial signs on fences or temporary structures built over the sidewalk, or property line durLug the building or remodeling of any structure. Section 4. Temporary signs shall be erected for a period of not more than thirty (30) days. -Every temporary etgn~shall contain in the lower left hand corner, in letters which can be clearly read from the sidewalk, the date of erection of same and by whom. That no wall sign shall project beyond the building line more than twelve inches. If projecting the bottom of such sign must be at least eight feet from the sidewalk. All such wall signs must be safely and adequately attached to said building. No wall sign shall be so erected as to cover the doors or windows of any building, or otherwise prevent free ingress or egress to or from any window, door or ~fire escape of any building. Section 8. Should any ground sign, roof sign, wall sign, projecting sign, marquee sign, or other sign, be or become unsecure or in danger of falling or otherwise unsafe in the opinion of the Building Inspector the owner or lessee of the premises upon which such sign is erected shall be notified to remove or properly secure said sign, and in the event he or they shall fail for a period of ten (10) days after such notice to secure the same in a manner, to be approved by the Building Inspector in accordance with the provisions of this ordinance, the Building Inspector shall have the power to remove such sign at the expense of the o~,~er or lessee of said premises. Section ~. No existing ground si~, roof sign, wall sign, projecting sign or marquee sign s~all be enlarged, rebuilt, structurally altered or relocated, e~cept in accordance with the provisions of this ordinance. This provision shall not however, relieve the o~mer or lessee of the premises upo~ which any sign is now existing from the duty of safely maintaining such sign in accorda~ce ~ith this ordinance. No sign of any d scription shall be installed, erected or constructed in such~ a manner as to obstruct any fire escape or any window or door, nor shall any sign be attached in any form or manner to a fire escape of any building or str~cture. Every ground sign, roof sign, ~all si~, projecting sign or marquee sign here- after constructed or maintained shall be plainly ~narked with tho n~ne of the person, fi~uu or corporation erecting and maintaining such sign. Any person, firm or corporation occupying any vacant lot or premises with a ground sign shall be subject to the smue duties and responsibilities as the o~.ner of the lot or premises with respect to keeping the sau~e clean, sanitary, inoffensive and f~ee 216 and clear of all noxious substances in the vicinity of such ground sign. Section 7. That any person, firm or corporation violating any of the provisions of this ordinance shall be i~nishable by a flue of not exqeeding One Hundred Dollars (iil00.O0), or by impriso~nent in the County Jail of the Co~ty of Orange, for a period not exceeding thirty (50) days, or by both such fine and imprisonment. That every day upon which any person, firm or corporation shall continue to violate the provisions of this ordinance shall be considered as a separate and distinct offense under the terms hereof. Ail ordinances or parts of ordinances in conflict with the provisions of this ordinance are to that extent hereby repealed, provided however, that nothing in this ordinance shall be interpreted as applying to advertising structures posted panels, or bill boards as defined in Ordinances 906 and 552 of the City of Sm~ta Aha. AN ORDINANCE OF THE CITY,OF SANTA ANA, PROVIDING FOR THE ESTABLISH~T GF A BOARD OF EXAMINERS FOR THE EXAMINATION OF ELECTRICIANS; PROVIDING FOR THE LICENSING OF ELECT- RICIANS AND THE FEES FOR SUCH LICENSE; PROVIDING A PENALTY FOR THE VIOLATION OF SAID SP~INANCE; AND REPEALING ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE. The City Council of the City of Santa Aha do ordain as follows: Section 1. DEFINITIONS. The following words and phrases when used in this ordinance shall have the meanings attached to them by this section: (a) Board of Examiners: The Board of Examiners of Electricians established by this ordinance. (b) Master Electrician: For the purpose of this ox~llnance, a Master Electrician shall be deemed to be any person, finn or Corporation engaged in or ca~rying on the business of electricial contracting. (c) Journeyman Electrician: Any persnn, except a Master Electrician or an apprentice, who is employed to do elec~rioal~work for a wage or salary, either by the day, week er month, but who does not furnish any materials or supplies in the exeeution or performance of any such electrical work where the voltage on the work done exceeds thirty (30) volts. . . (d) Apprentice: Any person, except a Master Electrician or a