ORDINANCE NO. 1157 ORD1-NANCE AMENDING ZONING ORDINANCE OF 1959 No. 1074 WHEHEAS, the Planning Comission of the City of Santa Ana duly declared its intention so to do and gave notice of public meetings, as required by law, and duly held two public meetings upon the question of the amendment herein contained and thereafter recomended the same to the City Council for adoption; and WHEREAS, the City Council gave due and regular notice of a public hearing to be held before the City Council and such public hearing has been duly and regularly held and the City Council does now find that public necessity requires the following amendment and change in the present classification of certain propert and the proposed uses of certain property in the City of Santa ~ua and that the proposed uses under the proposed new classification will not be detrimental to the surrounding property; NOW, THEREFORE, the City Council of the City of Santa Ana does ordain as follows: Section l: That Sheet No. 44 of the Districting Map of the City of Santa Aha be amended to reclassify as C-1 all property now and heretofore class(fie as R-1 and within the following exterior boundary lines, to-wit: A triangular piece of property extending 237' northerly along Main Street from northwesterly right of way line of Pacific Electric Ry., bounded on the North by South Santa Aha Tract and on the Southeast by the Pacific Electric Ry. That said Districting Map as so amended is attached hereto and is hereby adopted and made a part hereof. .~ection 2: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published ~n three consecutive issues of the Santa Aha Register, a newspaper printed, published and circulated in the City of Santa Aha, and hereby designated f~r that purpose. WHEREAS, the Council of the City of Santa Aha, California, did, on the 18th day of February, 1946, by a vote of more than two-thirds of the members of said Council, adopt~Resolution No. 3440 entitled "Resolution of the Council of the City of Santa Ana, California, determining that the public interest and necessity demand the acquisition and construction of certain municipal improvements and making findings relating thereto" which said resolution was duly signed and approved by the Mayor of said City and atteste and certified by the City Clerk of said City; NOW, THEREFORE, the Council of the City of Santa Ana DO ORDAIN aa follows: Section 1. That a special election be held, and the same is hereby called to be held, in the City of Santa Ana, California, on the 9th day of April, 1946, for the purpose of submitting to the qualified voters of said City four propositions of incurrin indebtedness and issuing bonds of said City therefor, in the amounts hereinafter set forth, and for the objects and purposes set forth in sai~ resolution and hereinafter stated. Section 2. That the objects and purposes for which said indebtednesses are proposed to be incurred and bonds issued therefor are as follows: BOND PROPOSITIQN NO. L: The acquisition and construction by the City of Santa Ana of a certain municipal improvement, to-wit: Street improvements in the City of Santa Aha, said improvements to consist of the construction and reconstruction of public streets in said City, including the grading and resurfacing thereof; the widening, straightening, opening and extending of ~ublic streets therein; the acquisition of all rights of way and easements necessary therefor; and the improvement of the portions of said streets so opened, widened, straightened or extended by the grading, paving and curbing thereof; including in said street improvements the construction of all culverts and drainage structures necessary therefor and the construction of a bridge on Bristol Street across Santiago Creek. BOND PROPOSITION NO. 2: The acquisition and construction by the City of Santa Ana of a certain municipal improvement, to-wit: The construction of drains, pipes, conduits, ditches and other drainage structures for the control and disposal of storm waters in said City including the acquisition of all mat®p~Al~, pipe, conduit, and easements and rights of way necessary therefor. BOND PROPOSITION NO. 3: The acquisition and construction by the City of Santa Aha ~f a certain municipal improvement, to-wit: Additions to and improvements of the sanitary sewer system of said City, said additions and improve- ments to consist of the construction of extensions of and additions to the main trunk and interceptor sewer system; the reconstruction of certain main trunk and interceptor sewers; and the reconstruction of the main trunk line sewer of the City of Santa Aha from the City of Santa Ana to its outlet at the sewage treatment plant near the southwest corner of Ellis and Verano Streets on the west side of the Santa Aha River, including the acquisition of all materials, pipe, apparatus and equipment and rights of way and easements necessary for said improvement. BOND PROPOSITION ~0. 4: The acquisition and construction by the City of Santa Ana of a certain municipal improvement, to-wit: Works and structures for the control of storm and flood waters of Santiago Creek in the City of Santa Ana, said works and structures to consist of retaining walls and the paving of the channel of a portion of said creek. Section 3. That the estimated cost of the proposed municipal improvement described in Bond Proposition No. i of Section 2 hereof is the sum of five hundred thousand dollars ($800,000.00); that the amount of the principal of the indebtedness to be incurred therefor is the sum of five hundred thousand dollars ($500,000.00); and that the maximum rate of interest to be paid on said indebtedness shall not ~exceed three per cent (3%) per annum, payable semi annually. That the estimated cost of the proposed municipal improvement described in Bond Proposition No. 2 of Section 2 hereof is the sum of five hundred seventy-five thousand dollars ($$78,000.00); that the amount of ~he principal of the indebtedness to be incurred therefor is the sum of five hundred seventy-five thousand dollars ($575,000., and that the maximum rate of interest to be paid on said indebtedness shall not exceed three per cent (3%) per annum, payable semi annually. That the estimated cost of the proposed municipal improvement described in Bond Proposition No. 3 of Section 2 hereof is the sum of three hundred thousand dollars ($300,000.00); that the amotuut of the principal of the indebtedness to be incurred therefor is the sum of three hundred thousand dollars ($300,000.00); and that the maximum rate of interest to be paid on said indebtedness shall not exceed three per cent (3%) per annum, payable semi annually. 