HomeMy WebLinkAbout63-138RESOLUTION 63-138 OVERRULING THE PLANNING COMMISSION AND GRANTING CONDITIONAL USE PERMIT NO. 152 FILED BY FACTORY DEVELOPMENT CORPORATION WHEREAS, after hearing, the Santa Ana Planning Commission denied application for Conditional Use Permit No.152, and Appeal Application No. 90 was filed presenting the matter to the City Council; and at the original hearing thereon held August 5th, 1963, the City Council instructed the City Attorney to prepare a resolution denying said Conditional Use Permit; and WHEREAS, on the 19th day of August, the next regular meeting of the City Council, only four members of the Council were present and the matter was continued to an adjourned meeting of the City Council to be held August 26th, 1963, at 5:00 P.M., fo= further consideration and discussion of the law applicable to the Conditional Use Permit. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana finds: 1. That the use as requested by the application for Conditional Use Permit No. 152 is desirable to provide shopping facilities in the Southwest part of Santa Aha which will contribute to the general well- being of the neighborhood and community; 2. That such use will not, under the circumstances of this particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity of the property ~n question~or injurious to property or improvements in said vicinity; 3. That the proposed use will comply with the regulations conditions specified in Chapter 2 of Article IX of the Santa Aha Municipal Code for such use; and 4. That the granting of this Conditional Use Permit will not adversely affect the general plan of the City of Santa Ana. BE IT FURTHER RESOLVED: That based upon said Findings of Fact the City Council hereby overrules the Planning Commission and hereby grants Conditional Use Permit No. 152, filed by FACTORY DEVELOPMENT CORPORATION to construct a 130,000 square feet of building for a department store and gas station on approximately 12 acres of property,irregular in shape, located at the Northeast corner of Warner Avenue and Harbor Boulevard for the operation of a discount department store on property zoned M-i, under the following conditions: The following conditions are to be complied with prior to the issuance of a building permit: 1. That the subdivider's engineer furnish the Department of Public Works an on-site drainage flow plan showing the direction and flow to adjacent streets when this property is developed. 2. That the subdivider's engineer furnish the Department of Public Works a final grading plan including existing elevations along the property lines. 3. That the owner pay a drainage assessment fee of $300.00 per acre. 4. That only one drive approach be permitted on Warner Avenue. -1- 5. That the number, location and traffic routing of driveways to the proposed project be according to the recommendations of the City Traffic Engineer. 6. That customer vehicular circulation of the parking lot be redesigned to incorporate an inner loop adjoining the building and outer loop leading to the ingress-egre~s ~r~veway~; ~ala reaes~gn shall incorporate "reservoir" parking space at the exit driveways. 7. That 781 (9' x 20') accessible and useable stalls on asphalt or concrete be provided and be marked; said parking to incorporate one-way traffic down each aisle with provision for pedestrian walks. 8. That a detailed landscaping plan be submitted to and approved by the City Planning Department; said plan shall locate and identify all plant materials and how said landscaping will be maintained. 9. That a 15-foot landscaped yard be provided along the entire south and east boundaries of the customer parking lot. 10. That all outdoor storage of materials, products or equipment be located only at the rear or side of the main building and that said storage area shall be screened by a solid fence or wall not less than six feet in height. 11. That all signing be indicated on a plot plan and elevation and be submitted to and approved by the City Planning Department; said plan to indicate fully the size, height, bulk and text of the sign or signs in question. 12. That an easement be provided by dedication for Warner Avenue for a width of 52 feet, excepting that the width shall be 60 feet from the center line of Harbor Boulevard to a point 220 feet east and thence a taper to 52 feet at a point 360 feet east of the center line of Harbor Boulevard, center line to property line, for street purposes and vehicular access rights except at street intersections. NOTE: Easement shall agree with that shown on improvement plans 1-19-4. NOTE: Access for one driveway can be determined and approved prior to dedication. 13. That the property line radius at Harbor Boulevard and Warner Avenue and Warner Avenue and Marconi Street be 25 feet. 14. That access rights on Harbor Boulevard be dedicated. NOTE: Dedication shall, be initiated by owner, through the Department of Public Works, at least two weeks prior to application for a building permit to avoid delay. 15. That developer dedicate and submit improvement plans for Marconi and Pendleton Streets and Yale Street from Pendleton to Warner Avenue and improve the same. 16. That all elevations be on 1958 Orange County Survey Datum. 17. That all plans and surveys for the required improvements be completed by the owner's engineer and submitted to the Department of Public Works for approval. NOTE: It is necessary that the lot line between Lots 22 and 26 be revised on Tentative Tract No. 3236. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO ISSUANCE OF UTILITIES RELEASE BY THE BUILDING DEPARTMENT: 1. That the owner place curb and gutter and pave up to the center line on Marconi Street. The new curb and gutter to be placed 20 feet West of the center line of Marconi Street. -2- 2. That in view of the type of traffic using Marconi Street standard Type A 2 curb and sidewalk shall be used. 3. That the owner deposit the amount of $4,900.00 to cover the owner's share of the cost of improvements on Harbor Boulevard. 4. That if the final map for Tract No. 3236 is not recorded, then a preliminary record of survey map be filed and approved showing this cut fr~ the larger parcel. 5. That developer deposit with City $5,000.00 in cash to be used to assist in the installation of traffic control signal lights to regulate the increased flow of traffic generated by the requested use at any location within one-half mile of such use as may be determined necessary by City. Said fund, if not so used within 8 years from date of deposit, to be refunded to the person or entity depositing the same. PASSED AND ADOPTED by the City Council of the City of Santa Ana at an adjourned regular meeting held on the 26th day of August, 1963.