Journeyman electrmcian, doing electrical work under the supervision and direction of a certified Master Electrician or a certified Journeyman electrician. (e) Master Electricians~ Certificate: A certificate issued by the Board of Ex-miners stating that the holder thereof is qualified to act or serve as a Master Electrician in the City of Santa Ana~ California. (f) Journeym, n electricianst certificate: A certificate issued by the Board of Ex-mtuers stating that the holder thereof is qualified to act or serve as a journeyman electrician in the City of Santa Ana, California. (g) Certificate cf Qualification: Either a Master Electrician certificate or Journeyman electricians' certificate as herein defined.. Section 2. ORGANIZATION OF BOARD OF EXAMINERS. (a) A board to be designated as the Board of Ex-~tuers of Electricians is hereby created. The Board of Ex-m~uers shall consist of one Masker electrician and one Jour$eyman electrician, each of whom shall have been actively engaged at the business or trade of electrical work in the State of California for a period of at least five (5) years prior to his appointment to said Board, and the City Electrician of the City of Santa Am,. Ail members of the Board of Examiners shall have received a certificate of qualification except the members of the first Board of Examiners. The two members of the Board of E~aminers besides the City Electrician shall be appointed by the City Council. The City Electrician shall designate the chairman of said Board. (b) I~ shall be the duty of said Board to hold regular meetings on the first business day of January, April, July'and October of each year for the purpose of examining applicants for certificates of qualification, and for the direction of any other lawful business of said Board. (c) The Board of Examiners shall hold as many special meetings as its business may require. Special meetings of said Board may be called by the Chairman or by two members thereof. Notice of any special meeting specifying the object and the time thereof, signed by the chairman, or by two members of said Board~ shall be served personally upon each member of said Board at least one hour prior to the time designated for the meeting, or shall be served by leaving a copy thereof at his plase of business at least one hour prior to the time designated for the meeting, if served between 7 ! o clock in the morning and 5 o clock in the afternoon, when such place of business is' known, or if not known or if served at any other time, by leaving a copy of such notice at his residence, at least one hour prior to the time designated f~r the meeting, (d) At all meetings of the Board of Examiners a majority of the Board shall constitute a quorum for the transaction of business. The members of the Board of Ex,mlners shall receive such compensation as may be fixed by the Chairman of the Board of Examiners, provided, that such compensation shall be payable only from the fees for ex-mluation provided for in this ordinance. Section 3. TERMS OF OFFICE. The term of office of appointed members of the Board of Examiners shall be two years and or until their successors are .appointed and qualified, ,mless sooner removed for cause by the City Council. The first two members appointed shall so classify.themSelves by lot that the tex-m of office of one shall expire one year after January 1~ 193I~ and the other two years after January 1, 1531. Section 4. RULES 0F BOARD OF EEAMINERS. (~)' It shall be the duty of the Board of Examiners to examine in such ~nner as it may deem proper, all applicants for certificates of qualification, such ez*mtnatioz to be held at the office of the Board of Ex-m~ners, the dates specified in Section hereof. (~) The Board of Ex-~tners shall immediately upon its organization adopt its 218 ~ules and methods of procedure governing applications, examinations and the issuance of certificates of qualifications. These ~ules shall be printed and available to the public ~without cost. The Board of Examiners may from time to time modify these rules and methods of procedure. (c) The Board of Ex-~tuers shall adopt an application form which it m~st supply upon demand to all persons wishing to apply for a certificate of qualifications. (d) The Board of Examiners shall adopt forms for all certificate forms to be issued by it, a~d these forms shall set forth that the holder of a cert- ificate has been examined by the Board of Examiners, has been found competent, and is qualified and entitled to act er serve as a Master Electrician or as a Jou~ney- man electrician. Section 5. SECRETARY (a) The Board of Examiners may employ a clerk or stenographer who shall act as Secretary of the Board of Examiners. The compensation of such Secretary shall be fixed by the Board of ExAminers, and