OVERRULING THE PLANNING COMMISSION AND GRANTING CONDITIONAL USE PERMIT NO. 126, SUBJECT ?0 CONDITIONS WHEREAS, after hearing on notice, the Planning Commission denied Conditional Use Permit No. 126 filed by CARL P. STEVENS and J. H. RICHARDS to establish retail sales and storage of new and used auto parts on M-2 property; and WHEREAS, Appeal Application No. 72 was duly filed by CARL STEVENS and HAROLD RICHARDS requesting a hearing on said Conditional Use Permit NO. 126 before the City Council; and WHEREAS, the City Council, after public hearing on notice, has determined that the Planning Commission should be overruled and that said Conditional Use Permit should be granted sub3ect to conditions. NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby grants Conditional Use Permit No. 126 for that property known and numbered as 915 East First Street, in the City of Santa Aha, County of Orange, State of California, described as: W. Z. Cook's Addition, Block 113, Lots 4 and 5, Assessor's Map Book 9, Page 11, County of Orange, in an M-2 District, to allow the establishment of retail sales and storage of new and used auto parts. Said Conditional Use Permit is granted subject to conditions as follows: 1. That the Westerly driveway (not in use) be closed to city standards. 2. That off-street parking area be designed to eliminate backing into First Street. 3. That there be five (5) marked (9' x 20') off-street parking spaces aligned in accessible and usable fashion off the main entrance on First Street. Said spaces to be so designed to allow required maneuvering on the applicant's property. 4. That not less than an 8-foot wood fence be erected along the East and West property lines. -1- 5. That all materials, products and items wrecked, dismantled or stored in the salvage yard be no higher than the fence or wall. 6. That all signing be incorporated into one sign at the sales office or yard entrance; the reasonable size of which to be determined by the Planning Commission. 7. That the above conditions be complied with prior to issuance of utilities release by the Building Department.
