ISTRATOR BUT MODIFYING CONDITIONS AND GRANTING
VARIANCE APPLICATION NO. 1425 FILED BY JESSE AND
LILLIAN OJEDA
WHEREAS, the Zoning Administrator, after public hearing on
notice, granted Variance Application No. 1425, filed by Jesse and
Lillian 03eda; and
WHEREAS, the Planning Commission did not affirm the granting
of said Variance Application but found that the matter was of such
magnitude as to be of special interest to the people of the City of
Santa Ana and referred said Variance Application No. 1425 to the
City Council; and
WHEREAS, the City Council, after public hearing on notice,
has decided that the Zoning Administrator's findings should be
affirmed, but that conditions established by said Zoning Adminis-
trator should be modified.
NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby
grants a variance on Application No. 1425 to permit the property in
the City of Santa Aha, lying in the County of Orange, State of
California, described as:
Parcel 1. Lot 7, Spurgeon Street Tract, as per map
recorded in Book 6, Page 23 of Miscellaneous Naps in
the office of the Recorder of said County. Excepting
therefrom a strip of land 11.21 feet wide along and
adjoining the South line thereof.
Parcel 2. Beginning at a point in the North line of
Lot 7 of the Spurgeon Street Tract, as per map recorded
in Book 6, Page 23 of Miscellaneous Maps in the office
of the Recorder of said County, said point being 24.45
feet East of the Northwest corner of said Lot 7, running
thence South along the boundary line of said Lot 7,
21.8S feet; thence East along the boundary line of said
Lot 7, 21.88 feet; thence East along the boundary of
said Lot 7, 47.~0 feet; thence North along the boundary
line of said Lot 7, 21.74 feet to the North line of said
Lot 7, thence West 47.~0 feet to the point of beginning.
Parcel 3. Lot ~ of the Spurgeon Street Tract in the
City of Santa Ana, County of Orange, State of California,
as per map recorded in Bo~ $, Page 23, Miscellaneous
Maps in the office of the County Recorder of said
County, excepting therefrom the East 50 feet thereof.

Parcel 4. Beginning at a point on the East line of
Lot 7 of the Spurgeon Street Tract, in the City of
Santa Ana, county of Orange, State of California, as
per Map recorded in Book 6, Page 23 of Miscellaneous
~aps, in the office of the County Recorder of said
County, 11.21 feet North of the Southeast corner of
said Lot 7; thence West parallel with the South line
of said Lot 7, 196 feet, more or less, to the Easterly
line of Spurgeon Street, as shown on said map; thence
Southerly along the Easterly line of Spurgeon Street
to the Southwest corner of said LOa 7; thence East
along the South line of said Lot 7, 197.65 feet to the
Southeast corner of said Lot 7; thence North 11.21
feet to the point of beginning, excepting therefrom
the East 50 feet thereof;
in an R-3 District to be used for the construction of a six-story
(54 feet) apartment house with a six foot projection into the re-
quired front yard, and with S55 square feet of lot area per unit
instead of the required 1200 square feet of lot area per unit.
Said Variance is granted subject to conditions:

That the two existing drive approaches on Spurgeon Street be
closed or replaced with a standard approach.
That 30 lineal feet of broken sidewalk be replaced.
That the alley to the rear of the property involved in this
Variance Application be improved.
That none of the proposed 4 structures be more than 6 stories in
height and not more than 70 feet in overall height from ground
level.
That the 20 proposed two-bedroom apartments be not less than
1500 square feet of floor area each; that the 2 proposed two-
bedroom penthouse apartment units be not less than 2200 square
feet of floor area.
That the development total not more than 22 two-bedroom units.
That all proposed parking areas, driveways, aisles and ramps be
be concrete or asphalt.
That the proposed 2 two-way ramps be not less than 20 feet in
width, and that both ramps meet all safety requirements d~ter-
mined by the City Traffic Engineer and the City Building
and Safety Department.
That all proposed subterranean parking stalls be not less than
9 feet by 20 feet, and that all be accessible and useable and
number not less than 33.
That all lights for the 33 subterranean parking stalls be reflec-
ted aw-ay from any adjoining residences.

That all engineering for the above improvements be done by
the owner's engineer and submitted to the Department of Public
Works for approval.
That the development be in accordance with the plot plan as
submitted and in accordance with the model presented to the City
Council on February 5, 19~t; that in no way will this develop-
ment be changed in nature or scope from the plot plan other than
number ~and placement of support columns, which must be approved
by the Planning Director.
That all of the above conditions be complied with prior to the
issuance of a utilities release by the Building Department.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 8th day of February, 1981.