be payable from the fees provided fox herein. (b) It shall bo the duty of the Secretary of the Board of Examiners to keep full and complete record of the proceedings and acts of said Board. The Secretary shall register in a book kept for that purpose the.name, residence and place of business of every person holding a certificate of qualifications engaged in or working at the business or trade of electrical work in the City of Santa ~a California. The secretary shall provide all applicants for a certificate of ~alification with appliCation blanks, and shall receive and file the same with the Board of Examiners when properly filled out by the applicant. (c) The Secretary shall mail to each applicant a notice stating the date and hour and the place where he will be examined by the Board of Ex-m~nerse Such notice shall be mailed at least one week before the date set for~the examination, and shall be addrAssed to the applicant at his address as given in his applicattone (d) The Secretary shall mail to each registered holder of a certificate of qualification, between December 1st and Sth of each year, a notice of the expiration of such certificate. Section 8.- CERTIFICATES. (a) W~.~en ,a~ applicant for a ~aster Electrician's certificate shall have appeared before the Board of Ex,mlners and shall have passed a satisfactory exam~nation, the Board of Examiners shall issue to him a Master Electrician's certificatee Such Master Electrician's certificate shall entitle the holder to engage in the business of electrical work and to direct the work of JourneymAn electriciana~ (b) When any applicant for a Journeyman electricianscertificate shall have appeared before the Board of Examiners and shall have passed a satisfactory examination, the Board of Ex-m~uers shall issue to him a Journeyman electrician's certificate.. Such certificate shall entitle the holder to act or ser~e as Journeym-n electrician in the City of Sant~ Aha, California. (c) The Board of Examiners shall not issue any certificates unless and until the applicant shall have filed a proper application and passed a satisfactor examination. (d) When an application for a Jo-u~neym-u's certificate is filed more tbs~ two weoksbefore the date of the next examination the City Electrician may issue to the applicant a temporary permit to do electrical work without a certificatee Such temporary permit shall e~pire on the ~ate on which the next examination is held, unless sooner revoked as provided in Section 10 hereof, and shall not be renewed. No such temporary permit shall be issued to a person who has failed, without sufficient reason, to take an examination for a certificate on the first regular examination after the filing of his application, or who has failed to pass an examination. (e) Ail certificates issued by the Board of Examiners shall expire on the last day of December of the year in which they were issued unless sooner revoked as provided in Section 10 hereof, or renewed as provided in subsection (f) hereofe (f) The holder of a Master Electrician's certificate or of Journeym-~ electrician's certificate may apply between the first day of December and the 81st day of December to the Board of Examiners for a renewal of his certificate for one yeaa~. If no charges as provided in this ordinance have been filed against him~ the Board of Examiners shall on or before the first day of the next January issue to him a renewal of his certificate for one year. Section ~. EXAMINATION. (a) Before issuing any certificate of qualifications to an applicant the Board of Examiners shall subject the applicant to a thorough examination which shall be designed to test his knowledge, both theoretical and practical, of any work which he might be called upon to do. Such examination shall also test his knowledge of all ordinances of the City of Santa Aha, California, ~overning the installation of electrical work and all laws or rulings of the State of California governing this subject, which are applicable in the City of Santa Aha, California. The applicant shall also be required to demonstrate his ability to perfox~m in a workmanlike m-uner the various operations incidental to the installation of ~lectrical worE. (b) Any applicant failing to pass a satisfactory examination shall be i~eli~ible for re-examination for a period of four (4) weeks after his failure to pass an examination. After four (4) weeks he may file another application and the Board of. Examiners shall give him another examination. Any applicant who shall three times fail to pass an examination shall not be eligible for re-examination for twelve months after his last examination. Section 8. F~.ES (a) Each applicant for a Master Electrician's certificate shall pay to the Secretary of the Board of Examiners the