FROM SAID WEST LINE EASTerLY TO THE TR~CK OF SaID
R~ILWAY COMPANY, S~ID STR~.~3f BEING WHOLLY UNIMPROVED
WH~E~S, in 1893 a certain street easement, herein described,
was dedicated to the City of Santa Ana but was never improved or
opened to public use, and, in the process of negotiating with the
Atchison Topeka and Santa Fe Railway Company for the establishment
of separation of grade at the crossing of its tracks on First Street,
the Department of P~blic Works has requested that the streets herein
described be vacated to prevent street access to First Street in
this area.
NOW, TEW~EFORE, BE IT RESOLVED: That the map attached hereto
marked Exhibit "A" is hereby approved and ordered filed with and as
a part of this Resolution in the office of the Clerk of the Council,
and reference is hereby made to said map for particulars as to the
street vacation proposed herein; and the City Council hereby declares
its intention to vacate that portion of Second Street and that portion
of an unnamed street running between Second Street and First Street
in the City of Santa Ana, County of Orange, State of California,
described as follows:
Commencing at the intersection of the center line of
Second Street extended with the West line of the Southern
California Railway Depot grounds in the City of Santa aha,
thence East at a uniform width of sixty feet, thirty feet
on each side of said center line extended, to the track of
the railroad of the said Southern California Railway Company.
also a strip of land sixty feet in width, commencing on the
South line of Second Street nearly opposite to the track
scales located on the "Y" of said Railway Company in said
City of Santa Cna, and extending Southerly in a uniform
width of sixty feet to First Street, in said City of Santa
ana) both of said lines being shown by dotted lines on the
map on file in the Office of the City Clerk, City of Santa
Said easement being the land described in that particular
agreement between the City of Santa dna and the Southern
California Railway Company recorded March 13, 1893, in
Book'82, Page 108, Deeds, Orange County Records.
BE IT FURT~RESOLVEDTHAT: The hour of 7:30 P.M. on the
7th day of October, 1963, in the Council Chambers, City Hall, Third
and Main Streets, Santa Ana, California, is the time and place fixed
for hearing ail persons interested in or objecting to the proposed
vacation of said street.
The City Council declares its intention to proceed with this
street vacation under the provisions of the Street Vacation Act of
1941 (Sections 8300 through 8374 of the California Streets and High-
ways Code).
The Clerk of the Council is ordered to publish this Resolution
in the manner prescribed by law for the publication of ordinances of
the City, and the Director of Public Works is ordered to post notices
of street vacation conspicuously along the line of said street,
stating the passage of this Resolution of Intention to Vacate and the
time and place of hearing thereof. Said notices shall be posted not
more than 300 feet apart and at least three shall be so posted. Both
publication and pust~ng shall be completed at least 10 days before
the date of said hearing.
Resolution 63-131 is hereby rescinded.