343 344 That the estimated cost of the proposed municipal improvement described in Bond Proposition No. 4 of Section ~ hereof is the sum of one hundred twenty- five thousand dollars ($1E5,000.00); that the amount of the principal of the indebtedness to be incurred therefor is the sum of one hundred twenty-five thousand dollars (~1~$,000.00); and that the maximum rate of interest to be paid on said indebtedness shall not exceed three per cent (3%) per annum, payable semi annually. That if any proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to-wit, two-thirds of the votes of the qualified voters voting on said proposition, bonds of said City, in not exceeding the principal amount stated in such proposition, shall be issued and sold for the objects and purposes set forth in said proposition. Section 4. That the polls for said election shall be opened at seven o'clock A.M., of the day of said election, and shall remain open continuously from said time mntil seven o'clock P.M., of the same day, when said polls shall be closed, except as provided in Section $~34 of the Elections Code of the State of California. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: Mark crosses (X) on ballot 0NDY WITH RUBBER STAMP; never with pen or pencil. (ABSTENTEE BALLOTS may be marked with PEN AND INK OR PENCIL). INSTRUCTIONS TO VOTERS.. To vote on any measure, stamp a cross (X) in the voting square after the word "Yes" or after the wSrd "No." All marks, except the cross (X), are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear, or deface this ballot, return it to the inspector of election and obtain another. Section 8. That the City Clerk shall certify to the passage and adoption of this ordinance by a vote of more than two-thirds of all of the members of the City Council of said City at an adjourned regular meeting of said Cotuncil, and its approval by the Mayor of said City, and shall cause said ordinance to be published once a day for seven (7) days in the SANT~ ANA REGISTER, a newspaper of general circulation, printed and published six (8) days a week in said City. No ether notice of such election need be given. Section 9. This ordinance shall take effect upon its passage. ADOPTED, SIGNED AND APPROVED this llth day of March, 1946. BOND PROPOSITION NO. 2: Shall the City of Santa Aha incur a bonded tndebSedness in the principal sum of $$V$,000.00 for the purpose of the acquisition and construction by the City of Santa Ana of a certain municipal improve- ment, to-wit: The construction of drains, pipes, conduits, ditches and other drainage structures for the control and 'dispoSal of storm waters in said City including the acquisition of all materials, pipe, conduit, and easements and rights of way necessary therefor. BOND PROPOSITION NO. 3: Shall the City of Santa Ana incur a bonded indebtedness in the principal sum of $300,000.00 for the purpose of the acquisition and construction by the City of Santa Ana of a certain municipal improve- ment, to-wit: Additions to and improvements of the sanitary sewer system of said City, said additions and improvements to consist of the construction of extensions of and additions to the main trunk and interceptor sewer system; the reconstruction of certain main trunk and interceptor sewers; and the reconstruction of the main trunk line sewer of the City of Santa Aha from the City of Santa Ana to its outlet at the sewage treatment plant near the southwest corner of Ellis and Verano Streets on the west side of the Santa Aha River, including the acquisition of all materials, pipe, apparatus and equipment and rights of way and easements necessary for said improvement. BOND PROPOSITION NO. 4: Shall the City of Santa Ana incur a bonded indebtedness in the principal sum of $125,000.00 for the purpose of the acquisition and construction by the City of Santa Ana of a certain municipal improve- ment, to-wit: Works and structures for the control of storm and flood waters of Santiago Creek in the City of Santa Ana, said works and structures to consist of retaining walls and the paving of the channel of a portion of said creek. and WHEREAS, each of said propositions received the affirmative vote and assent of more than two-thirds of all of the qualified voters of said City voting thereon at said election, and said City is now authorized to issue bonds for the purposes specified in said propositions: NOW, THEREFORE, the Council of the City of Santa Ana do ordain as follows: SECTION 1. That bonds of the City of Santa Ana, California, in the principal sum of one million five hundred thousand dollars ($1,500,000.00) be issued and sold for the purposes set forth in the propositions in the recitals hereof. Said bonds shall be designated MUNICIPAL IMPROVEMENT BONDS 1946, shall be one thousand five hundred (1500) in number, numbered from one (1) to one thousand five hundred (1500), inclusive, and shall be of the denomination of one thousand dollars ($1,000.00) each. Said bonds shall be dated July l, 1946, and · ~hall be payable in consecutive numerical order, seventy-five (V§) bonds annually on July 1 in each of the years from July 1, 1947 to July 1, 1966, both inclusive. Said bonds shall bear interest at a rate or rates to be hereafter fixed by resolution or resolutions, but not to exceed three per cent (3%) per annum, payable semi-annually on the first days of January and July of each year. Said bonds shall be payable at the office of the Treasurer of the City of Santa Aha in said City, Orange County, California in lawful money of the United States. SECTION 2. That the executive of said City, to-wit, the Mayor and President of the Board of Trustees and City Council thereof, and the Treasurer of said City are hereby authorized and directed to sign all of said bonds, and the Clerk of said City is hereby authorized and directed to countersign said bonds and to affix thereto the corporate seal of said City, and the Treasurer of said City is hereby authorized and directed to sign the interest coupons of said bonds by his printed, lithographed, or engraved facsimile signature, and to number said interest coupons of each of said bonds consecutively. SECTION 3. Upon failure to pay s~id charges, water will be shut off until such charge is paid. Fire hydrants are provided for the sole purpose of extinguishing fire, and shall be opened and used only by the Water and Fire Departments, or such persons as may be authorized to do so by the Water Department. It shall be unlawful for any person to draw water through any fire hydrant, or other hydrant owned or controlled by the City of Santa Ana, without first obtaining a permit so to do from the Water Department. No such permit shall be issued to any person who has violated any of the provisions of this ordinance, or whose indebtedness to the City of Santa Aha for water used, or damage to hydrants, is dellnqx~eut. Such permit shall show the date of issuance, the number or numbers of the hydrants to be used, and the loeat~on'there~. All such permits shall expire in fifteen (15) days from date of issuance and shall not be transferred or extended. Upon granting any permit under this section, the Water Department shall require a fifty dollar (~50) deposit from the applicant, said deposit to be returned upon