HomeMy WebLinkAbout63-181RESOLUTION 63-181 OVERRULING THE PLANNING COMMISSION AND GRANTING A VARIANCE ON VARIANCE APPLICATION NO. 1826 FILED BY CLARA EDITH VOSE, SUBJECT TO CONDITIONS WHEREAS, a~ter hearing on no, ice, %he Planning Commission denied a variance on Variance Application No. 1826, filed by CLARA EDITH VOSE, and Appeal Application No. 95 was filed presenting the matter to the City Council; and WHEREAS, the City Council, after public hearing on notice, has determined that the Planning Commission should be overruled and that said variance should be granted subject to conditions as rec~nmended by the Planning Commission. NOW, THF~REFORE, BE IT RESOLVED: That the City Council hereby grants a variance on Variance Application No. 1826 to permit the property located at the southeast corner of Bristol Street and Memory Lane, in an R-1 District, to be used for the construction of a service station. Said Variance is granted subject to the following conditions: That a 6-foot solid block wall be constructed along the entire east and south boundaries of the service station site, excepting that said wall be 3 feet in height within 10 feet of the street right of way. That a complete landscaping plan for the station site be submitted to and approved by the City Planning Department; said plan to include: a. 5-foot planters constructed on site at the locations indicated on the approved plot plan; b. The size, type and location of all plants, bushes and trees on the site; c. A 5-foot planting area along the interior of the block walls on the east and south; said areas to include trees, bushes or shrubs at least 6 feet high at time of planting and spaced not more than 10 feet apart that would grow to a height of at least 8 to 10 feet and achieve a landscaped backdrop for the station site as well as provide an aesthetically pleasing view for adjacent residences. That the applicant submit full renderings of the proposed station for Planning Commission approval and that the station, pumps and site be constructed according to the submitted design. 4. That all signs be non-flashing. That the existing traffic signal at the intersection of Bristol Street and Memory Lane be relocated and the cost of said relocation be borne by the Shell Oil Company. Said relocation to be determined by the Director of Public Works. That no outdoor storage, either permanent or temporary, such as tires, trailers, bales, etc., be permitted on site excepting for display racks for advertising purposes. 7. That all lights used in conjunction with the station be reflected away frem nearby residences. 8. That development as modified by the above conditions be otherwise according to the approved plot plan. That the following conditions are to be complied with prior to issuance of a building permit: a.) That the subdivider's engineer furnish the Department of Public Works an on-site drainage flow plan showing the direction and flow to adjacent streets when this property is developed. h.) That the subdivider's engineer furnish the Department of Public Works a final grading plan including existing elevations along the property lines. c.) That the owner pay a drainage assessment fee of $375.00 per acre. d.) That an easement be provided for Bristol Street for a width of 45 feet, and for Memory Lane for a width of 50 feet, center line to property line, for street purposes and vehicular access rights except at street intersections. NOTE: Dedication shall be for entire frontage on both Memory Lane and Bristol Street extending frown intersection to Tract No. 1980. NOTE: Access can be determined and approved prior to dedication. e.) That a 25-foot radius property, line spandrel easement be provided for at the southeast corner of Bristol Street and Memory Lane. NOTE: Dedication shall be initiatedby owner through the Department of Public Works at least two weeks prior to application for a building permit to avoid delay. f.) That the subdivider submit street improvement plans for Memory Lane and Bristol Street. g.) That all elevations be on 1958 Orange County Survey Datum. h.) That all plans and surveys for the required improvements be cc~npleted by the owner's engineer and submitted to the Department of Public Works for approval. 10. That the following conditions be complied with prior to utilities release by the Building Department for the service station: a.) That the owner place curb, gutter and sidewalk and pave up to the edge of existing pavement on Bristol Street. The new curb and gutter to be placed 37 feet east of the center line of Bristol Street. b.) That the owner place curb, gutter and sidewalk and pave up to the edge of existing pavement on Memory Lane. The new curb and gutter to be placed 40 feet south of the center line of Memory Lane.
