HomeMy WebLinkAbout1950 (#1282-1316) ORDINANCE NO. 1282 AN ORDINANCE OF SANTA AMA, CALIFORNIA, FIXING AND ESTABLISHING THE NAME OF A CERTAIN STREET AS SOUTH BROADWAY AND CNANGING THE NAME OF A PORTION OF SOUTH BROADWAY TO BROADWAY PLACE THE COUNCIL OF THE CITY 0F SANTA AMA DO ORDAIN AS FOLLOWS: ~.eot~p~ ~: TD~t the name of that portion of ~he Street now known and named South Broadway, south of Anahurst Place which de- viates from being approximately parallel with South Main Street by angling to the southeast to Join Main Street, be and the same is hereby changed, fixed, and established as "Roadway Place" and that portion of South Broadway south of Anahurst Place which is practically parallel with South Main Street and any southerly ex- tension thereof, is hereby fixed and established as "South Broadway". Section 2: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published in three consecutive issues of the Santa Aha Independent, a newspaper printed, published and circulated in the City of Santa Ana, and hereby desig- nated for that purpose. This Ordinance shall take effect thirty (30) days from and after it is passed and adopted. City Clerk ORDINANCE NO. 1283 An Ordinance ko be known as the Administrative Electrical Code of the City of Santa Ana; Creating the office of Electrical Inspector, Prescribing his duties and Authority; Providing for the Issuance of Electrical Permits and for Inspections and Fixing the Fees thereof; Regu- lating the Installation, Arrangement, Alteration, Repair, Maintenance and Operation of Electric Wiring, Electric Fixtures, andother Electrical Appliances and Equipment; Providing a penalty for Violation of the same; Repealing Ordinance No. lll6 and all other Ordinances and Parts of Ordinances in Conflict Therewith and Adopting by Reference that certain printed Electrical Code printed in book form entitled "Administra- tive Electrical Code," three copies of which are on file in the Office of the City Clerk for Use and Examination by the Public. The City Council of the City of Santa Ana does ordain as follows: Section 1. That certain document in book form, entitled "Administrative Electrical Code" (1957 edition), three copies of which are now on file in the office of the City Clerk of the City of Santa Aha is hereby adopted and enacted by the City Council of the City of Santa Ana as the Electrical Code of the City of Santa Ana. Section 2. That Ordinance No. lll6 of the City of Santa Aha entitled "An Ordinance of the City of Santa Aha, to be known as the Uniform Electrical Code of the City of Santa Ana, C~lifornia, creating the Office of Chief Electrical Inspector and Prescribing his Duties; Providing for the Issuance of Electrical Permits, and for Inspections and Fixing the Fees Therefore; Regulating the Installation, Arrange- ment, Alteration, Repair, Maintenance and Operation of Electrical Wiring, Electric Fixtures, and other Electric Appliances and Equipment in the City of Santa Ana; Providing a Penalty for the Violation of the same, and Repealing all Ordinances or Parts of Ordinances in Conflict with this Ordinance" is hereby repealed. Section 3. That a special election be held, and the same is hereby called to be held, in the City of Santa Aha, California, on the 6th day of June, 1950, for the purpose of submitting to the qualified voters of said city a proposition of incurring indebtedness and issuing bonds of said City there- for, in the amount hereinafter set forth, and for the object and purpose set forth in said resolution and hereinafter stated. Section 2. That the object and purpose for which said indebtedness is to be incurred and bonds issued there- for is as follows: The acquisition and constructiou by the City of Santa Aha of a certain municipal improvement, to wit: additions to and improvements of the fire- fighting facilities of the Cit~ of Santa Aha, said additions and improvements to consist of two fire stations, a training station, fire apparatus, and additions to the fire alarm system and the recon- struction of parts of such system, including the acquisition of all land, property, equipment~ and furnishings necessary for said improvement. Section 3- That the estimated coat of the municipal improvement described in Section 2 hereof is the sum of $475,000°00, and that the amount of the principal of the in- debtedness to be incurred therefor is the sum of $~?