HomeMy WebLinkAbout63-154RESOLUTZON N0.65-1~4 REQUESTING ALLOCATION OF FUNDS FOR THE FIRST STREET UNDERPASS UNDER SECTION 190 OF THE CALIFOI~I~IA STREETS A1VD HIGHWAYB CODE WHEREAS~ Section 189 of the Streets and Highways Code of the State of California, provides that the Public Utilities Commission shall prepare a priority list of railroad and street grade crossings most in need of separation~ and WHEREAS, Crossing Nos. 2~175.6-B and BK-51T.17-B on First Street between Evergreen Street and Grand Avenue in the City of Santa Aha was rated priority number i in the State of California for the calendar year 196~, and WHEREAS~ Section 190 of the same Code provides that the sum of $5,000,000 shall be allocated each year to be used for the elimination of grade crossings by the construction of grade separations. NOW, THEREFORE, LET IT BE RESOLVED, that the City Council of the City of Santa Ana hereby makes application to the California Highway Commission for an allocation of $612~800, which is 50% of the total estimated cost of the First Street Grade Separation Project after de- ducting all railway contributions. 1. All requirements of Section 190 of said Code have been met and it is possible to award a construction contract within six months from this date. 2. a. The estimatedtotal cost of the project is as follows: Preliminary engineering~ surveys and plans $ 44~45 Right of Way Acquisition Construction Work by Railroads Construction Engineering 545,000 581,360 181~725 22~170 TOTAL $1,374,600 The estimated break-down between the various agencies is as follows: AT&SF Railway Company $ 94,000 Southern Pacific Company 55,000 City of Santa Aha 306~400 County of Orange 306,400 State of California ($5,000,000 Fund) 612,800 TOTAL $1,374,600 3. Attached are certified copies of Public Utilities Commission Decision No. 64197~ dated September 4, 1962~ authorizing construction of a crossing at separated grades on First Street, and Decision No. 64198, dated September 4, 1962, authorizing construction of a grade crossing of Second Street over a spur track. 4. Attached are certified copies of agreements with the Atchison~ Topeka and Santa Fe Railway Company~ and with the Southern Pacific Company. 5- The City of Santa Ana budgeted in the 1962-63 Fiscal Year an amount of $257,750 in 5/8¢ Gas Tax Funds for this project. A copy of this approved budget is attached. The balance needed to complete the project will be budgeted in the 1964-65 Fiscal Year as the completion of the project is not anticipated until about December 31, 1964. The additional funds needed amount to $48,650. 6. The County of Orange has entered into an agreement with the City of Santa Ana which allocated $257,500 to this project. A copy of this agreement is attached. It is anticipated that an additional $48,900 will be allocated by the County Board of Supervisors in the 1964-65 Fiscal Year to complete the County's share of the project as it is the County's policy to allocate required additional funds for projects where ex- penditures exceed the allocation. Any deficiency~ however, will be covered by an allocation in the City budget for the 1964-65 Fiscal Year. 7. There are sufficient City funds available in the current 1963-64 budget which can be used to finance the project if necessary until the funds to be allocated in the 1964-65 Fiscal Year by both the City and the County are available. This would be done by budget transfer. 8. The Status of Right of Way Acquisition is summarized as follows: Total Number of Parcels in Project 21 Number of Parcels Already Acquired 9 Number of Parcels Covered by Right of Entry 4 Number of Parcels to be Condemned 8 The City Council has, by Resolution No. 63-15~ authorized condemnation proceedings on those parcels not acquired so that the right of way will be in the City's possession within 60 days from the date of the allocation by the California Highway Conmnission. A copy of this resolution is attached. 9. The plans and specifications are completed and have been sub- mitred for approval to the railway companies~ the County of Orange~ and the State Division of Highways.