sum of fifteen dollars at the time he files his application. (b) Each applicant for Journeyman electrician's certificate shall pay to the Secretary of the Board of Examiners the sum of five dollars at the time he files his application. (c) Should any applicant fail to pass an examination, or, after having been duly notified thereof, fail to take an examination, unless satisfactory cause is shown to the Board of Examiners, the Secretary of the Board shall retain the fee to cover the cost of the examination. (d) ~en certificates are renewed without examihation the fees shall be one dollar for a Master Electrician's certificate and one dollar for a Journeym-~ electrician certificate, provided that where an application for a renewal is not filed before December 31st the renewal fee shall be the same as if an examination'were required. (e) Ail fees collected by the Secretary of the Board of Examiners shall be handled and disbursed by the said Board of Examiners. (f) Should any electrician operating under a temporary permit repel to take his ex,m~nation when notified, without sufficient reason he shall not be entitled to receive any refund from the fee deposited with his application fbr a certificate nor shall any refund be made to him. Section 9. CHARGES AGAINST CERTIFICATE HOLDERS. (a) Any person may file with the Secretary of the Board of Ex'~ziners written charges against the holder of any certificate issued by the Board of Exa~iiners, or of any temporary permit issued by the City Electrician. Such charges shall state in detail the nature and substance of the matters charged and must be signed with the full name and correct address of the person making the charges. (b) The Secretary shall transmit such charges to the Board of Ex-miners at its next meeting thereafter and the Board shall give careful consideration to such charges. Section 10. SUSPENSI0~ OR CANCELLATION OF CERTIFICATE (a) Should the Board of Examiners find that the holder of any certificate issued by it, or temporary permit issued by the City Electrician~ has wilfully violated any of the provisions of this ordinance, or of any ordinance of the City of Santa Aha, or any law or ruling of the State of California, governing the in~tallation of electrical work in the City of Santa Aha, or is guilty of any offense involving moral turpitude, it in its discretion may suspend or revoke his certificate Or temporary permit. (b) Should the Board of Exam!nors find that any certificate issued by it or any ~emporary permit issued by the City Electrician has been obtained by fraud, it shall immediately revoke such certificate or temporary permit. (c) The Board of Examiners shall not suspend or revoke any certificate or temporary permit until it shall have given the holder thereof at least ten (10) days written notice to appear before it and show cause why his certificate or temporary permit should not be suspended cr revoked. In showing such cause he may be represented by an attorney and may introduce evidence. (d) When the Board of Examiners shall suspend or revoke any certificate or temporary permit no refund of fees shall be made to the holder thereof· SeCtion 11. APPEALS· (&) Whenever any person shall be aggrieved by any finding or decision of the Board of Examiners, such persons may appeal from such finding or decision to the City Council, whose duty it shall be to hear and pass upon the same· ' (b) No such appeal shall be allowed by the City Council of Santa Aha unless the applicant shall first deposit with the Secretary of the Board of Examiners the sum of fifteen dollars ($1~.00) as costs of such appea~i!to be taxed as hereinafter provided, and shall within ten (lC) days after the finding or decision of the Board of Ex-m~ners appeal and file with the said City Council of Santa Aha. a statement of his position, stating wherein he has been prejudiced or aggrieved by ~he finding or decision of said Board of Examiners. If the applicant shall prevail 6n appeal, his deposit for costs shall be returned to hlmby the secretary.of the Board of Examiners; if his appeal is rejected by~the City Council said fee shall be retained by the Board of Examiners. (c) When any person shall have complied with the provisions of subsections (a) and;(b) of this section, i$ shall be the duty of the City Council, within t-~l~-~ (20) days thereafter, to ex-m~ne into and de~ermine said appeal and if the members of said 22O City Council be of the opinion that a correct detAx'mination of applicant's complain cannot be had without the aid of the Board of Examiners they~ay call in said Board of Examiners and when notified that its aid and advice are required by the City Council, shall assist in determination of such appeal as an advisory body. The City Council shall certify to the Board