the return to the ~ater Department of the permit issued and any tools issued to such applicant, under such permit, and upon the payment to the Water Department for all water used under such permit. It shall be unlawful for any person to fail to return to the Water Department, any fire hydrant tools issued under such permit, on or before the expiration of said permit, which fire hydrant tools are the property of the City of Santa Ans. It shall be unlawful for any person to draw water through any fire hydrant without the use of a standard fire hydrant wrench and an auxiliary valve, such auxiliary valve to be placed on fire hydrant opening with the auxiliary valve closed before any fire hydrant valve is opened. Every person drawing water from any fire hydrant into a tank shall pay for such water used at the rate of ten cents (10~ for each 250 gallon tank or fraction thereof, and the rate of payment for larger tanks shall be multiples of the rate for 250 gallon tanks. (c) The following improvements are required on all new streets; the construction of curb and sidewalk, the installation of water, sewer and gas mains; the installation of sewer laterals and water services from mains to curbs; and the grading and paving of streets and alleys, except that the Board of Trustees may at its option omit the requirement for sidewalks where the construction of sidewalks would not conform to the appearance of the surrounding subdivided and occupied area. (d) All sidewalks a~d curbs shall conform to existing Ordinances and requirements of the City of Santa Ana. (e) All grading preparati~n of the subgrade and all surfacing shall be done in accordance with the Standard Specifications of the Department of Public Works, Division of Highways of the State of California, and to any and all special provisions and requirements of the City of Santa Aha which may be in force at the time. (f) The minimum requirements for surfacing of streets and alleys in strictly residential areas not subject to heavy, fast traffic shall be an untreated rock or crusher run base 4 inches thick after thorough compaction, upon which shall be laid plantmix surfacing, in two courses, the aggregate thickness of which shall be not less than ~ ~ inches when compacted. (g) On streets which are s~Ject to or may become subject to heavy and/or fast travel the Board of Trustees may require a thicker sub-base and surfacing than the minimum requirements. (h) On streets now open to public travel on which an asphalt concrete or oil mix surfacing has been constructed in the central portion of the street, the above requirements on surfacing shall apply to all of that portion of the street lying between the edEes of the ribbon surfacing now maintained by the City (normally considered to be 20 feet wide) and the curbs, except that under no conditions will gravel surfacing and/or any application of sO-called penetrating oil be considered as surfacing. (i) All water lines will be installed as prescribed in Ordinance No. 105~ and amendments thereto. (j) All sewer lines and sewer laterals shall be of vitrified clay sewer pipe and shall have joints poured with an approved sulphur silica compound, or equal. In case the sewer pipe is of the bell and spigot type sufficient oakum or jute shall be used before pouring the joint to prevent any of the joint compound from entering the sewer pipe. Nanholes must be constructed at intervals of approximately 500 ft0 (k) All of the improvements shall be constructed according to the lines and grades shown on the plans. (1) Plans f:.r street improvements will be drawn in the City Engineer's Office unless other arrangements satisfactory to the City Engineer are made, for which the cost of all surveying, engineering and drafting, including the setting of line and grade st~kes for construction, and inspection, plus 10% will be paid by applicant. The bond or ~tber security for the completion of the improvements will not be released until such charge has been paid. (m) No street shall be accepted which is less than sixty (80) feet in width, unless: (1) the street to be accepted is an extension of an existing street which is less than sixty (60) feet in width, or (3) the length of a new street which might be developed (of which the street proposed to be accepted is a part) be necessarily less than 2,000 feet in length; provided, however, that in nb event shall any street be accepted of less than fifty (80) feet in width." The Council of the City of Santa Ana do ordain as follows: Section 1: That Section 11 of Ordinance No. 908, entitled "AN 0RDINANCE5 OF THE CITY OF SANTA ANA DEEINING, REGULATING AND LICENSING THE ERECTION, CONSTRUCTION, AMD/OR MAINTENANCES OF SIGNS, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH", is hereby amended so as to read as follows: Section "Section 11: Advertising Structure Prohibited on Public Property. It shall be unlawful for any person, firm or corporation to erect or construct, or to cause or permit to be erected or constructed or main- tained, any advertising structure, sky sign, electric sign, banner or sign device upon any sidewalk, street, alley or other public place except as may be permitted or required by ordinance or law, or unless permitted under the provisions of Section 11~ of this ordinance, to,wit, Ordinance No.908." That said Ordinance No.908 is hereby amended by adding a new section thereto at the end of Section 11 thereof, which said new section shall be numbered 114, and which section shall read as follows: "Section 11~: Advertising Benches. It shall be unlawful for any person, firm or corporation to place upon or adjacent to the curb~ or the right of way of any public street within the City of Santa Ana, any benches or seats upon which any advertising matter shall be painted or otherwise affixed, without com- plying with each and all of the following conditions: (a) First applying for and o0taining from the Street Superintendent, a written permit therefor; (~) Using Oenches having concrete supports not less than 4 inches thick, with wooden seats and backs, and having an overall height of not more than 3~ feet and an overall length of not more than 8 feet; (c) Placing said. benches and main- taining them only at specific locations approved by the Street Superintendent; '(d) Placing or painting advertising matter on said benches which shall be approved by the Street Superintendent as being artistic and pleasing in design and not contrary to public welfare or morals. (e) Complying with any other restric- tions, limitations or conditions, including the revocation of such permit, which may be imposed by the Street Superintendent at any time, where he determines such imposition as being in the interest of the public welfare of the City of Santa Ana or its residents." Any violation of this Section shall Oe cause for the revocation of such permit by the Street Superintendent in addition to any other penal provisions of this Ordinance, to-wit, Ordinance