W-1-T-N-E-S-S-E-T-14 Recitals: A. Santa Ana is currently assigned a certain local government radio frequency, which the City of Industry is desirous of utilizing on as shared banis; and B. Santa Ana currently operates approximately 120 radio unlrR on such f req"ency; and C. Both Cities desire to enter into an Agreement respecting the shared use of such frequency and providing that Industry will assure Santa Ana's continued use of all current and future radio units up to a maximum of 160 such units, fl such frequency without interruption as a result of the shared use of such frequency. WHEREFORE, in consideration of the foregoing, and subject to the terms and conditions hereinafter set forth, the parties hereto do hereby agree as follows: 1. From and after the exec"tion of this Agreement, Santa Ana and Industry may each utilize the local government radio frequency currently utilized by Santa Ann. 2. It is anticipated that Industry's use OF such frequency will not interfere with Santa Ana's current use thereof. However, in the evpnt that Industry's use of such frequency sloes affect Santa Ana's radio transmissions in -I- r 147- any manner,"Indbstry agrees to nod Cry the Santa Ann base station(s) by the installation of "guard boards", "tone guards", or such of apparatus as is reasonably necessary to preserve the use, by Santa Ann, of all current and foturn radio nn!rR on such frequency, up to a maxinum of 160 Ruch units. All costs incurred in the modification of the Santa Ann station as set forth above shall he borne by Industry. In the event Santa Ana has not made snob determi— nation and required such installation by Industry within a period of Five years Prom the time Industry begins using the frequency, this provision of this Agree — mint will have no further force or effect. 3. This Agreement shall constitute consent by Santa Ana to Industry-s use of such frequenev, on the terns contained herein.