of Examiners the results of its detemmimation of all appeals and when so certified the same shall be spread upon the record of the Board of Examiners and said Board of Examiners shall begoverned by and forthwith make all necessary orders to give full force and effect to the decision of said City Council. Section 12. REGISTRATION. Every person who shall have obtained from the Board of Examiners, a certificate as provided by this ordinance, after procuring said certificate and before engaging in or doing any electrical work, or laying out or'electrical system of any hour, building or structure in the City of Santa Aha shall first register his name and address as well as the location of his place of business with the Secretax~ of the Beard of Ex-mlners. Every person so registered shall notify the Secretary o~the Board of E~am~ners of any change in his add~ess or place of business~ith~rive (5) days after the same shall have been made. Section 13. E~IBITING CERTIFICATE. (a) Every Master Electrician as herein defined having a certificate effective under the provisions of this ordinance and carrying on the business or trade of electrical work at a fixed place of business shall keep such certificate posted and exhibited while in force in some conspicuous part of said place of business. (c) Every person having a certificate effective under the provisions of this ordinance shall produce and exhibit the same whenever requested to do so by any police officer or'by the Electrical Inspector or any officer authorized to act under the provisions of this ordinance. Section 14. LICENSE No electrical permit shall be issued to angelectrician unless he shall have first obtained a Master Electrician's certificate from the Board of Examiners, and have paid the annual license fee. Section 15. UNLAWFUL TO DO ELECTRICAL WORK WITHOUT CERTIFICATE (a) It shall be unlawful for any person to carry on, do or engage in any electrical work on private property, or do similar work affecting the electrical system of any house, building or structure in the City of Santa Aha without a Master Electrician's certificate or without a Journeyman electrician's certificate, as the case may be, provided that apprentices of Master Electrician's may assist in such work or perform such work in the presence of and under the direction of a registered Master or Journeyman electrician who shall Be responsible for the work of such apprentices. (b) In the case of a firm or corporation engaged in any such electrical work the provisions of this ordinance relative to certificate of qualifications shall be deemed to be complied with if the member of such firm, officer of such corporation, foreman or other persons in charge of electrical work for such firm or corporation shall have received a master electrician's certificate. Provided, however, that said Master Electrician's certificate shall be issued only in the name of such firm or corporation by wh°m the person taking the examination is employed, and said ~s~er Electrician's certificate shall remain in force and effect only so long as the persons actually taking the e~mlnation shall remain a member of or an employee of such firm or corporation. Nothing herein contained shall be deemed to permit any person to have charge of, exercise any control over or ~.i~e~ any electrical work without having obtained a master and/or Journeym~ electrician's. Certificate. but nothing herein contained shall be construed to require a master electrician's or Journeyman electrician's certificate of any person before any such person shall be allowed to perform any electrical work upon his own property or premises used and occupied exclusively for living purposes by such persons. (c) It shall also be unlawful for any Master Electrician to employ or avail Himself of the services of any Journeyman electrician to do or engage in any work affecting the electrical work of any house, building or structure in the City of Santa Aha unless such a Journeyman shall first h~ve complied with all the provisions Of this ordinance and shall have been issued a certificate of qualifications o* a t~m?