No. 908. Section 8: The Oity 01erk shall certify to the passage and adoption of this Ordinance, and shall cause the same to be published in three consecutive issues of the Santa Aha Register, a newspaper, printed, published and circulated in the City of Santa Ana, and hereby designated for that purpose. Section ~: The provisions of ~his ordinance do not apply to temporary excavations in or under the puOlic streets permitted by other ordinances of the city, nor do they apply as to public utilities exca- vatlng in or under the city streets, under ~he valid exercise of a city franchise. No person, firm or corporation shall move any building or structure into the City of San~a Ana, or relocate any building or structure within said City, or cause the same to be done, without first obtaining a separate building moving permit for each building or s~ruc~ure from the Building Depsrtmen~. Section ~: APPLICATION. To obtain s permi~ the applicant shall firs~ file an application therefor in writing on a form furnished for that purpose by ~he Building Department. Every such application shall con~ain or have appended thereto the fo~lowlng information: 1. Name of street and official house number, the name of the tract and/or ~block number and zone-use legend, the lot number and its dimensions, where the building or structure to be moved is to be placed. Z. The proposed use or occupancy for the buildimg. 5. The tract, block, lot, zone-use, and official address of ~he building or structure's existing location. 4. All dimensions and s~ructural type of the building or structure. 5. The na:ure of ~he repairs and any alterations or additions. S. The complete valuation of the proposed work. 7. A PLOT PLAN drawn to a scale of not larger ~han one-eighth inch (1/8") to the foot, shall be filed wi~h ~he application. Such plo~ plan shall indicate with dimensions all existing and proposed building locations, yards and setbacks. 8. A PLA~ of the building or s~ructures to be moved shall be filed wi~2~ the application and such plan shall show all necessary structural and sanitavy details as authorized by the Building Department. Section 8: POSTING. When such applica~ion is filed with all the infor- mation required by Section ~ hereof, the MOVING NOTICE cards shall be made out and posted by the Building Department within twelve hours from the time of the filing of such application. Said Moving Notice cards shall be not less than I foot square in area, shall be headed "Notice of Moving and Relocation" in black-faced type letters of not less ~han 2 inches in height, and there shall be printed or ~ypewrl~ten upon said cards, the following information: a. The address from which and to which it is proposed ~o move said structure or structures, together with a brief description of the structure or s~rmctures ~o be moved. b. A notice that if a written protest to said moving signed by one or more persons who own real property within 800 feet of the location to which said struc- ture or structures are to be moved, is filed in the office of the Building Department on or before a date therein named (which date shall be on or Oefore ? days after such posting), tha~ such protest shall be heard and de~ermined by ~he Planning Commission of ~he City, at i~s first regular meeting after ~he expiration of the date set for filing protests, as aforesaid. One Moving Notice card shall be located and posted in a con- spicuous place on the lot to which it is proposed to move said building or structure, in clear view and approximately fifteen feet (1§') back of the front property line of an interior lot. If it is proposed to move the building or structure onto a corner lot, a second Moving Notice card shall be located and posted in a similar position and facing the second- ary street. One Moving Notice card shall be posted on the front of the building or structure tob~oved. The said moving notice cards shall remain posted for a period of seven (7) continuous days. At the end of such posting time the Moving Notice cards shall be removed by an official of the Building Department. Section 4: PRELIMINARY INSPECTION. During the posting time an official of the Building Department shall inspect the building as to the necessary repairs and alterations. Section §: PROTEST AND HEARING. If a protest against the moving of said building or structure is filed it shall be in writing and signed by one more individual property owners who own real property within 300 feet of the location to which said structure or structures are to be moved. Such protest shall be filed in the office of ~he BuXldlng Depart- ment in the City Hall of said City during said period of required posting. The Building Inspector shall cause each and every application filed hereunder to be presented to and filed with the Planning Commission of said city, at the ~rst regular meeting of said Commission following the expira- tion of the seven day posting period, and at the same time shall file with said Commission, any protests that shall hawe been filed with the Building Department. He shall file at the same time, his recommendation regarding the granting or denial of a permit. The Planning Commission shall call the application and any protests for hearing at the meeting at which are filed, and may grant or deny the application at that time, or may appoint a comm- ittee to investigate the application and any protests thereto that may Have been filed, and continue the matter of determination to a subsequent meeting. In the event the Planning Commission of the City of Santa Ana denies an application to move a building or structure, a second application to move the same building or structure to the same property and address shall not be applied for, nor permit granted therefor, within six (6) months from and after the date of the Planning Commission's denial of the application to move said building or structure. In the event that the Planning Commission of the City of Santa Ana authorizes the moving of said building or structure to the proposed new location, after a hearing is held as herein provided, the Building Department shall issue a permit therefor, providing all other requirements of this ordinance have been fulfilled. Section 6. FEES. