OF A SPANDREL AT THE SOUTHWEST CORNER OF EDINGER
AND CYPRESS FOR STREET PURPOSES
WHEREAS, the City is in the process of widening Edinger
Avenue and has determined that a spandrel turn area is necessary at
the Southwest corner of Edinger and Cypress.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Aha hereby finds and determines that the public interest
and necessity require that certain parcel of land herein described be
acquired to create an intersection turn area to accommodate the rapidly
increasing demands of traffic at said intersection, and further require
that the City do have, take and acquire for street purposes an easement
over that certain land in the City of Santa Ana, County of Orange,
State of California, described as:
An easement for street purposes over that portion of Lot 6
in Block "A" of Tract No. 252, McFadden Home Tract No. 3,
as shown on a map thereof recorded in Book 13, Page 33, Miscel-
laneous Maps, Records of Orange County, California, described
as follows:
A spandrel shaped parcel of land bounded Northerly by the
North line of said Lot 6, bounded Easterly by the East line
of said Lot 6 and bounded Southwesterly by the arc of a
curve concave Southwesterly having a radius of 25.00 feet
and tangent to said Northerly and Easterly boundaries.
BE IT FURTHER RESOLVED: That the public interest, necessity
and convenience require, and it is hereby ordered, that the City of
Santa Aha, a municipal corporation, take immediate possession and use
of the property herein ordered to be acquired upon complying with the
requirements of law applicable thereto; that the City Attorney report
to the Director of Finance the amount of money required therefor and
that the Director of Finance shall deposit said amount with the Clerk
of the Court for such possession.
BE IT FURTHER RESOLVED:
1. That said City Council hereby finds and declares that the
public improvement herein being provided for is planned and located
in a manner which will be most compatible with the greatest public
good and the least private injury.

2. That the City Attorney is hereby ordered to bring an action
in the name of the City of Santa Aha in the Superior Court of the State
of California, in and for the County of Orange, to condemn the property
herein described, and to do all things necessary to prosecute said
action to final determination.
3. That said action for condemnation herein ordered shall be
taken in accordance with the provisions of the Code of Civil Procedure
and the Constitution of the State of California relating to eminent
domain.
PASSED AND ADOPTED by the City Council of the City of Santa Ana
at its regular meeting held on the 3rd day of December, 1962.