~rary permit az provided in Section 6, subsection (d) hereOfe Section l~. (a) No person, firm or corporation shall engage in the business of contracting electrical installation or inst~ lations,~alterations and or repairs for any purpose whatsoever without first having deposited with the City Clerk a bond in the sumof Five Hundred Dollars ($§00.00) and having procured a license as hereinafter provided. (b) Any person desiring to be licensed as a Master Electrician or as a Journeyman electrician must make application with the City Clerk for a license as a Master Electrician or a Journeym-n electrician. Said application must be accompanied by the sum of Fifteen Dollars ($1B.00) for a Master Electrician andby the sumof Five Dollars ($8.00) for a Journeym~u electrician to cover the e~mluation as hereinafter provided. Upon the receipt of said application, together with the sum as specified, said application with fee and applicant mast be referred to the Board of Ex-miners for an examination and upon the completion of a successful examination, said application must be returned to the City Clerk by said Boa~ of Examiners with a notation that said applicant is qualified to be licensed as a Master Electrician or a Journeyman electrician.' Whereupon said City Clerk shall notify said applicant that he has passed a successful ex-m~uation and can be licensed as a Master Electrician or as a Journeyman electrician. (c) There shall be no additional fee for a Journeyman electric~-~ but every per,on, fircuor corporation who successfully passes an examination and obtains a certificate entitling such applicant to obtain a license as a Master Electrician before obtaining such license must pay an annual license fee of Twenty-five Dollars ($28.00) for every year or portion thereof. Said fee shall bepaid in advance by any Master Electrician at the time of the issuance of the original license for said person, firm or corporation to operate as a Master Electrician. (d) It is further provided that at the tLme alicense is granted to such Master Electrician such Master Electrician must have established in the business distric' within the City of Santa Aha, a regular or established.place of business at which place of business is kept the necessary tools, equipment and merchandise for the carrying on of such business as Master Electrician. The term 'regular or established place of business~ as used in this ordinance is meant and shall be construed to mean a perm,nent Store orplace where from month to month the business of Master Electrician is generally conducted and where circumstances show an intention of becoming an established business and continuance part of the regular and legitimate life of the City and not otherwise. Section 17. PENALTY. Every person violating any of the provisions of this ordinance shall be deemed guilty cf a misdemeanor and upon conviction thereof shall be punishable by a fine of not less thanten dollars ($10.00) nor more than five hundred dollars ($500.00) or by imprizcnment in the County Jail of the County of Orange, for not more than six months, or by both such fine and imprisonment. Every such person shall be deemed guilty of a separate offense for each and every day during which any of the provisions of this ordinance are violated, and shall be ~unishable therefor as herein provided. Sectio~ 18~ Ail ordinances and parts of ordinances in conflict with this ordinance are hereby repealed, provided, however, that Ordinance No. 803 and all ordinances amendatory thereof shall be and remain in full force and effect. Section 19. If any section, subsection, sentence, clause or phrase of this ordinance shall be~6und to be unconstitutional or invalid, the~emainder of the ordinance shall not be invalidated thereby but shall remain in full force and effect. That no license for the operation cf a taxicab or for-hire vehicle shall be issued, nor shall any taxicab or for-hire vehicle be operated on the streets of the City of Santa Aha unless and until the City Council of said City has issued a certificate that the public convenience and necessity requires the operation thereof. Section 5. That an application for a certificate of public convenience and necessity shall be made to the City Council and shall set forth the name and address of the applicant, the name under which the applicant proposes to do business, where the proposed stand or garage from'-~hich the applicant will operate is to be located, the number of vehicles applicant intends to operate, the class, seating capacity, design an~ color scheme of eq~h vehicle, and the lettering and marks to be used thereof; and shall also state whether the applicant, or any of his drivers, have been convicted of any violation of any State Law. Upon receipt of such application the City Council shall make, or cause to be made, an investigation, including any hearing deemed necessary, as to each applicant for such certificate, and shall determine whether or not the public convenience or necessity requires the operation of such taxicabs or for-hire vehicles, and ~ether or not the applicant ~ts a person of sufficient financial ~eap~nsibility and suitable character and qualities to conduct 'such business. That Section 12AG of the Building Code adopted by Building Ordinance No. $19 of the City o~ Santa Aha is hereby amended to read as follows: "Section 124G. That all builders shall make application to the Superintendent of Streets for the