~,000.00. That the maximum rate of interest to be paid on said indebtedness shall not exceed four per cent (4%) per aun~m, payable semiannually. That if the proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit, two-thirds of the votes of the qualified elec- tors voting at said election, bonds of said City, in not ex- ceeding the principal amount stated in such proposition, shall be issued and sold for the object and purpose set forth in said proposition. Section 4. That the polls for said election shall be opened at seven o'clock, A.M., of the day of said election and shall remain open continuously from said time until seven o'clock, P.M., of the same day, when said polls shall be closed, except as provided in Section 573~ of the Elections Code of the State of California. That on the ballots to be used at said special elec- tion, in addition to any other matters required by law, there shall be printed subst~ntially the following: MARK CROSSES (~ ) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. The said precincts, polling places, and names of the election officers will be set forth in an order designating polling places and election officers in the County of Orange for said direct primary election to be adopted by the Board of Super- visors of said County on April 25, 19~0, and to be entered in the minutes of said Board of Supervieors, and will be set forth in a notice to be given by the County Clerk of the County of Orange entitled "Notice of appointment of precinct election officers and the designation of the polling places for the direct primary election to be held June 6, 1950," which is to be published by the County Clerk of said County in the Santa Ana Daily Register on May I and 2, 1950, and reference is hereby made to said order and to said notice. The Board of Supervisors of the County of Orange hereby is requested to order the consolidation of the special municipal election hereby called with said direct primary elec- tion, and said Board of Supervisors is authorized hereby to canvass the returns of the special municipal election hereby called, and the elections shall be held in all respects as if there were only one election, and only one form of ballot, namely, the ballots used at such direct primary election, shall be used. Said Board of Supervisors shall certify the result of the canvass of the returns of such special munici- pal election to the Council of the City of Santa Aha who shall thereupon declare the result thereof. Section 6. That the City Clerk shallcerttfy to the passage and adoption of this ordinance by a vote of more than two-thirds of all of the members of the Council of said City, and shall cause said ordinance to be published once a week for three successive weeks in the SANTA ANA INDEPENDENT, a weekly newspaper of general circulation in said city. Section 2: The original copy of such report shall be kept on file in the office of the City Clerk u~der the caption "Surplus Property Reports" and shall be open to the public for inspection. Any person interested in the purchase of any such property and who leaves his name and address with the City Clerk, shall be notified by mall, of any sale of said property at least ten days prior to the date of such sale. Section 3: All reports of surplus property shall be read at a regular 0ouncll meeting and no sale of any such property shall be had until the Council by Minute Order, has approved the report and declared the property to be surplus and no such sale shall be had if any other Depar~ent of the City expresses a desire or need for such property for a City purpose. Section $: Whenever the City Council shall declare that sufficient surplus property has accumulated, it shall fix a date for the sale of the same. All such surplus property shall then be accumulated at a central location unless the City grants an excep- tion to this requirement and therein designates the property so ex- cepted. Notice of such sale shall be given By publication at least once in a newspaper of 8eneral circulation, printed, published end circulated in the City of Santa Aha and by sending written notice to all persons who had requested notice and to all persons suggest- ed by Department Heads as prospective bidders, such notices to be published and mailed at least ten days prier to the date of sale. All such sales shall be at public auction and the City Council shall designate the person to conduct the auction and the person to act as Clerk, to make a record of bids and payments during said auction. That each of said Trustees shall hereafter hold office for a term of three years or until their successors are appointed. Section 2: DISASTER COi~ITTEE ~}~ERSHIP. The Santa ~na Disaster Committee is hereby created and shall consist of the follow- ing: A. T~e l~yor, who shall be Commander. B. Tae Vice