THE PLANNING COMMISSION TO GRANT A VARIANCE
ON VARIANCE APPLICATION NO. 1813 FILED BY

THE PLANNING COMMISSION'S DECISION TO EXCLUDE
THE SERVICE STATION PORTION FROM SAID VARIANCE
AND GRANTING SAID VARIANCE AS REQUESTED ON
APPLICATION NO. 1813, SUBJECT TO CONDITIONS
WHEREAS, Variance Application No. 1813 was filed with the
City Planning Department requesting permission to construct a
shopping center and service station on R-1 property located between
Mountain View and Newhope Streets on the South side of West Fifth
Street, Santa Aha, California; and
WHEREAS, after public hearing on notice, the Planning Commis-
sion granted said Variance but excluded the service station portion
of the applicant's request; and
WHEREAS, Appeal Application No. 110 was duly filed by said
applicants appealing the decision of the Planning Commission to
exclude the service station fr~m said Variance and requesting a
hearing on said Variance before the City Council; and
WHEREAS, the City Council, after public hearing on, notice,
has determined that the decision of the Planning Commission to
exclude the service station from the granting of Variance Application
No. 1813 should be overruled and that said variance should be granted
subject to conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana hereby approves the decision of the Planning
Co~amission to grant a variance on Variance Application No. 1813,
overrules the Planning Commission's decision to exclude the service
station portion from said Variance, and does hereby grant said
Variance as requested on Application No. 1813, subject to conditions
as follows:
1. That a minimum of 44 accessible and usable parking stalls on
asphalt or concrete be provided on the applicant's property.
2. That all parking be 9' x 20' and be marked and have wheel stops.

That a 6-foot block wall be constructed along the applicant's
south property line; and/or the south line of a 20-foot alley
to the rear df the property in question.
That a detailed landscaping plan showing over-all treatment of
the property, meaning type, size and placement of shrubs,
grass and landscaping, be submitted to and approved by t'ne
Planning Department prior to a utilities release.
5. That the following conditions be complied with prior to issuance
of a building permit:
That the subdivider's engineer furnish the Department of
Public Works an on-site drainage flow plan showing the
direction and flow to adjacent streets when this property
is developed;
That the subdivider's engineer furnish the Department of
Public Works a final grading plan including existing
elevations along the property lines.
c. That the owner pay a drainage assessment fee of $415.00
per acre.
d. That the plot plan be revised so that driveways conform
to the Municipal Code.
That an easement be provided for Newhope Street for a
width of 42 feet, center line to property line, for
street purposes and vehicular access rights except at
street intersections.*

That a 25-foot radius property line spandrel easement be
provided for at the southeast corner of Fifth Street and
Newhope Street, and at the southwest corner of Fifth
Street and Mountain View Street.**
g. 'l~nat the subdivider submit street improvement plans for
Fifth Street, Newhope Street and Mountain View Street.
h. That all elevations be on 1958 Orange County Survey Datum.
That all plans and surveys for the required improvements
be completed by the owner's engineer and submitted to the
Department of Public Works for approval.
6. That the following conditions be complied with prior to a utilities
release by the Building Department:
That the owner provide sanitary sewer and storm drain
facilities to meet with the approval of the Department
of Public Works.
That the owner place curb, gutter and sidewalk and pave
up to the edge of existing pavement on Fifth Street.
The new curb and gutter to be placed 18 feet south of
the center line of Fifth Street.
That the owner place curb, gutter and sidewalk and pave
up to the edge of existing pavement on Newhope Street.
The new curb and gutter to be placed 32 feet east of the
center line of Newhope Street.

That the owner place curb, gutter and sidewalk and pave
up to the center line on Mountain View Street. The new
curb and gutter to be placed 18 feet west of the center
line of Mountain View Street.
* NOTE: Access can be determined and approved prior to dedication.
** NOTE: Dedication shall be initiated by owner, through the
Department of Public Works, at least two weeks prior to
application for a Building Permit to avoid delay.
