AGREEMENT
THIS AGREEMENT is made and entered into this 17th day
of June 1975, by and between the CITY OF
SANTA ANA, a Municipal corporation, hereinafter designated as
"SANTA ANA," and the CITY OF GARDEN GROVE, a Municipal corporation,
hereinafter designated as "GARDEN GROVE."
RECITALS
1. Both Garden Grove and Santa Ana maintain as part of
their municipal service, an organized and equipped fire depart-
ment, charged with the duty of fire protection and rescue within
the corporate limits of each of said cities.
2. Investigation has disclosed that it would be to
the mutual benefit of each city that the services of each fire
department be, in some circumstances, extended outside of the
corporate limits of each city and into the other city.
3. The parties desire to enter into a mutual response
pact, wherein in some circumstances Garden Grove will respond to
incidents within the corporate limits of the City of Santa Ana
and conversely and mutually the City of Santa Ana will in some
circumstances respond to incidents within the corporate limits
of Garden Grove.
THE PARTIES MUTUALLY AGREE AS FOLLOWS:
4. The parties hereto, pursuant to the authority
granted by Section 55632 of the Government Code, hereby contract,
to respond to emergency alarms outside their corporate
geographical limitations, and within the corporate geographical

limitations o.f the other, iz- accordance with the terms and
conditions as shall hereinafter appear.
S. Specific details of the services to be provided
under this Agreement shall be: determined by the respective fire
chiefs -of each city; however, it is understood that all.plans
which'deal. with emergency response shall. adhere as closely as
practical to the "nearest: unit" concept which forms . the basis
for -this mutual response pact, except that Paramedic service is
not included'in this agreement-
6. Each of the parties will provide fire apparatus
to geographical areas of the other city, accompanied by a
minimum of three men, including a. company commander.
7. The City of Garden Grove agrees to indemnify and
hold the City of Santa Ana harmless from Loss, liability, claim,
suit or judgment resulting from work or acts done or omitted by
the City of Santa Ana
,.in carrying out this agreement. The City
of Santa Ana agrees to indemnify and hold the City of Garden Grove
harmless from any :Loss, liability, claim, suit, or judgment
resulting from work or acts done or omitted by the City of Garden
Grove in carrying out this agreement. Those provisions are
included in accordance with Government Code Section 895.4 and
are applied to all parties herein.
8. Each city shall maintain suitable workmen's compen-
sation coverage for its own employees without cost to the; other
city, and each city shall payroll its own personnel. without cost
to the other city.
9. Each of the parties hereto shall be fully res-
ponsible for all repair, maintenance and upke,ep of all equipment

in use pursuant to this Agreement, while said equipment is used
outside of: its geographical limitations, said repair and mainten-
ance and upkeep to include gas, oil, lubrication, parts replace-
ment and repair of casualty damage.
1.0. The costs necessary to develop and provide for
the necessary inter -tie between communications systems shall be
shared 'equally by -the participating cities.
11. The service mutually agreed to he rendered
pursuant to this Agreement shall include first alarm fire and
rescue and each r.i•ty shall be responsible for providing, where
possible; the additional equipment necessary in the event of a
second. or third alarm involvement within its geographical liraits.
12. Each city warrants and represents., that it has
sufficient equipment to handle the involvements which skull be
assigned to it under this agreement and that in the: event certain
types of involvements require special_ equipment, the responsible
city will. not be obligated to respond to said involvement unless
and until it has obtained said special equipment. It is further
understood and agreed by and between the parties hereto, that the
Fire Chief of each city or his designated representatives shall
work. out and agree upon the capabilities of each city to respond
to involvements requiring special equipment and that neither city
will be obligated under this Agreement to respond to any involve-
ment requiring special equipment where said. city does not own or
operate said special equipment.
13. Each city shall provide' the necessary police
traffic,control personnel within its geographical boundaries.

of this Agreement, there is hereby designated the Fire Chiefs of
each city who shall be jointly responsible for the administration
of this contract. This responsibility may be delegated to agents
or employees of the respective fire departments of the cities and
that eadh party shall furnish the other in writing the names and
rank of all participating officers.
15. For all structural fires, or upon request, wher(.�
either city responds outside its geographical boundaries, that
the other city will provide an officer of its department in the
position of Battalion Commander or greater who will be in charge
aiW who will direct activities and have the final voice in
releasing any engine company from the scene.
16. No money payments shall be made between the cities
party to this Agreement, in performance of this contract.
17. This agreement shall be in effect from the date
of its execution, providing that the same may be terminated by
either party after giving notice in writing of its intention to
teyminate not
less than
ninety
(90) days
from and
after
the date
of said
notice.
This agreement
shall be
reviewed
by the
parties
at least annually.
The parties hereto have executed this agreement the
day and year first above written.