Co~ander, who, in t~e a0sence of, or at the di- rection of t~e 0ommander, shall act on his behalf on matters within the perview of this Ordinance. C. The Vice Commander shall be an officer of the City Govern- ment, qualified by experience and training, to assume command during a disaster, and shall be appointed by the City Council and his ap- pointment shall require a four-fifths vote of the City Council. D. The Chiefs of ~ivisions, as hereinafter provided. E. Such other representatives of civic, business, labor, veterans, professional or other organizations as may be considered desirable, and the Chiefs of ~ivisions and such representatives, may be appointed by the D~ayor, with the advice and consent of the other members of the City Council. Section 3: DISASTER COIi~ITTEE. PO¥~r~RS DUTIES AND ~gEE~INGS. Zt shall be the duty of the ~anta Ana Disaster Council, and it is hereby empowered: A. To develop a plan for meeting any disaster. Such plan shall provide for the effective mobilization of all t~e resources of the community, both public and private. B. To prepare and recommend for consideration by the City Council, Ordinances necessary to implement the disaster plan. C. To consider and reconmend to the City Council for ap- proval, mutual aid plans and agreements. D. The chain of command of the Santa ~na Disaster Com- mittee shall be as-follows: Commander, Vice Co~ander, Police Chief, Fire Chief, City ~ngineer, ~uilding Inspector or such other or further officials or Division Heads as may be designated by the City Coun- cil. In event the members of the City Council are unable to meet or act during a Risaster, then temporary Division Heads may be appointed to act during the absenc~ or disability of regular Division Heads, by a majority of the Heads of the Divisions actively engaged in the combatting of any existing disaster. E. The Disaster Committee shall meet upon the call of the Commander, Vice Commander, or the joint call of two of the following: -2- Chief of Police, Fire Chief, City Engineer, or any member of the City Council. Section ~: COMMA~NDh~. PO~ERS A~,~D DUTIES. There is hereby created, the office of Commander. The Commander is hereby empowered: A. To proclaim the existence or threatened existence of a disaster and the termination thereof; B. To request the Governor to proclaim a state of extreme emergency in the area in and around the City of Santa Aha when in the opinion of the Commander the resources of the community are in- adequate to cope with the disaster; C. To govern and direct the effort of the Santa Aha ~isaster Corps in the accomplishment of the purposes of this Ordinance; D. To direct co-ordination and cooperation between the Chiefs of Divisions and resolve questions of authority and responsibility that may arise between them; E. To represent the Disaster Corps in all dealings with pub- lic or private agencies pertaining to disaster preparedness. It shall also be the duty of the Commander, and he is hereby empowered, -during a disaster or when a disaster is in~inent: A. To make and issue rules and regulations on matters reasonably related to the protection of life and property as affeat- ed by such disaster; B. To obtain vital supplieS,meqUipment and such other operties found lacking and needed for tGe protection of the life d property~of the people, and, with the consent of the other mem- rs of ~he City Council, bind the City for the fair value thereof, d, if required immediately, to commandeer the same for public use; C. To require emergency services of any City Officer or employee; D. To requisition necessary personnel or material of any City Department or Agency; -3- E. To execute all of the special powers conferred upon him by this Ordinance, and all powers conferred upon him by any other lawTul authority. Section 5: E~gCUTIVE OFFICER. There is hereby created the position of Executive Officer of the Disaster Corps. The Executive Officer shall be appointed by the City Council, and the appointment shall require a four-fifth vote of the City Council. The Exec~utive Officer shall be the Chief of the Division of Personnel and Recruit- ment. Section 6: DISASTER CORP~. G~RAL. Officers end employees of the City of Santa ~na, together with those volunteer forces en- rolled to aid them during a disaster, and all groups, Organizations, and persons who may by agreement or operation of law, be charged with duties incident to the protection of life and property in the City of Santa Aha during such disaster, shall constitute the Santa ~na Dis- aster Corps. Section 7: DIVISIONS OF DISASTER CORPS. The functions and duties of the