THE PLAATNING COMMISSION TO GRANT A VARIANCE
ON VARIANCE APPLICATION NO. 1836 FILED BY
THOMAS T. RUSSELL, SUBJECT TO CONDITIONS
WHEREAS, after public hearing on notice, the Planning
Commission granted a variance on Variance Application NO. 1836,
filed by THOMAS T. RUSSELL, to permit the construction of a
40-unit, 10-building, 2-story apartment complex on A-1 property
located at 4120 West Fifth Street, Santa Ana, California, subject
to conditions; and
WHEREAS, Appeal Application No. 103 was duly filed by BARNES
F. HUNT appealing the decision of the Planning Commission and
requesting a hearing on said variance before the City Council; and
WHEREAS, after public hearing on notice, the City Council
has determined that the decision of the Planning Commission should
be affirmed and that said variance should be granted, subject to
conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Santa Ana hereby affirms the decision of the Planning
Commission to grant a variance on Variance Application No. 1836,
subject to conditions as follows:
That a revised plot plan be submitted to and approved by the
City Planning Department; said plan to incorporate the
following features:
a. Less than 50% land coverage as defined in the R-4
District;
b. A non-monotonous orientation of buildings and open
space while continuing to maintain:
c. Separation of vehicular and pedestrian traffic as
per plan now under consideration.

That all provisions of the R-4 District be complied with,
excepting for two-story construction. Said two-story
construction shall be limited to studio apartments.
That the applicant submit a continuing offer of dedication
across the full width of the property measured from the
south property line to a point 30 feet north.
4. That development be according to a revised plot plan approved
by the Planning Director.
5. That the following conditions are to be complied with prior
to the issuance of a building permit:
That the subdivider's engineer furnish the Department
of Public Works a run-off study based on a storm of a
ten year frequency. This study to show existing and
proposed facilities and method of draining this area and
tributary areas without exceeding the capacity of any
street, on-site or off-site.

That the subdivider's engineer furnish the Department of
Public Works an on-site drainage flow plan showing the
direction and flow to adjacent streets when this property
is developed.
That the subdivider's engineer furnish the Department of
Public Works a final grading plan including existing
elevations along the property.

d. That the owner pay a drainage assessment fee of
$415.00 per acre.
e. That the subdivider submit street improvement plans
for Fifth Street.

That a continual offer of dedication for a 30-foot
easement for street purposes be granted along the south
property line.
g. That all elevations be on 1958 Orange County Survey
Datum.

That all plans and surveys for the required improvements
be completed by the owner's engineer and submitted to
the Department of Public Works for approval.
The following conditions are to be complied with prior to
issuance of utilities release by the Building Department:

That the owner provide sanitary sewer and storm drain
facilities to meet with the approval of the Department
of Public Works.

That the owner place curb, gutter and sidewalk and pave
up to the edge of existing pavement on Fifth Street.
The new curb and gutter to be placed 18 feet south of
the center line of Fifth Street.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 18th day of November, 1963.
