HomeMy WebLinkAbout61-026RESOLUTIO~ NO. 61-Z6 AUTHORIZING COND~4NATION OF CERTAIN REAL PROPERTY FOR THE PURPOSE OF WIDENING FIFTH STREET AND DECLARING ~HE NECESSITY THEREOF WIqEREAS, Fifth Street as it now exists from the Santa Ana River Westerly to Harbor Boulevard is inadequate in width to accomo- date the flow of traffic presently using said street. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Aha does hereby find and determine that public interest and necessity require that Fifth Street be widened and improved on the North and South sides, and further require that said City do have, take and acquire easements for street purposes over, through and across certain lands in the City of Santa Ana, County of Orange, State of California, described as: PARCEL 1: The Southerly 45.00 feet of the East 139.00 feet of the West 159.00 feet of the South 230.00 feet of the Northwest quarter of the Southeast quarter of Section 10, in Township 5 South, Range 10 West, in the Rancho Las Bolsas, City of Santa Ana, as shown on a map thereof recorded in Book 51, Page 7 et seq, Miscellaneous ~aps, records of Orange County. PARCEL 2: The Southerly 45,00 feet of the East 100.00 feet of the West 259 feet of the South 290 feet of the Northwest quarter of the Southeast quarter of Section 10, in Township 5 South, Range 10 West, San Bernardino Base and Meridian, in the City of Santa Ana, California. PARCEL 3: An easement for street purposes over the Southerly 18.00 feet of that portion of the Northwest quarter of the Southeast quarter of Section 10, in Township 5 South, Range 10 West, San Bernardino Base and Meridian, described as follows: Beginning at a point 220 feet West of the intersection of the North line of Fifth Street with the Westerly line of the Santa Ana River, through the Newbert Protection District and run- ning thence North 260 feet; thence West 69.50 feet; thence South 260 feet to said North line of Fifth Street; thence East 69.50 feet to the point of beginning. PARCEL 4: Beginning at the point of intersection of the North line of Fifth Street with the Westerly line of the right of way of the Santa Ana River through the Newbert Protection District running thence West along said North line of Fifth Street 120 feet to the true point of beginning; thence North 26.00 feet; thence East 75.00 feet; thence South 26.00 feet; thence West 75.00 feet to the true point of beginning. -1- PARCEL 5: Beginning at a point 120 feet West of the intersection of the North line of Fifth Street with the Westerly line of the Santa Ana River, through the Newbert Protection District; and running thence North 23.00 feet; thence West 100 feet; thence South 23.00 feet to said North line of Fifth Street; thence East 100 feet to the point of beginning. PARCEL 6: An easement for street purposes over the Northerly 49.00 feet of that portion of the Southwest quarter of the Southeast quarter of Section 10, in Township 5 South, Range 10 West, San Bernardino Base and Meridian, in the City of Santa Ana, California, described as follows: Beginning at a point in the North line of the Southwest quarter of the Southeast quarter of said Section 10, distant North 89° 35' 00" East 335.50 feet from the Northwest corner of the Southwest quarter of said Section 10, thence South 01~ 16' 20" West 176.00 feet; thence South $9° 35' 00" West 70.00 feet to a point being Station "A"; thence South 01~ 1~' 20" West 23~.67 feet; thence South ~9° 35' 00" West 05.71 feet to a point, distant North 89° 35' 00" East 71.25 feet from the Southeast corner of land described in Deed to Maril W. Guynn, recorded September 11, 1936, in Book 843, Page 305, Official Records, in the Office of the County Recorder of Orange County, California; thence North 00v 32' 20" West 412.49 feet to a point in the North line of the Southwest quarter of the Southeast quarter ~ said Section 10, distant North 89° 35' 00" East 96.00 feet from the Northeast corner of said land of b~aril W. Guynn; thence North 89° 35' 00" East 148.75 feet to the point of beginning. BE IT FURTHER RESOLVED: That the City Attorney is hereby ordered and directed to bring an action in the name of said City in the Superior Court of the State of California, in and for the County of Orange, to condemn said property necessary to be taken as herein ordered and described, and to do all things necessary to prosecute said action to final determination. BE IT FURTHER RESOLVED: That the public interest, necessity and convenience require, and it is hereby ordered that, the City of Santa Ana, a municipal corporation, Plaintiff in the Condemnation Action ordered herein, take immediate possession and use of the property herein ordered to be acquired upon compliance with the requirements of the law applicable thereto; that the City Attorney report to the Director of Finance the amount of money required thereof, and that the Director of Finance shall deposit said amount with the Clerk of the Court. -2- BE IT FURTHER RESOLVED: That the said action for condem- nation of said property so to be acquired shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 6th day of February, 1961.