Santa Aha Disaster Corps shall be distributed among the following divisions of such corps, each division to be under the di- rection of a Chief and, in his absence, the First Deputy and Second Deputy Chief, respectively, appointed by the Chief, and said Division to consist of the following forces, organizations and services, and such other forces, organizations os services as may be included pur- suant to the provisions of this Ordinance. The Chiefs of Divisions shall organize and train volunteers assigned to such division by the Personnel and Recruitment Division and shall formulate the division plan which, when approved by the Disaster Council, shall become an annex to the Disaster Plan. The Chiefs of Divisions shall include in the Disaster Plans, recommended mutual aid agreements. The C~iefs of Divisions shall be custodians of special equipment and other prop- erty which may be obtained from any so~rce and assigned to such divi- sion by the Commander. -4- A. LAW AND ORDER DIVISION. This Division shall be under and subject to the control of the Chief of Police, who shall be Chief of the Law and Order Division. The Division shall consist of Police personnel and auxiliary Police (volunteers). B. FIRE DIVISION. This Division shall be under and subject to the control of the Chief of the Fire Department, who shall be Chief of the Fire Division. The Division shall consist of ~'ire De- partment personnel and auxiliary fire fighters (volunteers). C. ~DICAL DIVISION. This Division shall be under and sub- ject to the control of a Doctor, who shall be Chief of the ~edical Division. The Division shall consist of Health Department personnel and ~edical Jervice volunteers. D. PUBLIC ~RKS DIVISION. This Oivision shall be under and subject to the control of the City Engineer who shall be Chief of the ~ublic ~orks Division. The Division shall consist of the De- partment of Public '~,orks personnel and auxiliary personnel (Volunteer~. E. UTILITIES DIVISION. This Oivision shall be under and sub- ject to the control of the Chief of the Division who shall be a citi- zen experienced and engaged in such industry, appointed by the ~myor with the advice and consent of the City Council. The Division shall consist of auxiliary personnel and volunteers. F. TRAi~PORTATIOE DIVISION. The C~ief of this Division shall be a citizen, experienced and engaged in such industry, appointed by the ~ayor with the advice and consent of the City Council. The Division shall consist of auxiliary personnel (volunteers). G. CO~ICATIONS D/VISiON. The Chief of this Division shall be a citizen, experienced and engaged in such industry, appointed by the I~ayor with the advice and consent of the City Council. The Division shall consist of auxiliary personnel (volunteers) and shall control telephone, telegraph, short wave, K.V.O.E., radar and any other means of communication. H. PERSO~ELAI~ PROCU~ED~NT DIVISION. This ~ivision shell be under and subject to the control of the Executive Officer. It -5- shall be the duty of this Division to recruit all volunteer person- nel, to enroll and register such personnel, to keep adequate records thereof, and to assign such personnel to other Divisions of the Disaster Corps, and to maintain liason with the National Guard and with any military establishment in the vicinity of the City of Santa ~na to the end that there will be the fullest cooperation between the ~ational Guard Units and facilities and any other military or- ganization or establis~uent and the Disaster Committee. I. A~,~ERIC~ RED CROSS. The A~erican Red Cross in the City of Santa Ann will furnish food, clothing, shelter, registration and information service, supplementary medical service when requested, and rehabilitation to individuals and families affected by a dis- aster. The American Red Cross will provide funds with which to fi- nance all its relief operations. The Chief of this Division will be the chairman of the City of ~anta Ann Chapter of the American Red Cross, or a delegated representative thereof. J. BUILDIEG DIVISION. This Division shall be under end sub- ject to the control of the Chief building Inspector of the City of Santa ~na. The duty of this Division shall be to determine the safe- ty of all buildings, the necessity for destruction, or repair of buildings, and the carrying out of such work. This Division shall consist of the personnel in the Building Department and auxiliary personnel (volunteers) and privately owned equipment, the service of which shall be donated. Personnel in this ~ivision shall be limited to contrsctors and building trades personnel who are