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: Section 1. That portion of a certain document, three (3) copies of which are on file in the office of the City Clerk of the City of Santa Aha, being marked and designated as "Uniform Building Code, 1948 Edition, published January l, 1948, by Pacific Coast Duilding Officials Conference", be and the same is hereby adopted as the building code of the City of Santa Aha for regulating the erection, construction, enlargement, alteration, repair, moving, removel, demolition, conversion, occupancy, equipment, use, height, area, and maintenance of all buildings and/or structures in the City of Santa Aha; providing for issuance of permits and collection of fees there- for; providing penalties for violation of such code; declaring and establish- ing fire zones; a~d each and all portions of the regulations, provisions, penalties, condition,,and terms of such "Uniform Building Code, 1948 Edition, puDllshed January l, 1948, by the Pacific Coast Building Officials Conference", on file i~ the office of the City Clerk and hereby referred to, are hereby adopted, and made a part hereof as if fully set out in this Ordinance. Section Z. That the entire incorporated area of the City of Santa Aha is hereby declared to be and is hereby established as a Fire District and said fire district shall be known and designated as Fire Zones l, Z, and and each such zone shall include such territory or portions of said city as illustrated, outlined and designated on a certain map on file in the'office of the City Clerk of the City of Santa Aha being marked and designated as "Fire Zones of the City of Santa Aha#, which ia hereby adopted as the fire zoning map of the City of Santa Aha for the application of the regulations included in the Uniform Building Code, 1948 Edition% published JanuaFy l, 1948, by Pacific Coast Building Officials Conference. Section ~. That the portions of said Uniform B~ildlng Code so adopted are as follows: Section lO1 to Section 6004, both sections inclusive, being Chapter i to 60, Doth inclusive, of said Code; and also that section of the Code marked "Appendix" being Section ?02 (c) to Section §llS, both sections inclusive; Table B~-A, Minimum Foundation Requirements for Type V Buildings; Section B301, Weights of Building ~aterials; Section Table No. ~3-A, Horizontal Force Factors; Section ~5~5, Termite Provisions; Section ~418, Masonry of Unburned Clay Units, provided, however, that Sub- section (m) (Limitations) shall be amended so as to read as follows: "Masonry of unburned clay units shall not be used in any building more than one story in height. No bearing wall of unbumaed clay units shall have a height of more than l0 times the thickness of such walls, and the t~ickness shall in no case be less than sizteen inches (lB"). Provided, however, when it can be shown by test that the unOurned Clay unit will exceed the require- ment of Table No. ~4-1, the height may De increased and the thickness may be .decreased in comparison to the increase over the required strength. Such variations must ce approved by the B~ilding Department in writing." Section 4. That said Uniform Building Code, 1946 Edition, as adopted by this ordinance, is hereby amended in the following particulars: That there is hereby added to Section 303 the following: "A fee of $1.00 shall be charged on all installments and repairs to awnings which exceed the cost of $10.00 located in the following districts: C-l, C-2, M-l, and In addition to the foregoing fees, the applicant shall pay the following fees for plastering: For all plastering from twenty square yards (20 sq. yds.) to one hundred square yards (100 sq. yds.), both inclusive, the minmum fee shall be $1.00. For and up to one thousa~ all plastering over one hundred square yards (100 sq. yds.) square yards (1,000 sq. yds.), one cent per square yard. For all plastering over one thousand square yards (1,000 sq. yds.) up to three thousand square yards (3,000 sq. yds.) one-half cent per square yard. For all plastering over three thousand square yards (3,000 sq. yds.), one-quarter cent per square yard. A fee of $10.00 shall be charged for all inspections outside the Juris- diction of the 0uilding department. In addition thereto, mileage at the rate of ten cents for each mile traveled shall be charged." That Section 1005, Second ~aragraph, is hereby amended so as to reed as follows: "In all buildings used for public parking of automobiles operated under their own power and in all buildings where flammable liquids are used exhaust ventilation shall be provided sufficient to produce one complete change of air every 15 minutes. Such exhaust ventilation shall be taken from a point at or near the floor level." That Section 25~3, (Foundstlon Ventilation) is hereby amended by adding the following: "Where basements are not provided there shall be at lesst one open- ing through the exterior foundation walls not less than sixteen inches by twenty-four inches (16" x 24") with a movable door or screened vent. If a screened vent is constructed, such opening may be computed as a part of the required ventilation space, provided, however, all such doors or screens '~sh~ll be set in metal frame." Section §. That subdivision (b) of Section 2521 of ssid Code is hereby amended by adding at the end thereof and as a part of the last sentence thereof, the following, to-wit: " .......... provided, ~owever, that no sole or plate shall be cut for the installation of any pipe three inches (2") or less in outside diameter, but ~a~ the installation of such pipe, the soles and plates shall be bored with a hole of a size not more than sufficient to permit the installation of Section 6. That as to read as follows: said pipe." Section 4506, paragraph 3, is hereby amended so "The lowest part of any movable awming or hood frame shall be not less than seven feet (7') above the grade immediately below, and the lowest part of any fringe attached to such awning or hood shall be not less than six feet six inches (6'6") a0ove shall be attached which violates Awnings of a slide rod, the grade immediately below. That Section 5111, Subdivision (~) (Location) is hereby amended so as to read as follows: "No water heater shall be installed in any room used or designed to be used as a bathroom or closet or for sleeping purposes. Any compart- ment less ~han six and one-quarter square feet (6~ sq. ft.) in area in which a water heater is to be installed shall have at least one side open and unobstructed." Section 8. That Section 2501 is hereby amended by adding a new subsection to be demoninated subsection (e) and to read as follows: "(e) Infected Lumoer. All wood used in any structure shall be free from fungus, dry rot, pile burn, termites, and all other disease or growth detrimental to lumber." Section 9. That Ordinance No. 1136, entitled City of Santa Aha Regulating the Erection, Construction, "An Ordinance of the Repair, Enlarge- ment, Alteration, Removal, Demolition, Buildings and Structures in said City, Thereunder and Repealing Ordinance No. Section 10. If any section, Sanitation, and Occupancy of all Providing for Permits and Penalties 1090", is hereby repealed. subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be 8nconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, clauses .and phrases be declared unconstitutional. Section 11. The inclusion of any clause, portion or part of the "State Sales and Use Tax Law"~ Part l, Division 2 of the Revenue and Taxation Code of the State of California, ver0atlm in this ordinance shall not in or of itself be deemed to exclude any of the remaining provisions of said "Sales and Use Tax Law" that are