HomeMy WebLinkAbout61-122RESOLUTION NO. 61-122 INITIATING PROCEEDINGS FOR THE ANNEXATION OF TERRITORY TO THE CITY OF SANTA ANA, DESIGNATING AN APPROPRIATE NAME OF "GRAND AVENUE WEST AND SANTA CLARA N.E. ANNEX" FOR SAID TERRITORY, AND GIVING NOTICE OF PROTEST HEARING TWRREON WHEREAS, at the request of property owners in the territory herein described, the description and map of said territory were presented to the Santa Ana Planning Con~mission and the Orange County Boundary Commission, and said Planning C~,~,ission approved annexation of said territory and said Boundary Commission caused a report to be prepared inferentially finding the proposed boundaries to be definite and certain. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby initiates proceedings for annexation of said territory herein described to the City of Santa Ana for the following reasons: 1.~ That said territory is presently in need of municipal services, particularly access to an adequate sewerage system, and in the City of Santa Ana said territory could be connected into the Santa Ana sewerage trunk lines without paying any cost for said lines. 2.) That the area can best be served by the City of Santa .Ana with municipal services of the highest quality anywhere obtainable at a lower cost than elsewhere obtainable. 3.) That it is to the mutual advantage of the land owners and the City of Santa Ana that said territory become a part of said City. BE IT FURTHER RESOLVED: That the City Council hereby declares its intention to annex all of the territory hereinbelow described under the provisions of the Annexation of Uninhabited Territory Act of 1939, and hereby finds and declares that said territory is unin- habited within the meaning of California Government Code Section -1- 35303 on the date.of the adoption of this Resolution; that Said territory is contiguous to the City of Santa Aha, lies in the County of Orange, State of California, and is described as:. Beginning at the intersection of the center line of Santa Clara Avenue with the Southerly prolongation of the East line of Lot 48 of the Santa Aha Grand Avenue Tract as shown on a map thereof recorded in Book 26, Page 53, Miscellaneous Records of Los Angeles County, California, said point of intersection being a point on the city boundary of the City of Santa Aha, as annexed by Ordinance Number 73, on August 20, 1888, and running thence West along said center line of Santa Clara and along said city boundary 385 feet more or less to the intersection of said center line of Santa Clara Avenue with the Southerly prolongation of the East line of that certain 80 foot wide strip of land acquired by the State of California and described in final order of condemnation recorded November 7, 1935, in Book 785, Page 382, of Official Records of Orange County, California; thence departing from said city boundary and running along the following three courses which are on the East line of said 80 foot wide strip conveyed to the State of California and its Southerly prolon- gation, North 0° 10' 15" West 18~53 feet to the beginning of a tangent curve concave Westerly, having a radius of 2040 feet; thence Northwesterl~ along the arc of said curve through a central angle of 12- 35' 29" an arc distance of 448.30 feet to a tangent line~ thence North 12° 45' 44" West 345 feet more or less to the intersection of said East line of 80 foot strip, with a line which is parallel with and 801.9 feet North, measured at right angles from said center line of Santa Clara Avenue; thence East along said parallel line 315 feet more or less to the West line of Lot 38 in said Santa Aha Grand Avenue Tract; thence North along the West line of said Lot 38 and the West line of Lots 36 and 34 of said Tract 312.38 feet more or less to the Northwest corner of said Lot 34; thence East along the North line of said Lot 34, 322.72 feet more Or less to the Northeast corner of said Lot 34 and to the West line of Grand Avenue, 80 feet wide, as shown on said Tract; thence South along the West line of said Grand Avenue 204.71 feet; thence South 8° 16' 34" West 919.35 feet more or less along said West line of Grand Avenue and its Southerly prolongation to the point of beginning. BE IT FURTHER RESOLVED: That "Grand Avenue West and Santa Clara N.E. Annex" is hereby designated as an appropriate name by which said territory shall be known for the purpose of this annexation. BE IT FURTHER RESOLVED: That notice is hereby given that July 3, 1961, at the hour of 7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, Santa Ana, california, is the time and place fixed at which said Council will hear protests against this annexation made by any person owning property within said territory. At any time before said hour any owner of property within said territory may file written protest against this proposed annexation. Such protest shall -2- state the name of the owner of the property affected and the descrip- tion and area of the property in general terms, all as provided for in Section 35312 of the Government Code of the State of California. PASSED AND ADOPTED by the City Council of the City of Santa A~a at its regular meeting held on the 15th day of May, 1961.
