was introduced, ~ead, considered and placed O~ file for second reading.
Communication was read from the Planning Commission recommending
approval of amendment appiication. No. 97, on behalf of Means and Ulrich
for reclassification of L~s i7, 18, 19, 20 and 21 from R-3 to M-l,
Lots 22, 23, 24 and 25 from R-3 to C-1 in Block 68 of Santa Aha East,
involving property on t~e west side of Poinsettia Street between
· Wellington and Vance Streets. Attorney Winthrop Gordon, representing
Means & Ulrich, stated that the owners of the property located on
Poinsettia Street between Vano, a~nd Wellington Stree~ had already agre
to place four lots nearest the hospital in a ,O-1 commercial zone rathe~i
than manufactur.ing, an.d that the Hospital was faced with a manufaoturi~
district on the east. Attorney Ronald Crookshank, representing the
Community Hospital stated that the Hospital had no objections to the
use of the property as proposed by Means & Ulrich but that a blanket
rezoning would allow' other manufacturing uses to purchase the property
and set up a considerable noise nuisance. On motion of Trustee
Jerome, seconded by Dahl and carried, the City Attorney was instructed
to prepare a Resolution dehying the recommendation of the Planning
Commission, setting forth the reasons for the denial, and recommendin~
to the Planning Oommission, that a variance be granted in lieu of a
zoning amendment.
C6~r~unication was read from Oranco GrOtto requesting use of the
Municipal Bowl for the purpose of staging a circus during the afternoon
and evening, at'some future date, .and making an appeal for a lower
rental and license fee in view of the fact that they will not use the
entire stadium. It was moved by Trustee Dahl, seconded by Jerome and
carried, that the rental charge for the Bowl be on the basis of the
usual percentage of admittance tickets sold and taken at the Bowl-.
Communication was read from'the Planning Commission advising that they
re-recommended approval of Tentative Map Tract 1734, of Nelson and
Oasserly, involving property located north of Fairview and between
Flower and Shelton Streets, and on motion of Trustee Jerome, seconded
by Dahl and carried, Tentative Map of Tract 1734 was approved.
On motion of T~ustee Dahl, seconded by Jerome and carried, Map Tract
No. 1521 and bond submitted by Santa Aha Estates, Inc., in the sum of
$63,0o0.00 were apProved and o~ficials authorized- to sign Map covering
improvements consisting of curbs, sidewalks, sanitary sewers, water
mains and street surfacing of Edinger, Lowell, Stanford, Pomona,
Berkeley, Occidental, Olive and Towner Streets.

Communication was read from the Planning Commission recommending
approval of Tentative Map of Tract No. 1754, subject to the approval

Copy of communication was read from the Civil Service Board addressed
to the Chief of Police regarding complaint receive(l with reference to
Clarence Johnson, Franklin Carter, D.G.Gross and H.H.Ety, members of
the Police Department, engaging in work outside of Civil SerVice which
is competitive and detrimental to the occupational and business
interests of local citizens and taxpayers. Communications were read
from George Novicoff, Market Director, Mayfair Markets, requesting that!i
Clarence Johnson be granted permission, during his off-duty hours, to
perform his duties as an officer in safeguarding the store against hold~
up, etc., and from the Chief of Police stating that formal request has
been made'by Clarence Johnson to enter into casual employment along
police duty 'lines with Mayfair Markets. Chief Hershey stated that
officers H.H.Ely and D.G.Gross are not working on their off-duty hours
and suggested that written permission be secured from the Civil Service~
Board to assign officers to various duties, on their off-duty hours,
such as public dances and for special events of various nature when
police protection is necessary, on motion of Trustee Dahl, seconded
by Jero~ and carried, the communications were received and filed.

Department attend. On motion of T~ustee McBride, seconded by Jerome
and carried, the communication was received and filed.
Communication was read from the City Attorney advising that Santa Aha
Municipal Code, Section 5309 (b) provides for a Hearing Board to take
action in event of-any violation of the provisions of the Chapter
regulating orchard heaters. It was moved by Trustee Dahl, seconded
by Jerome and carried, that the fees collected on violations by the
City be turned.over to the County to apply on supervision. On motion
of Trustee Dahl, seconded by Jerome and carried, the Chief of Police
was designated as the enforcing officer providing a complaint is
signed.
On motion of Trustee Jerome, seconded by Dahl and carried, the request
of Edward A. Miller, M.D. that a passenger loading zone be
at 309 West 8th Street was referred to the Administrator, City Engines
and Chief of Police for report at the next meeting.
Communication was read from Thomas P. Douglas, Director, Department
Social Welfare, reSerence article published in the local newspaper
on the subject "Beggars on the City Streets" and suggesting the read-
ing of County Ordinance No. 572 and using the trained staff of the
Welfare Department to investigate the individuals. On motion of
Trustee McBride, seconded by Jerome and carried, the communication
was referred to the City Attorney for study and report.
On motion of Trustee McBride, seconded by Jerome and carried, the
request of Cecil C. DeVote that street lights be installed over the
intersecting streets of Tract No. ~625, was referred to the City
Engineer.
On motion of Trustee Jerome, seconded by McBride and carried, the
claim of Rosa Liebermann for alleged injuries sustained when she fell
on the sidew&lk,

in the sum of $150.00, was referred to the City Attorney and Insuranc,

applications of Burl Chase, William L. Henderson, Jr., and Merle D.
Potter to drive taxicabs, were received and permits granted.

