EC:ej <br />4-13-77 <br />AGREEMENT FOR THE PAYMENT OF EXTRAORDINARY SEWER <br />MAINTENANCE FEES BETWEEN THE CITY OF SANTA ANA <br />AND THE GARDEN GROVE SANITARY DISTRICT <br />THIS AGREEMENT, made and entered into this WtZ, day <br />of MF41 r 1977, by and between the City of <br />Santa Ana, a municipal corporation of the State of California <br />hereinafter called "CITY", and the GARDEN GROVE SANITARY DISTRICT <br />OF ORANGE COUNTY, a public corporation of the State of California, <br />hereinafter called "DISTRICT", <br />W I T N E S S E T H <br />RECITALS <br />1. CITY proposes to construct a northerly and easterly <br />extension of its C-5-F Storm Drain to its ultimate upper terminus; <br />and <br />2. DISTRICT owns and maintains an existing ten -inch sani- <br />tary sewer in First Street at the intersection with Figueroa <br />Street located at a depth which conflicts with the proposed storm <br />drain; and <br />3. CITY proposes to remedy said conflict by constructing <br />an inverted siphon in DISTRICT'S ten -inch sewer, thereby creating <br />extraordinary maintenance costs over and above the costs of main- <br />taining the presently un-siphoned sewer. <br />WHEREFORE, in consideration of the respective and mutual <br />covenants and promises hereinafter contained and made, the <br />parties hereto agree as follows: <br />A. CITY agrees to construct an inverted siphon in <br />DISTRICT'S said ten -inch sanitary sewer without flow <br />interruption. <br />B. DISTRICT agrees to permit CITY'S construction <br />of said inverted siphon on its ten -inch sanitary <br />sewer in the vicinity of First Street and <br />Figueroa Street, Santa Ana. <br />C. CITY agrees to pay DISTRICT two -hundred forty <br />
