ADMINISTRATOR AND THE PLANNING COMMISSION AND
GRANTING A VARIANCE ON VARIANCE APPLICATION
NO. 1689 FILED BY DAVID A. AND ELLEN M. MELIM,
SUBJECT TO CONDITIONS
WHEREAS, the Zoning Administrator, after public hearing on
notice, denied a variance on Variance Application No. 1689, filed
by DAVID A. and ELLEN M. MELIM to construct a six-unit apartment
building with a four-foot side yard on the street side of the parking
area at 602 East Chestnut Avenue in an R-2 District; and
WHEREAS, the Planning Co~u.ission affirmed the denial of said
Variance Application by the Zoning Administrator; and
WHEREAS, Appeal Application No. 74 was duly filed by DAVID
A. MELIM requesting a hearing on said Variance Application before
the City Council; and
WHEREAS, the City council, after public hearing on notice, has
determined that the Zoning Administrator and the Planning Commission
should be overruled and that said variance should be granted, subject
to certain conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Aha hereby grants a variance on Variance Application
No. 1689 to permit the property located at 602 East Chestnut ~venue
in the City of Santa Aha, County of Orange, State of California,
described as:
Beginning at a point 80 feet South of the Southwest
corner of Lot 8 in Block C in Halladay's Addition to
the Town of Santa Aha, as shown on a map thereof
recorded in Book 22, Page 14, Miscellaneous Maps, of
Los Angeles County and running thence East along the
South line of Chestnut Street 60 feet; thence South
150 feet; thence West 60 feet; thence North 150 feet
to the point of beginning,

The following conditions are to be complied with prior to the
issuance of a building permit:
That the subdivider's engineer furnish the Department of
Public Works an on-site drainage flow plan showing the
direction and flow to adjacent streets when this property
is developed.
That the subdivlder's engineer furnish the Department of
Public Works a final grading plan, including existing
elevations along the Northerly and Easterly property lines.
That vehicular access rights on Chestnut Avenue be dedicated
to City of Santa Aha. NOTE: Dedication shall be initiated
byc~ner through the Department of Public Works at least
two weeks prior to issuance of a building permit to avoid
delay.
That an easement be provided for a 25-foot radius ~property
line spandrel at the Southeast corner of Chestnut Avenue
and Hickory Street.
5. That the subdivider submit street improvement plans for
Hickory Street.
6. That all elevations be on 1958 Orange County Survey Datum.
That all plans and surveys for the required improvements
be ccanpleted by the owner's engineer and submitted to the
Department of Public Works for approval.
The following conditions are to be complied with prior to the
issuance of utilities release by the Building Department:
That the owner provide sanitary sewer and storm drain
facilities to meet with the approval of the Department of
Public Works.
That the owner place curb, gutter and full sidewalk and
pave up to the edge of existing pavement on Hickory Street.
The new curb and gutter to be placed 18 feet East of the
center line of Hickory Street.
3. That the owner replace the existing curb return with a
35-foot radius curb return.
That the owner replace the sidewalk on chestnut Avenue
along the entire frontage of the property involved in
this variance with new 5-foot sidewalk.
5. That the owner replace the broken curb on Chestnut Avenue.
