HomeMy WebLinkAbout62-094MARKEL AND JOHN JEZOWSKI SUBJECT TO CONDITIONS WHEREAS, after hearing on notice, the Zoning Administrator denied Variance Application No. 1636, filed by A. C. MARKEL and JOHN JEZOWSKI to reestablish a cement contractor's office and equipment-materials yard i.n the C-1 District; and WHEREAS, the Planning Commission took no action affirming the aforesaid action by the Zoning Administrator; and WHEREAS, Appeal Application No. 61 was duly filed by Hubert Melton requesting a hearing on said Variance Application No. 1636 before the City Council and appealing the denial of said Variance by the Zoning Administrator; and WHEREAS, the City Council, after public hearing on notice, after careful consideration of the statements contained in and the materials accompanying the application, the testimony offered at the hearing, the examination of all the facts established; and after determining that said Variance Application meets the requirements of Section 9250.8 of the Santa Aha Municipal Code, it has been determined that the Zoning Administrator's decision should be over- ruled and that said Variance should be granted subject to certain conditions. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby grants a variance on Variance Application No. 1636 to permit the reestablishment of a cement contractor's office and equipment and materials storage yard in the C-1 District on certain land situated in the City of Santa Ana, County of Orange, State of California, and described as: Starting at the intersection of the center line of Sullivan Street and the center line of Edinger Street; thence West 584.62 feet; thence North 52.00 feet to the true point of beginning; .%hence North 265.00 feet; -1- thence West 240.00 feet; thence South 64.00 feet; thence East 160.00 feet; thence South 213.00 feet; thence East 80.00 feet to the true point of beginning; subject to conditions, as follows: 1. That the subdivider's engineer furnish the Department of Public Works an on-site drainage flow plan showing the direction and flow to adjacent streets when this property is developed. 2. That a deed be provided for Edinger Avenue for vehicular access rights except at street intersections. NOTE: Access can be determined and approved prior to dedication. '3. That all elevations be on 1958 Orange County Survey Datum. 4. That all plans and surveys for the required improvements be completed by the owner's engineer and submitted to the Department of Public Works for approval. 5. That the above conditions, numbered 1 through 4, are to be complied with prior to the issuance of a building permit. 6. That the owner place curb, gutter and sidewalk and pave up to the edge of existing pavement on Edinger Avenue. The new curb and gutter to be placed. 42 feet North of the center line of Edinger Avenue. 7. That the owner comply with all conditions set by Council for Record of Survey PL 256. 8. That the above conditions, numbered 6 and 7 be complied with prior to issuance of utilities release by the Building Department.