persons regu- larly engaged or employed in such work. It shall De the duty of the Chief of this Division to proceed with the recruitment of building trades personnel and equip~ent, which duty shall be in addition to and supplemental to the duty imposed upon t~e Division of Personnel and Recruitment. K. STAFF DIVISION. Whenever the existence of a disaster or a state of extreme emergency is proclaimed, the members of the City -6- Council not assigned to act as Chiefs of ~ivisions or place~in the chain of command, shall meet in a Special Meeting of the City Coun- cil and remain in continuous meeting to ta~e such action as may be neeessery. They may adjourn from time to time to allow reasonable periods of absence from their place of meeting, but such adjourn- ments shall be to a time certain and for short periods only. This ~ivision shall make available such City funds as they consider necessary to meet the situation, may authorize purchase of supplies and equipment and may remove any member from Disaster Committee ~embership for conduct against the public interest, neglect of duty, insubordination, or inability to perform his duty, and may appoint a successor to immediately fill the position so vacated and may relieve any volunteer or City employee of his position, duties or authority. This Division may adopt such emergency Ordinances as may be necessary. L. PUBLIC RELATIONS. The Chief of this Division shall be a citizen or employee appointed by the Eayor with the consent of a majority of the other members of the City Council and the ~ivision shall consist primarily, of all news gathering and disseminating services and the Ministers and Chaplains of the community. It shall be the duty of this Division to gather and control the disseminatinn of intelligence to the community, to the end that panic m~y be min- imized and the seriousness of the disaster restricted to its physi- cal proportions. It shall inform the Committee of the actual condi- tions confronting them and, in every way possible, maintain a normal and healthy attitude of mind on the part of the public at large. Section 8. VOLUNTEERS. All persons, other than Officers and employees of the City, volunteering services pursuant to the pro- visions of this Ordinance, shall serve without co~pensation from the City, and no Officer or employee of the City shall receive any extra c~pensation for services rendered hereunder. Mhile engaged in such services, they shall have the same im~unities as Officers and em- ployees of the City performing similar duties. -7- Section 9: PUT~IS?~NT OF VIOLATIONS. It shall be a mis- demeanor, punishable by a fine of not to exceed Five Hundred Dollars ($500.00) or by imprisonment for not to exceed six months, or both, for any person during a disaster: A. Wilfully to obstruct, hinder or delay any member of the Disaster Oorps in the enforcement of any lawful rule or regulation issued pursuant to this Ordinance, or in the performance of any duty imposed upon him by virtue of this Ordinance; B. To do any act forbidden by any lawful rule or regulation issued pursuant to this Ordinance, if such act is of suc~ a nature as to give, or be likely to give, assistance to the enemy, or to imperil the lives or property of other inhabitants of this City, or to prevent, hinder, or delay the defense or protection thereof; C. To wear, carry or display, without authority, any means of identification specified by the ~isaster Committee. Section 10: That City Ordinances N~mber 1099 and ll08 and any other Ordinances or parts of Ordinances in confligt herewith, are hereby repealed. Section ll: PURPOSE. It is the declared purpose of this Ordinance to provide personnel, equipment and comprehensive plans for their use in case of major disaster and to maintain the same in a ready status without ~mmediate expense to the City of Santa Ana. Section 12: The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published by three insertions in the Santa Aha ~ndependent, a weekly newspaper printed, published and circulated in the City of Santa Ana, and here- by designated for t~at purpose. This Ordinance is declared to be an emergency measure, neces- sary for the immediate preservation of the public peace, health, and safety and shall take effect immediately upon its being passed and adopted. The facts necessitating this emergency are: That United States troops are now engaged in combat in Korea which may lead to armed conflict with ~ussia involving combat within the territorial limits of the United otates and a complete and adequate disaster plan must be formulated at once by the ~isaster