OF CERTAIN REAL PROPERTY SOUTH OF FIRST STREET,
NORTH OF McFADDEN AVENUE, FOR THE CONSTRUCTION
OF PROPOSED FAIRVIEW STREET
WHEREAS, Fairview Street is presently proposed to be extended
South of First Street to provide an artery for North and South
vehicular traffic.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana does hereby find and determine that public interest
and necessity require that Fairview Street be extended Southerly from
First Street, as shown on maps thereof on file in the office of the
Department of Public Works and herein referred to for greater detail,
to accommodate the demands of traffic, and further require that said
City do have, take and acquire an easement for street purposes over,
through and across certain lands in the City of SantaAna, County of
Orange, State of California, described as:
That portion of a strip of land 52.00 feet wide, the East
line of which is described as follows:
Beginning at the intersection of the center lines of
Fairview Street and McFadden Avenue as shown on a map
of Tract Number 3423 recorded in Book 127, Pages 10, 11,
and 12 of Miscellaneous Maps, Records of Orange County,
State of California, said intersection also being the
Northwest corner of said Tract Number 3423, and running
along the following courses, bearings based on said'
center line of McFadden Avenue as being North 89° 22' 28"
East; thence North 0° 47' 20" West 2,215.57 feet to the
beginning of a tangent curve concave Easterly having a
radius of 1,200.00 feet; thence Northerly along the arc
of said curve through a central angle of 34° 58' 14" an
arc distance of 732.42 feet to a point of reverse curva-
ture; thence Northerly along the arc of a curve concave
Westerly having a radius of 1,238.97 feet through a central
angle of 34° 52' 44" an arc distance of 754.23 feet to a
tangent line; thence North 0° 41' 50" West 307.72 feet to
& point on the center line of First Street, said point lies
823.03 feet Westerly from the center line of Sullivan Street
measured along said center line of First Street, said center
line of First Street being the South line of Section 10,
Township 5 South, Range 10 West, San Bernardino Base and
Meridian.
Lying within the following described property:
Beginning at the Northwest corner of the land deeded December
9, 1876, from H. H. Roper to C. G. Linington, et al., by deed
recorded in Book 52, Page 233, Deeds, Records of Los Angeles
County, California, running thence West 19.15 chains; thence
Southerly 8.36 chains= thence East 19.15 chains; thence North
8.36 chains to the point of beginning.

BE IT FURTHER RESOLVED: That the City Attorney is hereby
ordered and directed to bring an action in the name of said City in
the Superior Court of the State of California in and for the County
of Orange, to condemn said property necessary to be taken as herein
ordered and directed and to do all things necessary to prosecute
said action to final determination.
BE IT FURTHER RESOLVED: That the public interest, necessity
and convenience require, and it is hereby ordered that the City of
Santa Ana, a municipal corporation, Plaintiff in the condemnation
action ordered herein, take immediate possession and use of the
property herein ordered to be acquired upon compliance with the
requirements of the law applicable thereto; that the City Attorney
report to the Director of Finance the amount of money required there-
of; and that the Director of Finance shall deposit said amount with
the Clerk of the Court.
BE IT FURTHER RESOLVED: That said action for condemnation of
said property so to be acquired shall be taken in accordance with the
provisions of the Code of Civil Procedure and the Constitution of
the State of California relating to eminent domain.
