COMMISSION AND GRANTING A VARIANCE ON
VARIANCTM APPLICATION NO. 1845 FILED BY
DOXANDER P. LEONARD, ET AL., SUBJECT TO
CONDITIONS
WHEREAS, after hearing on notice, the Planning Commission
DENIED a Variance on Variance Application No. 1845, filed by
DOXANDERP. LEONARD, ET AL., and Appeal Application NO. 108 was
duly filed presenting the matter to the City Council; and
WHEREAS, the Clty Council, after public hearing on notice,
has determined that the Planning Commission should be overruled
and that said Variance should be granted subject to conditions as
recommended by the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED: That the City Council
hereby grants a variance on Variance Application No. 1845 to permit
the property located east of Bristol Street, between Memory Lane
and the Santa Aha Freeway, in an A-1 District, to be used for the
construction of a 203-unit, one and two story apartment complex.
Said Variance is granted subject to the following conditions:
1. That the applicant comply with all provisions of the R-4 District.
2. That the applicant submit a revised plan of the project; said
revised plan to show:
A plot plan with not more than 199 units (the deletion of
4 units in the locations outlined in the latest revised
plot plan on file at time of hearing with Planning
Department).
b. ~nergency access areas to the west end of West Orange Road
and to future Westwood Street.
The development timing or phasing,unless the applicant
wishes to construct the entire project at one time. Said
construction order shall be approved by the Planning
Director in order to assure the following features within
the project:
1. Adequate vehicular circulation into, around and
through the project by emergency vehicles.
2. Adequate ingress-egress frc~ Bristol Street for
the project.
Crash gates at the emergency access points that will
be functional, aesthetical and compatible to the
project and surrounding neighborhood.
4. Construction features, such as block walls, etc.,are
implemented on each phase or total project.
d. A perspective rendering and elevation plan for each design
motif in the project.

That development be according to revised and approved plot plan,
rendering and elevations except for minor modifications approved
by the Planning Director.
That crash gates be installed across the emergency access points;
the detailed plans of said gates shall be filed with the Planning
Department and shall include the signed approval of the City Fire
Chief or his representative. Said gates shall be so designed,
erected and maintained by the applicant so as to deny all
pedestrian and vehicular access except for emergency service to
the site by proper officials.

That the applicant or his heirs or assignees defray one half
the total cost of any future signal on Bristol Street, north of
Memory Lane, at the major entrance to the development.
That the applicant submit a complete and detailed landscaping
plan of the total site for approval by the City Planning Depart-
ment; said plan to indicate the type, size and location of all
trees, shrubs and grass.
That all landscaping be implemented and maintained by the
applicant.
That final subdivision maps for R-1 Development for 16 lots with
a minimum of 8,000 square feet be filed and approved; and further
that the applicant execute a contractual agreement with the
proper City officials to provide in the deed for the sale of all
16 lots limiting the same to single family home construction
with 1,700 square feet or more, providing further that said
restrictions shall be irrevocable for a period of 10 years,
before a building permit is issued.
The following conditions are to be complied with prior to the
issuance of a building permit:
That the subdivider's engineer furnish the Department of
Public Works a run-off study based on a storm of a ten year
frequency. This study to show existing and proposed
facilities and method of draining this area and tributary
areas without exceeding the capacity of any street, on-site
or off-site.
That the subdivider's engineer furnish the Department of
Public Works an on-site drainage flow plan showing the
direction and flow to adjacent streets when this property
is developed.
That the subdivider's engineer furnish the Department of
Public Works a final grading plan, including existing
elevations along the property lines.
d. That the owner pay a drainage assessment fee of $375.00
per acre.

That an easement be provided for Bristol'Street for a width
of 50 feet, center line to property line, for street
purposes and vehicular access rights, except at street
intersections.
That there shall be allowed two entrances, for ingress and
egress, on Bristol Street. One shall be located on the
south property line and the other shall be located 1036 feet
north of the center line of Memory Lane. The plot plan
shall be revised to show these driveways.
g. That a drainage easement be provided for along the south
property line.
NOTE:
Dedication shall be initiated by owner, through the
Department of Public Works, at least t~o weeks prior
to application for a Building Permit to avoid delay.
h. That the subdivider submit street improvement plans for
Bristol Street.
i. That all elevations be on 1958 Orange County Survey Datum.

That all plans and surveys for the required improvements
be completed by the owner's engineer and sUbmitted to the
Department of Public Works for approval.
10. The following conditions are to be complied with prior to the
issuance of utilities release by the Building Department:
That the owner provide sanitary sewer and storm drain
facilities to meet with the approval of the Department of
Public Works.
That the owner place curb, gutter and sidewalk and pave up
to the edge of existing pavement on Bristol Street. The
new curb and gutter to be placed 42 feet east of the center
line of Bristol Street.
That the drainage easements along the north and south
property lines be improved to take care of the surface
run-off in a manner satisfactory to the Department of
Public Works.
