THE CITY OF SANTA ANA, REQUESTING CONSTRUCTION
OF A WA~ER SERVICE CONNECTION BY THE METROPOLITAN
WATER DISTRICT OF SOUTHERN CALIFORNIA, UPON THE
TERMS AND CONDITIONS PRESCRIBED IN RESOLUTION 6297
OF ITS BOARD OF DIEECTORS
WHEREAS, a request has been made on behalf of the City of Santa Aua,
hereinafter designated CITY, that a service connection be constructed upon the
Orange County feeder of the Metropolitan Water District of Southern California,
hereinafter designated METROPOLITAN, at the intersection of Red Hill Avenue
and Warner Avenue, for delivery of water by METROPOLITAN to CITY for use
within CITY; and
WHEREAS, the Board of Directors of METROPOLITAN at its meeting on
April 9, 1963, adopted its Resolu~ on 6297 authorizing the construction of
said service connection upon the terms and conditions fixed in said Resolution,
a certified copy of which Resolution has been received by CITY; and
WHEREAS, it is proper, under the policy of METROPOLITAN, that such
service connection be constructed at the expense of CITY and without cost to
METROPOLITAN upon the terms and conditions set out in NETROPOLITAN's said
Resolution;
NOW, THEHEFORE, BE IT RESOLVED THAT:
1. The certified copy of METROPOLITAN's said Resolution referred
to in the recitals hereof is ordered filed in the Office of the Clerk of the
Council, attached to this Resolution No. 63-75
2. METROPOLITAN is requested to construct the service connection
referred to in the recitals of this Resolution and such construction is
authorized on behalf of CITY in the manner and upon the terms and conditions
prescribed in METROPOLITAN's Resolution.
3. CITY agrees to pay, or reimburse to METROPOLITAN, all costs of
providing, constructing, and installing said service connection in accordance
with the terms and conditions of METROPOLITAN's Resolution which is hereby
incorporated by reference.
4. The Director of Public Works of CITY is hereby authorized to
approve the plans and specifications for said service connection and to
request commencement and/or suspension of service through said connection.
5. CITY agrees to pay METROPOLITAN for all water delivered through
said connection at the rate from time to time fixed by the Board of Directors
of METROPOLITAN.
6. The Mayor and Clerk of the Council of said CITY be and they
hereby are authorized to execute, on behalf of CITY, any agreement or agreements
necessary or required by METROPOLITAN to be entered into between METROPOLITAN
and CITY in order to provide for the construction of said service connection
in the manner and subject to the terms and conditions set forth in METROPOLITAN's
said Resolution, and to affix the corporate seal of CITY to any such agreement
or agreements; provided, however, that the signatures of the Mayor and Clerk
of the Council of said CITY, together with the corporate seal of CITY, affixed
to a certified copy of this resolution, shall, if acceptable to METROPOLITAN,
be, and be deemed to be, an agreement on the part of CITY for complying with
and carrying out all of the terms and conditions set forth herein and in
METROPOLITAN's said Resolution.
PASSED AND ADOPTED by the City Council of the City of Santa Aha at
its regular meetim4 held on the 6th day of May, 1963.