made a part hereof by reference only. Section 8. APPLICATION FOR PERMIT. Every person desiring to engage in or conduct business as a seller within the City of Santa Aha shall file with the City Clerk an application for a permit for each place of business. Every application for a permit shall be made upon a form prescribed by the City Clerk anQ shall set forth the name under which the .applicant transacts or intends to transact business, the location of his place or places of business, and such other information as the City Clerk may require. The application shall be signed by the owner, if a natural p~rson; in the case of an association or partnership, by a member or partner; in the case of a corporation, by an executive officer or some person specifically author- ized by the corporation to sign the application, to which shall be attached the written evidence of' his authority. Section ?. ISSUANCE AND DISPLAY OF PERMIT. After compliance with Section 6 of this ordinance by the applicant, the City Clerk shall grant and issue to each appll- cant a separate permit for each place of business within the City of Santa Aha. A permit is not assignable and is valid only for the person in whose name i~ is issued and for the transaction of business at the place designated therein; provided, how- ever, a change of location may be endorsed upon the permit by the City Clerk. The permit shall at all times be conspicuously displayed at the p~ace for which issued. Section 8. REVOCATION OF PERMIT. Whenever any person fails to comply with any provisions of this ordinance or any rule or regulation adopted pursuant hereto~the City Council of the City of Ssnta Aha, upon hearing, after giving the person ten days' notice in writing specif~2~g!~the time and place of hearing and requiring him to show cause why his permit or permits should not be revoked, may revoke or suspend any one or more of the permits held by the person. The notice may 'be served personally or by mail in the manner prescribed for the service of notice of a deficiency determina- tion under the "Sales and Use Tax Law". The City Clerk shall not issue a new permit after the revocation of a permit unless the City Council of the ~ity of Santa ~na is ~a~isfied that the former holder of a permit will comply with the provisions of this ordinance and the rules and regulations adopted pursuant hereto and directs the City Clerk to issue such permit. Section 9. UNLAWFUL ACTS. A person who engages in business as a seller in the City of Santa Aha without a permit or permits, or afte~ a permit has been suspended or revoked and before the renewal or issuance of a permit, and each officer of any cor- poration which so engages in business, is guilty of a mieAemeanor. Section 10. DUE DATE. The Saxes imposed by this ordinance are due and payable to the City Clerk-on or before the fifty,nth day of the month nex~ succeeding each quarterly period, the first quarterly payment to be due and payable under this ordin- · ance on the l~h day of January, 19~7. Section ll. REIMBURSEMENT. The tax hereby imposed shall be collected Oy the retailer from t~e consumer insofar as it can be done. Section l~. U~AW~'UL ADVERTISING. Any person vlolatimg any provision of this section is guilty of a misdemeanor. Section 13. SUIT FOR TAX. All taxes hereby levied shall be payable to the City Clerk and any civil suit for the collection thereof may be filed in any court of competent Jurisdiction in the State of California, and the City Attorney of said City shall prosecute the action. Section 14. RESALE CERTI~'£oATE. The City Clerk may at his option accept a State of California Resale~ Certificate as evidence that any sale is not a sale at retail, or he may in his discretion require an a~fidavit from the seller setting forth such information respecting such sale as he deems necessary to determine the nature of such sale. Section 15. DIBPOSITION OF PROCEEDB. All monies collected under and pursuant to the provisions of this ordinance shall be deposited and paid into the General Fund of the City of Banta Ana. Section 16. DIVULGING OF INFORMATION FORBIDDEN. It is unlawful for any officer o~ employee of the City of Banta Aha having an administrative duty under this ordinance to make known in any manner whatever the business affairs, operations, or information obtained by an investigation of records and equip- ment of any retailer or any other person visited or examined in the discharge of official duty, or the amount or source of income, profits, losses, expendi- tures, or any particular thereof, set forth or disclosed in any return, or to permit any return or copy thereof or any book containing any abstract or particulars thereof to be seen or examined by any person. However, the City Council may, by resolution, authorize examination of the returns 0y Federal or State officers or employees or by ~he tax officers of this or any other city if a reciprocal arrangement exists. Section b: ~herever the "Commission" is hereinafter used, unless it is otherwise expressly specified, it shall be understood to refer to and mean the Recreation Commission, as in this article constituted. Section 4: The Commission shall elect one of its members as Presi- dent, who shall hold office for one (1) year and until his successor is elected. The Comrmission shall have the power to appoint a general manager, who shall be known as the Superintendent of the Recreation Department, and · t the Supermntenden' shall act as Secretary of the Commission. The Commis- sion must hold regular meetings at least once every month, aud shall es- tablish such rules and regulations as it deems necessary for its govern- merit and for the faithful performance of its duties and which shall not be inconsistent with the laws of the State of California. Section 8: The Superintendent shall manage and supervise the public recreation of the City within or without its corporate limits; shall aid and promote and supervise all public functions of a public recreational na- ture or character; shall, subject to the approval of the Recreation Com- mission by order entered on its minutes, have charge of the construction, operation, sale, renting or leasing of all concessions oF privileges on playground and public recreation areas, and shall have exclusive supervis- ion and control of all equipment, apparatus, buildings, portions of build- ings, public recreation areas in parks and playgrounds devoted to public recreation; shall issue permits for t he use of playgrounds and other pub- lic recreation areas, equipment and facilities; and shall, subject to the approval of the Recreation Commission by order entered on its minutes, adopt a schedule of charges and fees and rents for special or regular services and use thereof. The Superintendent, with the approval of the Commission, shall ap- point or discharge such supervisors, assistants and other employees as shall be necessary, and shall have the powe~ to purchase such