Committee created by this Ordinance. Ouch a plan will be based upon the individual plans formulated by the Chiefs of Divisions and upon such mutual aid agreements as can be arrived at, to protect the lives and prop- erty of the citizens of this City and the responsibility for the execution of these acts must be fixed immediately. The City Council, therefore, declares that this Ordinance is adopted as en emergency measure to ta~e effect from and after its adoption. Such application shall be accompanied by a fee in ~he amount of $2.50. Upon receipt of s~ch application the Plumbing Inspector shall make an inspection and if he de~ermines ~hat all gas-fitting ~ork in- stalled in said building is sound and safe for said temporary con- nection, he shall approve said temoorary counection and notify the Southern Counties Gas Company to make the ~emporary connection as herein provided~ for the period herein specified. (a) Person. "Person" as used in this Ordinance is hereby defined to mean any person, firm, association, organization, partnership, business trust, corporation, company, city, county, municipality, district or other political subdivision. (b) Orchard Heater or Heater. "0rohard Eeater" or "heater" as used in this Ordinance is hereby defimed to mean a machine, bowl, burner or contrivance burning any t2pe of fuel cap- able of emanating carbonaceous matter or other air contaminates, that is used to give protection from frost damage in areas not com- pletely enclosed. (c) Nursery. The word "nursery" as used in this 0rdinanee is hereby defined to mean any place within the City of Santa ~-a whereon more than fifty trees or plants are raised, maintained or grown in the open within an area of six thousand square feet, for the purpose of selling the same. (d) Orchard. The word "orchard" as used in this Ordinance is hereby defined to mean any parcel of land within the Olty of Santa Aha whereon more than five fruit or citrus trees exist within an area of less than ten thousand square feet. (e) Heating Season. "Heating season" is defined as the period between October 1st of any one calendar year and April 1st of any succeeding calendar year. (f) One Hole Opening. "One hole openimg" as used in this Ordinance is hereby defined to mean an orifice not to exceed one inch in diameter or a total of not to exceed 0.8 of one square inch. (g) 0ne-half Hole Opening. "0ne-half hole opening" as used in this Ordinance is hereby defined to mean an orifice not to exceed 0.5 of one square inch. Section 2: It shall be unlawful for any person, after the 1st day of October, 1950, to use, operate, permit or allow to be used or operated, any heater in the City of Santa Ana without first obtaining a permit so to do, or at any time when such person is not in possession of a valid, current and unrevoked permit so to do, or to have, keep, permit or allow any heater in operable condition of any type that cannot be licensed hereunder, in any nursery, orchard, place or location where the same could be fired to furnish protec- tion to trees or plants from frost damage. It shall be unlawful for any person to keep or permit any heater in operable condition to be or remain in any nursery or orchard composed of fruit trees of any type, after the 1st day of 0etcher, 1950 unless such person has a permit for such heater as herein provided for. Such applica- tions shall give the following lmformation: (al The location an~ extent of the area proposed to be heated for proteotlon from frost damage. (~) The name and a~&ress of the owner thereof. (c) The ~ypes of heaters and the number of each type for which a permit is requested. (d) The type an~ kln~ of fuel propose~ to be use~ in sal~ heaters. (e) A statement that all heaters are in goo~ operating condition, that all parts fit properly and tightly, are clean aa~ free of carbon, soot and sl~dge residue an~ shall be use~ wi~h a maximum of one hole opening. This application shall be ac~ompanie~ by a fee ia the amount of One Dollar ($1.00). This applioation must be ma~e an~ signe~ by the owner or his authorized agent. No permit shall be granted until an inspeetion has been made to ~etermine that the heaters covere~ by the application are of a type for which permits maC'issueS that they are in good repair, with tightly fitting parts, an~ in all respeets, clean and free from car- -3- bon, sludge and soot accumulations. Section ~: Approved Heater Types. After the 1st day of October, 1950, no combustible material of any k~lnd shall be used, burned or oxidized for the protection of trees or plants from frost dam_age in unenclosed areas