HomeMy WebLinkAbout61-069RESOLUTION NO. 61-69 OPPOSING THE ADOPTION OF ASSEMBLY BILL 427 WHEREAS, Cities, Counties and the State of California have processes of employment which reasonably require certain age limi- tation because of the physical requirements of the duties involved, this being particularly true in the employment of peace officers, firemen, tree and pole climbers and certain other park and forestry employees, and other positions where great physical strength, agility and strenuous physical endeavor is required on an emergency basis, or where the high hazard of the occupation is reduced by the employment of younger personnel whose physical agility has not yet been im- paired; and WHEREAS, the State Employees' Retirement System and the vari- ous county and individual city retirement programs as presently regu- lated make it financially undesirable to employ people of advanced years because most of such programs have "no exception permitted" clauses in the group coverage Provided; and WHEREAS, until there is legislation amending the statute regu- lating the State Employees' Retirement provisions to allow special employment to persons over fifty-five years of age, excluding them from the provisions of the retirement program, cities and the State of california will be properly reluctant to employ such persons in any large numbers, the same being actuarially undesirable to such employing agencies. NOW, THEREFORE, BE IT RESOLVED: that the City Council of the City of Santa Ana opposes the adoption of Assembly Bill 427 and urges that the determination as to the age of persons being initially em- ployed should be left to the discretion of the local agencies.