use of any portion of any street or alley for the storage of materials, equipment, etc. necessary to carry on the construction work or erection of any building within the said city. That where permission is granted to use a portion bfa street or alley for such purpose, the contractor or builder shall erect and maintai: a board walk for pedestrians use and shall protect such board walk by erecting a wall on the building side and by covering s~id board walk with a canopy, both wall and canopy to be of sufficient strength to protect the pedestri~a:walk from any falling building materials, and in no case shall a permit be granted by the Superintendent of Streets for the use of more than ten (10) feet From the curb of any street to be used fo~ said purpose. It shall be unlawful to store earth from excavations, or rubbish or materials taken from any building, on the sidewalks or the roadway of any street or alley, but the same must be removed from day to day. Proper precautions must be taken to lay the dust from all rubbish being handled in connection with building operations. Where basement excavations are to be made under the sidewalk reservations on any street, it shall be necessary for the builder or contractor to make application to the Superintendent of Streets for such excavation. The Superintendent of Streets shall make a thorough investigation as to the underground work or public utilities occupying said street, as well as that of the water department and sewer department of said city, to determine whether or not such excavation would be advisable. Such application, together with the Street Superintendent's recommendations, must then be presented to the City Council for their approval or disapproval, and a permit granted or refused in accordance with the action of such City Council." ORDINANCE NO. 9S4 AN ORDINANCE TO DIVIDE THE CITY OF SANTA ANA INTO FIVE WARDS~ FIXING TEE BOUNDARIES TM~EOF, DESIGNATING THE NI~ER OF TRUSTEES TO BE ELECTED FROM EACH WARD, AND DESIGNATING THE MANNER OF ELECTION OF SAID TRUSTE~, AND REPEAL- ING ALL ORDINANCES IN CONFLICT HEREWITH. The City Council of the Oity of Santa Aha do ordain as follows: Section 1. The City of Santa Ana is hereby divided into five wards, and one T~ustee shall be elected from each ward; the respective Tx~astee fr°m each ward to be elected by the general vote of th~ whole City of Santa Aha. Section 2. That Ward No. 4 shall be that territory bounded by the following exterior boundary line, to-wit: Beginning at the intersection of the Westerly City Boundary Line with the center line of Fifth Street; thence Easterly along the center line of Fifth Street to the center line of Patton Street; thence Southerly along the center line of Patton Street to the center line of First Street; thence Westerly along the center line of First Street to the center line of Flower Street; thence Southerly along the center line of Flower Street to the center line of Highland Street, as it exists Easterly of Flower Street; thence Easterly along said center line of Highland Street to the center line of Ross Street; thence Southerly along the center line of Ross Street to the center line of Fairview AvenUe; thence Easterly along the center line of Fairview Avenue to the center line of Main Street; thence Southerly along the center line of Main Street to an angle point in the City Boundary line at Delhi Road; thence Westerly, Northerly, Westerly, Northerly, Westerly and Northeasterly along said City Boundary Line to the point of beginning. Section 6. That Nard No. 8 shall be that territory bounded by the following exterior boundary line, to-wit: Beginning at the intersection of the center line of Fifth Street with the Westerly City Boundary Line; thence Easterly along the said center line of Fifth Street to the center line of Olive Street; thence Northerly along the center line of Olive Street to the center line of Eighth Street; 'thence Easterly along the center line of Eighth Street to the center line of Patton StrSet; thence Northerly along the center line of Patton Street to the center line of Tenth Street; thence W~sterly along the center line of Tenth Street to the center llne of Flower Street; thence Northerly along the center line of Flower Street to the center line of Seventeenth Street; thence Easterly along the center line of Seventeenth Street to the center line of Main Street; thence Northerly along the center line of Main Street to an angle point in the Northerly City Boundary Line, approximately 150 feet Northerly from West Orange Road; thence Westerly, Northwesterly, Westerly, Southeasterly, Southerly, Westerly and Southwesterly along the said City Boundary line to the point of beginning. Section V. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. Section 8.
