HomeMy WebLinkAbout63-185RESOLUTION 63-185 AUTHORIZING EXECUTION OF QUITCLAIM DEEDS BY THE CITY OF SANTA ANA WHERF2%S, heretofore on June 1, 1959, the City entered into Escrow No. 42743-C through Security Title Insurance Company with WILLIAM EARL PATTERSON and BLANCHE PATTERSON, and as a part of the consideration in said escrow agreed to transfer to the grantees herein referred to that property described herein which became excess and of no further use to the City as a result of the realignment of Fifth Street; and the City has determined to execute a quitclaim deed to effect said transfer; and WHEREAS, heretofore the owners of certain property located on the South side of Dyer Road, East of Oak Street, dedicated to the city vehicular access rights to Dyer Road, and the present Owners have now requested driveway locations across said area and the City has determined to grant the same; NOW, THEREFORE, BE IT RESOLVED: That the Vige-Mayor~and the Clerk of the Council are hereby authorized and directed to execute a deed quitclaiming to WILLIAM EARL PATTERSON and BLANCHE PATTERSON the City's interest in that certain property in the City of Santa Ana, County of Orange, State of California, described as: That portion of Fifth Street situated in the Rancho Santiago De Santa Ana, City of Santa Aha, County of Orange, State of California, which lies Southerly of the new South line of Fifth Street, which is parallel with and 42 feet Southerly, measured at right angles, from the following described new center line of Fifth Street: Commencing at the Southeast corner of Section 10, Township 5 South, Range 10 West, San Bernardino Base and Meridian, and running thence North 00° 06' 45" West 1243.69 feet along the center line of Sullivan Street to the center line of Fifth Street and to the true point of beginning; thence South 89° 28' 45" West 332.45 feet to the beginning of a tangent curve concave Northerly, having a radius of 1,200.00 feet; thence Northwesterly along the arc of said curve through a central angle of 11° 38' 20", an arc distance of 243.76 feet to a tangent line; thence North 78° 52' 55" West 85.00 feet. Said portion of Fifth Street quitclaimed hereby is bounded Westerly by a portion of the following described line: C~mencing at a point on the South line of said Section 10, which bears South 89~ 34' 00" West 778.03 feet from the Southeast corner of said Section 10, and running thence North 00° 01' 15" West 712.28 feet to the beginning of a tangent curve concave Easterly having a radius of 1,148.00 feet, and to the true point of beginning; thence Northeasterly along the arc of said curve through a central angle of 26° 28' 31" an arc distance of 530.47 feet to a point of compound curvature; thence Easterly along the arc of a curve concave Southeasterly, having a radius of 25 feet, through a central angle of 74° 39' 49" an arc distance of 32.58 feet to a tangent line, said tangent line being the new South line of Fifth Street, and bounded Easterly by the East line and its Northerly extension of the property contiguous on the South which is vested in the grantees herein named, and deliver the same to said grantees. BE IT FURTHER RESOLVED: That the Vice-Mayor and the Clerk of the Council are hereby authorized and directed to execute a deed quitclaiming IN SEVERALTY TO THE VARIOUS OWNERS OF THE UNDERLYING FEE, AS THEIR RESPECTIVE INTERESTS MAY APPEAR OF RECORD vehicular access rights to Dyer Road, East of Oak Street, and deliver the same to the Clerk of the Council. PASSED AND ADOPTED by the City Council of the City of Santa Aha at its regular meeting held on the 18th day of November, 1963.