On motion of Trustee Dahl, seconded by Jerome and carried, the reques~
of The Blue Star Mothers of America,, Chapter No. 10, to sell Daisies
on Saturday, May 9, 1953, was granted.

Minutes of the Executive Committee of the Joint Outfall Sewer held at
Anaheim, January 8, 1953', were received and filed.

On motion of Trustee Dahl, seconded by McBride and Carried, the
report for 1952 of the Fire Department, report on audit of City Court
from July 1, 1952 to January 7, 1953, report on funds as qf December
31, 1952, submitted by the City Auditor; report of the Building
Department for January, 1953 and yearly report of Police Department
and for the month of January, 1953, were received and filed.

On motion of T~ustee Jerome, seconded by McBride and carried, the
demands as audited by She Finance Committee were approved and Clerk
authorized to issue warrants for same.

Communication wac read from the 20-30 Club of Santa Aha requesting
use of the Municipal Bowl to stage the annual Donkey Circus, to be
held sometime in June. On motion of Trustee Dahl, seconded by
McBride and carried, permission was granted and a minimum charge to
be made for use of the Bowl, as of the date of performance.

On motion of Trustee Dahl, seconded by McBride and carried, the
matter of the minimum rental for use of the Municipal Bowl was referrer
to the Administrator, Park Superintendent and Auditor for review and
recommendation at the next meeting.

Communication was read from L.B.Ward, 2406 North Baker Street, reques~
lng information as to when the City Pound will be moved to a more
suitable location, and on motion of Trustee McBride, seconded by Dahl
and carried, the communication was received and filed.

On motion of Trustee Dahl, seconded by Jerome and carried, the
Administrator was instructed to write a letter of explanation to
L.B.Ward, 2406 North Baker Street, advising him of the reasons for
the delay in moving the City Pound to a more suitable location.

On motion of Trustee Dahl, seconded by Jerome and carried, the Mayor
wac authorized to sign escrow instructions from Earl S. and Evelyn E.
Young, for the acceptance of an easement deed for street purposes, on
Halladay Street north of. Dyer Road.

Communication was read from Willis H. Warner, Coordinator Area X,
Region 9, extending an invitation to the Council and to Xey City
people in Civil Defense to hear Dr. John Beeston, Associate Professor
of Public Health, UCLA, at meeting to be held February 9th at the
Santa Ana High School, and on motion of Trustee Dahl, seconded by
Jerome and carried, the communication was received and filed.

Communication was read from the Pacific Telephone and Telegraph
Company advising that arrangements have been completed to turn over
to the City approximately 34,381 duct feet of their underground
conduit system which le to be used in connection with the new Fire
Alarm System, and on motion of Trustee Dahl, seconded by Jerome and
carried, the Clerk was instructed to write a letter of appreciation
to the Telephone Company for turning over the equipment to the City.

of Jerry Whitehead for permission to conduct a public dance on Sunday
February 22nd, 1953, at the American Legion Hall, was referred to the
Chief of Police.
On motion of Trustee Dahl, seconded by McBride and carried, the Mayor
was authorized to execute escrow instructions from Enrique and Leornor
Campos, for the purchase Of the entire parcel, being approximately
5.15 a0ree located on the south side of Delhi Road east of the Delhi

Oommunlcation was read from Richard Marshall, President, South Main
Improvement Association requesting that the Ordinance pertaining to
off-street parking for apartment houses should be more specifically
defined. On motion of Trustee McBride, seconded by Dahl and carried,
the matter was referred to the City Attorney, Planning Commission
and Building Inspector to prepare an amendment to the Municipal Code
with reference to automobile parking for apartment hou~es~

Administrator and City Engineer were authorized to present Resolution
No. 53-13 requesting the Orange County Flood Control District to
assume responsibility for the "West Ditch" of the Delhi Drainage
District, to the Board of Supervisors in conjunction with a similar
Resolution adopted by the Delhi Drainage District.

on behalf of Means and Ulrich, for reclassification of Lots 17, 18, 19,

Poinsettia StrCet between Wellington and Vance Streets, was read, con-

On recommendation of the City Engineer and on motion of T~ustee Jerome
seconded by McBride and carried, the request of Carlyle Dennis to clos
off driveway #C" on French Street and extend driveway "A" on Second
Street for ~8 feet, which addition will accommodate six customer's
cars 'off street parking', and also make available thirteen stalls on
the parking lot, was denied.
The Administrator reported on communication from Mrs. J.P.Sutherland,
Chairman, Sub-Committee on Annexation, stating that the citizens of
Costa Mesa are planning to incorporate the area and suggested that thei!

and communication from Mrs. Sutherland received and filed.
On motion of T~ustee Dahl, seconded by McBride and carried, the Clerk
was authorized to mall sample ballots to the registered voters for
the Municipal Electlon to be held ApriI 7, 1953.

On recommendation of the committee and on motion of Trustee Jerome,
seconded by McBride and carried, the basic bid of the American Rubber
Manufacturing Company was accepted for the furnishing of fire hose,
with the additional purchase cf 500 feet or ten lengths of 2~" hose,
at an approximate cost cf $2500.00, and all other bids rejected.
On motion cf Trustee Jerome, seconded by Dahl and earried, the City
Council adjourned.