except oil of the type and grade speci- fied in this Ordinance, or better, when used in conjunction with the following binds of heaters which are the only heaters for which permits may be issued hereunder: (a) University Return Stack Heater (b) Pipeline Heater (c) Xlttle Heater (d) ExchAnge Model 7" diameter stack (e) Hy-Lo 158 Special Heater (f) Hy-Lo 230 Heater (g) Twenty-four inch Lazy Flame Heater (h) Any heater equipped with a 25~ stack (i) Jumbo Cone Heater with an adapter inserted which will allow a one-half hole opening only (~) Lemora Stack None of said heaters except those specified in Subdivisions (a), (b) and (l) hereof shall be operated with more than one hole opening. Section 6: Exceptions. There is excepted from the operation of this Ordinance and freely permitted in orchard or ~ursery heating for protection from frost damage, the following: (a) Briquet Heaters when used with briquets (b) Natural gases (o) Liquid petroleum gases (d) Electricity (e) Wind machines (f) Steam (g) Hot Water ~ection 7: 0il Specifications. It shall be unlawful for any person to deliver more than forty (~0) gallons of fuel oil to be used to give protection from frost damage in areas not completely enclosed, to any person without furnishing to the purchaser, at the time of delivery, and keeping a copy of, a written statement showing the date, the seller's name and address, the buyer's name and ad- dress, the quantity of the fuel delivered, the flash point of the fuel delivered and the specifications of the fuel delivered in enough detail to show all facts about such fuel as are necessary to comply with the requirements of this Section. It shall be unlawful to furnish any such statamentwhich contains any false or untrue informatlom. It shall be unlawful for any person to sell, deliver or use for the purpose of protecting nurseries or orchards from frost dam- age, any oil except the following: (a) Kerosene Distillate (b) Stove 0ils (c) Diesel Fuels of the two top grades Provided, however, that any fuel oil on hand by any grower prior to ~uly 1, 1950 may be used for orchard heating. ~ection 8: Replacements. (a) Any heater of the type hereinabove permitted to be licensed may housed if in good repair, reasonably clean and free of carbon and soot accumulations and sludge residue during the 1950-1951 heating season provided a permit is obtained therefor. (b) Any pipe line heating system or briquet type heat- ers may be operated indefinitely if maintained in good operating con- dition. (c) Before any permit may be issued for the 1951-1952 heating season, the applicant shall have replaced not less than one- third of the total number of heaters other than pipe line systems or briquet type heaters, with University Return Stack Heater, its equiv- alent or better, and no heater shall be equivalent or better unless the '5- same has been so datermine~ to be by the Extension Service of the University of 0alifornia and does not emit any more solid, carbon- aceous matter or require more frequent cleaning. (d) Before any permit may be issued for the 1952-19~3 heating season, the applicant therefor shall have replaced an addi- tional one-third of all heaters operated by him, other than pipe line system or briquet heaters, with University Return Stack Heater, its equivalent or better as next hereZaabove defined. (e) During the heating season of 1953-1955, no orchard heater other than pipe line systems, briquet type heaters or Univer- sity Return Stack Heater, its equivalent or better, as hereinabove in Sub-section (c) defined, shall be used by any person for the pur- pose of providing protection from frost damage in any place not en- tirely enclosed, and no permit shall be issued for any other type of heater during said season or thereafter. Seetio2 .~: (a) Any person operating, using or maintaining heaters hereunder, who is in possession of a valid and ,m~evoked permit, shall for the first violation of this Ordinance, have his permit revoked by tha Agricultural Commissioner or other person who may be responsible for the enforcement of this Ordinance but shall not be deemed guilty of a misdemeanor. Regardless of the penalties elsewhere provided for, such first violation shall result only in revocation of the permit. It is the duty of the Agricultural Com- missioner to revoke the permit of any person violating any provision of this Ordinance and if such violator has no permit, then to imme- diately file a criminal complaint against him. Upon the second violation of this Ordinance by any person who holds a permit hare- under, it shall be the duty of the Agricultural