supplies and ap- p~a~atus as may be necessary for properly carrying on their recreational activities. Section 8: The term "public recreation" wherever herein used is here- by defined and understood to ~an and include all public recreational ac- tivities in or upon playgrounds, athletic fields, ball parks, su~er camps, recreation centers, swi~mning pools, beaches, streets, water fronts, water- ways, public buildings, coliseums, play areas in parks, tennis courts and other suitable places or other public lands or public waterways used, owned, controlled or operated by the City of Santa Ana, either within or v~thout its corporate limits, and the activities in or upon them, and the use of s~me for athletic sports, or contests, games, aquatic g~mes, community leagues, pageants, dramatics, music, public amusements and other recreational ~nd play programs or activities, whether herein specified or not, and the provisions of this article shall apply to adults as well as to minors. Section 7: The City Council of Santa Aha shall have the power by ordinance to set aside, either absolutely or for a definite period of time. any lands, waterways or buildings, equipment or facilities belonging to it for public recreation under the jurisdiction of the Recreation Com- mission, and the same shall, when and so long as used by the Con~ission, be under its exclusive jurisdiction and control. Section 8: The Commission may recommend to the City Council the acquisition of lands or waterways, buildings, structures or other equip- ment and facilities for public recreation as itmay from time to time deem necessary fQr the proper conduct of public recreation as in this article defined. It shall have exclusive jurisdiction and control of the operation and conduct of all public recreational activities. The Commission shall pass upon and approve all plans for the improvement of lands for public recreation and for the erection, construction or improvement of buildings or other equipment, structures and facilities for the purpose of public recreation. Section 9: The City Council of Santa Aha shall establish a fund to be known as the "Recreation Fund". There shall be deposited to and eX- pended from this fund all fees or moneys received by the Commission, in- cluding the proceeds from all gifts, legacies or bequests or other sources managed or controlled by the Commission and derived by it in connection with the operation of the public recreational activities and facilities under its jurisdiction. All moneys in said fund shall be used for the promotion, supervision and operation of public reereation, as in this article ~e£ined, and not otherwise, and if not used during any current year shall acctumulate in said "Recreation Fund". Section 10: The City Council of Santa Aha shall annually levy and collect on all the taxable property in the City of Santa Aha, for the purpose of creating a special fund to be designated as "Recreation Pund", not less than one (1) mill of each dollar of the value on all real and personal property of the City, as assessed by the City for City purposes, and, in addition thereto, shall have power to appropriate such additional funds as it may deem necessary and propere Said fund shall be exclusively maintained and used to meet the legal demands and expenditures of the Commission made for supervision~ promotion and operation of a recreational program, and for the purchase of playground equipment and supplies. Section ll: The Connnission may, for and on behalf of the City of S~uta Ana, receive legacies, gifts or bequests for the purchase, mainte- nance or improvement o£ grounds, buildings, equipment or facilities for the purpose of public recreation. All moneys received from such legacies, gifts or bequests shall, unless otherwise expressly provided hy the terms of said legacies, gifts or bequests, be deposited in the treasury of the City of Santa Ana in the "Recreation Fund", and the same may be withdrawn therefrom and paid out only in the manner as is provided for the payment of moneys legally appropriated for the supervision, promotion and opera- tion of public recreation programs and purchase of playground equipment and supplies. If the moneys derived from such gifts, legacies or bequests shall at any time exceed in amount t~he sum necessary for the inumediate expenditure for the purposes of public recreation, then the Commission may invest all or a part of the same in interest bearing bonds of the United States of America or of the State of California, or of any munici- pality or school district thereof. Section 12: The Commission shall make a report every tt~ee (3) months of the activities thereof to the City Council and an annual report of the activities thereof to the City Council, which annual report shall be filed with the City Clerk. Section lO: If any section, subsection, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining sections of this ordinance. THE PEOPLE OF THE CITY OF SANTA ANA DO ORDAIN AS FOLLOWS: Section l: That a contract is hereby authorized between the City Council of the City of Santa Aha and the Board of Administration, California State Employees, Retirement System, a copy of said contract being attached hereto ma~ked Exhibit "A" and by such reference made a part hereof as though herein set out in full. Section E: In order to meet its obligations under the proposed contract referred to in this ordinance, the City council of the City of Santa Aha is authorized and directed to comply with all the provis- ions in the STATE E~PLOYEES' RETIEENENT LAW, as now enacted, or as it may hereafter be amended, including the levy of all necessary taxes as provided in Section BO~ of said law. Section ~: The ~ayo~ of the City of Santa Aha is hereby author- ized, empowered and directed to execute said contract for ~nd on behalf of said Subdivision~ Section ~: This ordinance shall take effect December l, and shall, within two months from said date, be published at least three times in the Santa Ana Daily Register, a newspaper of general circula- tion published and circulated in the City of Santa Ana~ Section B: It appearing that a majority of the qualified elect- ors voting at a special election held on the 8th day of November, in the City of Santa Aha (which special election was consolidated with the General Election of the same date), voting upon the foregoing Ordi- voted in favor thereof, therefore, the foregoing Ordinance be nance, and the same is hereby adopted this ~day. . of~~. ... . . 1~8, at the meeting of the City Council of said City held on said date at which time the results of said election were entered on the Council minutes after being canvassed and declared by the Board of Supervisors of the County of Orange, and said Ordinance shall go into effect at the time herein provided. Public Agency is to participate in the State Employees' Re- tirement System, subject to the provisions of the State Employees' Re- tirement Law. 2. Public Agency shall participate in said Retirement System, making its employees members of said System, from and after July l, 19~7. 