oN FILE VvORK MAY PROCEED UN IR "URA CE E,XP11JES GLERK OF I)A X Er SECOND AMENDMENT TO AGREEMENT THIS SECOND AMENDMENT TO AGREEMENT, is entered into on 2003, by and between Hood Services, Inc., a Californi — ----- ia corporation ("Contractor") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). Recitals: A. The parties entered into an Agreement dated March 6, 2001, (hereinafter referred to as "said Agreement") by which Contractor provides reduced price vending services to the City at City -owned locations. B. Subsequent to the execution of said Agreement and First Arnendment to said Agreement, Contractor changed its name to Downey Vendors Inc.; remaining the same corporate entity, with only the nai-ne change. C. Contractor desires to continue to provide "reduced prices" however, Contractor has informed and provided evidence to the City that whole -sale prices for certain items sold in Contractors vending machines has increased substantially. D. The parties wish to amend said Agreement to adequately reflect the cost to provide products in Contractors vending machines. Wherefore, in consideration of the covenants contained in said Agreement, and subject to all the teens and conditions of said Agreement, the parties agree as follows: I. Contractor's name shall be changed to Downey Vendors, Inc., to accurately reflect the company name change. 2. Exhibit A of said Agreement shall be amended to increase vending machine prices of the following items: Candy shall be raised from .55 cents to .60 cents Big Cookie shall be raised from .60 to .65 cents Pastry Items shall be raised from .75 cents to .85 cents Bottle Soda shall be raised from .90 cents to $1. .00 Bottle Juice shall be raised to from $ 1.00 to $ 1. 10 All other prices shall remain in effect.
