HomeMy WebLinkAbout62-195RESOLUTION NO. 62~I~ ADDING CONDITIONS TO A VARIANCE GRANTED BY THE PLANNING COMMISSION ON VARIANCE APPLICATION NO. 1685 WHEREAS, after hearing on notice, the Planning Commission granted a variance on Variance Application No. 1685, filed by SIVE CELLA ASSOCIATION to permit the construction of a gasoline service station on the Southeast corner of Bristol and He~lock Streets in an R-1 District; and WHEREAS, Appeal Application No. 71 was duly filed by the SANTA ANA CITY PLANNING DEPARTMENT requesting a hearing before the City Council on said Variance Application No. 1685 to reconsider the decision of the Planning C~,~,ission; and WHEREAS, after public hearing before the City Council; after careful consideration of the statements contained in and the materi- als accompanying the application; the~st/mony offered at the hearing; the examination of all the facts established; and after determining that the use applied for by the Variance Application meets the require~ents of Section 9250.8 of the Santa Aha Municipal Code, it has been determined that the Variance should be granted, but subject to certain conditions. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby grants Appeal Application No. 71 and grants a Variance on Variance Application No. 1685~ subject to the following conditions: 1. That the development be according to the submitted plot plans, excepting that the development shall comply with C-5 zoning provisions. 2. That all lights be directed away from adjacent residences. 3. That both Bristol Street and Hamlock Street be landscaped by a 5-foot planter strip. 4. That the subdivider's engineer furnish the Department of Public Works an on-site drainage flow plan showing the -1- direction and flow to adjacent streets when this property is developed. 5. That the subdivider's engineer furnish the Department of Publiu Works a final grading Dian, including existing elevations along the Northerly and Easterly property lines. 6. That the subdivi~er submit street improvement plans for Bristol Street and Hemlock Street. 7. That all elevations be on 1958 Orange County Survey Datum. 8. That all plans and surveys for the required improvements be completed by the owner's engineer and submitted to the Department of Public Works for approval. 9. That conditions numbered 4 through 8 be complied with prior to the issuance of a .building pemit 10. Thatthe owner.pro~ide sanitary sewer and storm Brain facilities to meet with the approval of the Department of Public Works. 11. That the owner place curb, gutter an~ sidewalk and pave up to the e~ge of existing pavement on Bristol Street. The new curb and gutter are to be placed 42 feet East of the center line of Bristol Street. 12. That the owner place curb, gutter and sidewalk and pave up to the center line on Hemlock Street plus the transition to existing pavement. The new curb and gutter are to be placed 18 feet South of the center line of Hemlock Street. 13. That approaches shall conform to City requirements as to location, number and width. 14. That conditions numbered 10 through 13 be complie~ with prior to issuance of utilities release by the Building Department.