3. Employees of Public Agency in the following classes shall be- come members of said Retirement System in accordance with the provisions of said Retirement Law,~governingmembership in said Retirement System, and subject to the further exclusions from membership in the next follow- ing sentence: Number of Employees Eligible Classes of E~ployees for Membership on Jan. 1, 1947 as Local Firemen, as defined in the State Employees, Retirement Law . · · · · · b$ Local Policemen, as defined in the State Employees' Retirement Law . . . . · · . · . Employees other than Local Firemen and Local Policemen o · . . . 196 In addition to the employees excluded from membership by said Retirement Law, the following employees shall not become members of the Retirement System: Ne Additional Exclusions Board and Public Agency agree that, except as provided in paragraph 9, no adjustment shall be made in the amount of contributions provided in paragraph 9a on account of prior service, or in the centage provided in paragraph 9b, because of variations in the numbers of employees who become members of said Retirement System on the ef- fective date hereof, from the number listed above, due to termination of service by such causes as death, resignation or discharge, or the employment of individuals not included in said number. 4. Age 80 shall be the normal minimum age for retirement for service, of miscellaneous members employed by public agency, that is, members other than Local Firemen and Local Policemen, and one-sixtieth shall be the fraction of final compensation, as defined in said Re- tirement Law, to be provided on the average, for each year of service as a member, by the members, and Public Agency's normal contributions, upon retirement at said minimum age. '8. Benefits on account of prior service, that is, service cred- ited hereunder as rendered to Public Agency prior to the effective date of participation, to respective members employed by Public agency as Local Firemen or Local Policemen, shall be allowed only as a percentage of the average salary specified in said Retirement Law, for each year of such service, and said percentage shall be 100 per cent of the fraction of final compensation as defined in the State Employees' Re- tirement Law, for each year of service rendered after said date, as dete~mlned for said respective members under said law, for the retire- ment for service at age §§, or upon qualification for service retirement at a higher age. If a member retires for service before attaining age 88, his Drior service pension shall be reduced to that amount which the value of the pension as deferred to age 88 will purchase at the actual age of retirement. 6. Prior service benefits to miscellaneous members employed by Public Agency, that is, members other than Local Firemen and Local Policemen, upon retirement for service at the normal minimum age entered in paragrap~ 4 hereof; shall be allowed only as a percentage of the average salary specified in said Retirement Law, for each year of such service, and said percentage shall be 100 per cent of one-sixtieth. If a member retires for service before attaining the normal minimum age in item 4, his prior service pension shall be reduced to that amount which the value of the pension as deferred to said minimum age will purchase at the actual age of retirement. 7. The provisions of Section 212§Sb of the State Employees. Retirement Law, guaranteeing a m~tnimum retirement allowance under cer- tain conditions shall apply to employees of Public Agency who become members of said Retirement System. 8. The provisions of Section ~1367.B of the State Employees Retirement Law, providing a $~00 death benefit after retirement shall apply to employees of Public Agency who become members of said Retire- merit System. 9. Public Agency shall contribute to said Retirement System as follows: a. The sum of $51,080.69 per annum, payable in equal monthly or less frequent installments as Board shall require, for a period of 28 years, on account of the liability for benefits based on service rendered to Public Agency prior to the effective date hereof. b. 9.93V per cent of total salaries paid by Public Agency each month to its employees who are members of said Retire- ment System, provided that only salary earned as members of said System shall be included in said total salaries, and the employees who are members of said System shall include employees who become members upon the effective date hereof and employees who become members thereafter. o. A reasonable amount per annum, as fixed by the Board, payable in equal monthly or less frequent installments, as Board shall require, to cover the costs of administering said System as it affects the employees of Public Agency, not including tim costs of special valua- tions or of the periodical investigation and valuation required by law, provided that said amount shall be determined on the basis of the number of employees of Public Agency who are members on July 1st of the respective fiscal years, or with respect to the first year of par- ticipation, on the effective date of said participation. d. A reasonable amount as fixed by the Board, payable in one installment from time to time as the occasions arise, to cover the costs of special valuations on account of employees of Public Agency, and the costs of the periodical investigation into the experience under said Retirement System, as it affects said employees, and the valua- tion of the assets and liabilities of said System on account of said employees. Contributions required of Public Agency and its employees shall be subject to adjustment by the Board of Administration on account of amendments to the State Employees' Retirement Law, and on account of experience under the Retirement System, as determined by the periodical investigation, valuation and determination provided for by said Retire- ment Law. lC. Contributions required of Public Agency under paragraph 9 immediately preceding, and contributions required of Public Agency's employees who are members of said System, shall be paid by Public Agency to the State Employees' Retirement System within thirty days after the end of the month or longer period to which said contributions refer. If more or less than the correct amount of contribution required of Public Agency or its employees is paid for any period, proper adjust- ment shall be made in connection with subsequent remittances of Public Agency to the Board, to rectify the e~rors; or such adjustments on ac- count of errors made in contributions required of employees, may be made by direct cash payments between the employee in connection with whom the error was made, and BoardePaYments of Public Agency to Board may be made in theform of warrants, bank checks, bank drafts, certified checks, money orders, or cash.