Commissioner to im- mediately file a criminal complaint against such person as well as to revoke his permit. No person who has had his permit twice revoked, shall again be granted a permit during the same heating season, and a criminal complaint shall be filed for the second and each succeeding violation on the part of any person regardless of what heating season -6- the first violation occurre~ im. Ail permits shall explreMa7 la~ and new permits must be obtained for each heating season. When a permit has been revoked for an individual's first violation he may reapply for a per~n~t when the condition occasioning the violation has been corrected, pay a new fee, and satisfy all the requirements of application for a permit. It shall be the duty of the Agricultural Commissioner or other person charged with the enforcement of this 0r~lnance to ma~e continuous inspections during the heating season. (b) A Hearing Board is hereby created consisting of the City Engineer, who shall be the Ohairman, and four other impar- tial citizens to be appointed by the Oity Council. Three members of this Board shall constitute a quo~.,m. It shall require a majority of the Board members to take any action except to adjourn. (c) NO revocation of any permit as hereinabove in Sub-section (a) of this Section provided for, shall be effective until the same has been passed upon by the Hearing Board created by this Section. It shall be the duty of the enforcing Officers to serve personally, a notice of proposed revocation and hearing thereon on the grower holding any per, it proposed to be revoked, at least five hours before the hearing thereon. If the grower be not present at the grove affected, then it shall be deemed sufficient service if the notic.e be posted in a conspicuous place on said grove. Sal~ notice shall recite the violation, the place and hour of hearing, and a statement that the permit in question is proposed to be revoked at said hearing. The grower may appear and be heard at said hearing, personally, by attorney or authorized agent. (d) After hearing on the question of the revocation of a permit the Hearing Board may cancel and revoke said permit, ~ay deny the revocation or may continue the permit upon such terms and conditions as they desire to impose, in which event the grower may continue to operate under said permit provided he complies with saia terms and conditions. -7- Section lq: Heater Maintenance. It shall be unlawful for any person to operate any orc~ar~ ~eater that is not in goo~ opera- ting comdition. Ail orchard ~eater stacks must be maintained in serviceable condition, must be kept reasonably clean and must be cleaned throughout w~ene~er the same is necessary to prevent the emission of solid, carbonaceous matter. Whenever orchard heaters are burming they must be adequately attended and supervised to main- tain the condition, adjustment and cleanliness of the heaters. ~eetion 1!: Severabllity. If any section, sub-section, sen- tence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competeut jurisdiction, such ~ecision shall not affect the validity of the ramalnlngportions of this Ordinance. The 0ouncil hereby ~e- elates that it would have a~opte~ this Ordinance and each section, sub-section, sentence, clause, phrase or portion thereof, irrespec- tive of the fact that any one or more sections, sub-sections, clauses, phrases or portions be declared invalid or unconstitutional. Sa.~tion 12: Penalty. Any person violating any of the pro- visions of this Ordinance shall be deemed guilty of a misdemeanor an~ upon a comviction thereof, shell be punishable by a fine of not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00) or by imprisonment in the County Jail for a period of not less than five days nor more than six months or by both such fine and imprisonment. Each such person shall be guilty of a sepa- rate offense for each day during any portion of w~lch a violation of any provision of this Ordinance shall be COmmitted, continued or permitted. Section 1~: Every violation of this Ordinance is hereby de- clared to be a public nuisance. Section 15: Ail Ordinances or parts of Ordinances in con- flict herewith are hereby repealed. When such a permit has been issued the holder thereof may burn combustible material during the hours in such permit allowed and under the conditions in such permit specified and any violation of the hours or conditions in such permit contained shall be deemed a violation of Section 2 of said Ordinance No. 864 and subject the person guilty thereof to the penalty set forth in said Section 2 of said 0rdinanoe."
