COUNCIL OF THE CITY OF SANTA ANA,
CALIFORNIA, DETERMINING, ASCERTAIN-
ING AND FIXING THE GENERAL
PREVAILING RATE OF PER DIEM WAGES
AND THE GENERAL PREVAILING RATE
FOR HOLIDAY AND OVERTIME WORK
FOR EACH CRAFT, CLASSIFICATION OR
TYPE OF WORKMAN NEEDED TO EXECUTE
A3~L CONTRACTS FOR PUBLIC WORK IN
SAID CITY AND REPEALING RESOLUTION
NO. 62-175.
WHEREAS, pursuant to general law and the
charter of the City of Santa Ana, this City Council
from time to time awards contracts for, or authorizes
public work in, the City of Santa Aha; and
WHEREAS, before awarding any contract for
public work this City Council is required, under the
provisions of the Labor Code (commencing at Section 1770),
to determine, ascertain and fix the general prevailing
rate of per diem wages and the general prevailing rate
for holiday and overtime work for each craft, classification
or type of workman needed to execute any such contract;
and
WHEREAS, the City Council has ascertained and
considered the applicable wage rates established by
collective bargaining agreements and such rates as may have
been predetermined for federal public works within the
City of Santa Ana, and in the nearest labor market area,
and such further data from labor organizations and
employers or employers' associations, as this City Council
deems necessary for ascertaining the rates actually
applying in said city.
NOW,
of Santa Ana,
AND ORDER, as
THEREFORE, the City Council of the City
California, DOES HEREBY RESOLVE, DETERMINE
follows:
Section 1. This City Council hereby
determines, ascertains and fixes the general prevailing
rate of per diem wages and the general prevailing rate
for holiday and overtime work for each craft, classification
or type of workman needed to execute any public works
contract awarded or authorized by this City Council,
and such rates shall be as described and set forth in
the schedules marked Schedule "A" and Schedule "B",
which schedules are attached hereto, incorporated herein
and made a part hereof as though fully set forth herein.
Section 2. Not less than said rates, fixed
as herein provided, shall be paid to all workmen employed
on public works, exclusive of maintenance work.
Section 3. From time to time as changes
occur in any such rates or any new and different rates
prevail in said city, the City Council may either repeal
this resolution and adopt a new resolution determining,
ascertaining and fixing such rates or amend or supplement
this resolution by determining, ascertaining and fixing
such changed, new or different rates and for that purpose
may by resolution, amend, correct, modify or delete any
schedule previously incorporated herein or add new schedules
hereto.
Section 4. This resolution, including any
resolutions amendatory or supplementary hereto, may be
referred to in any other ordinance, resolution, notice,
contract, or other document. Any call for, or notice
inviting bids and any contract for the construction of
any public work in the City of Santa Ana may specify the
rates which shall be applicable thereto by referring to
and incorporating by reference the rates determined,
ascertained and fixed by this resolution, including
any resolutions amendatory or supplementary hereto. Any
such reference in any of the foregoing instruments shall
be deemed to include not only this resolution buy also
all resolutions theretofore adopted which may be amendatory
or supplementary to this resolution.
Section 5. The Clerk of the Council is
hereby directed to certify to the adoption of this
resolution, and to cause the same to be published once
in THE REGISTER, a newspaper of general circulation,
published and circulated in said city.
Section 6. The Clerk of the Council is
hereby authorized and directed to file a certified copy
of this resolution, and any resolution amendatory or
supplementary hereto, with the Director of Industrial
Relations of the State of California.
Section 7. Resolution No. 62-175 is hereby
repealed; provided, that any proceedings for or the award
or execution of any contract for public work commenced or
completed prior to the adoption of this resolution shall
remain unaffected by such repeal.
