REVENUE SHARING AGREEMENT
THIS AGREEMENT made and entered into this g2iO day of
1974, by and between the CITY OF SANTA ANA,
a chartereo municipal corporation, hereinafter referred to as
"CITY" and the COUNTY OF ORANGE,�hereinafter referred to as
"COUNTY."
W i T N E S S E T H:
WHEREAS, CITY has a total population of 176,000 people of
which approximately 38,277 are over 50 years of age; and
WHEREAS, the CITY presently provides services and facilities
to the Santa Ana Senior Citizens Club;*and
WHEREAS, the present facilities provided by CITY do not meet
the needs of the elderly; and
WHEREAS, COUNTY, Under Resolution 73-11.56 has appropj:iateU a
portion of revenue sharing funds in the amount -of $490,000 for the
Santa Ana Senior Citizens Service Center for support of construction
and transportation services for senior citizens; and
WHEREAS, the City Council of the City of Santa Ana, pursuant t•o
its Resolution 73-54, has designated as one of its proposed uses for
County revenue sharing funds,'social impact programs for the elderly
poor; and
WHEREAS, CITY has requested COUNTY that revenue sharing funds be
provided to assist .in funding the Santa Ana Senior Citizens Service
Center; and
WHEREAS, this service center will provide to the elderly poor of
the CITY financial and health counseling, and recreational facilities.
NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE MUTUAL PROMISES,
COVENANTS AND CONDITIONS HEREINAFTER SET FORTH, THE,PARTIES HERETO
AGREE AS FOLLOWS:
I
The Senior Citizens Center shall be located on the northerly side
of Third Street between Ross and Birch Streets, as shown on tho map
which is attached hereto as Exhibit "A" and incorporated herein and
made a part hereof by this reference as though fully set forth.
II
The parties hereto agree that the cost of acquisition, development,
construction and operation of the Senior Citizens Service Center for
social services use regarding the project site described in paragraph
I above shall be divided between the CITY and the COUNTY and the CITY
shall pay Five Hundred Eighteen Thousand Four Hundred (SS18,400.00)
Dollars, and the COUNTY shall pay not more than Four Hundred Ninety
Thousand ($490,000) Dollars. COUNTY'S and CITY'S share of said cost
of acquisition, development, construction and operation is set forth
in the proposed bLidget for said Santa Ana Senior Citizens.Service
Center attached hereto as Exhibit "B" and incorporated herein and made
a part hereof by this reference as though fully set forth. CITY shall
be responsible for the costs of overhead, operation and maintenance;
such costs are not to be included in this joint funding agreement.
Monthly payments by the COUNTY, based on actual expenditures, shall be
made upon tender of invoices and proper documentation of accounting and
with the approval of the CO€1NTY'S Revenue Sharing Office.

The CITY'S source of funding for -its share of the project cost
shall be derived from its participation in, the Fedoral Revenue Sharing
Program.

IV
For purposes of this agreeme.nt all funds to be received under this
agreement shall be disbursed or incumbered on or before July 1, 1976.
V
CITY shall maintain proper accounting records and procedures and
ether evidence pertaining to costs incurred which records shall be kept
available at the CITY'S' office during the agreement period and thereafter
for three (3) years from the date of final payment of COUNTY revenue
sharing funds and shall make said records available to the COUNTY for
the purposes of auditing and that quarterly progress and disbursement
reports shall be supplied by the CITY to the COUNTY'S Revenue Sharing
Office for the period may 1974 to July 1976. Progress reports shall
show construction progress and number of people served by each portion
of the program.
VII
CITY agrees that overhead for the facility itself, planning not
including design service and all other development, shall not be included
under this joint funding agreement. The CITY acknowledges responsibility
for the design of the facility and agrees that plans and specifications
shall be approved,by the COUNTY prior to advertising for bids. COUNTY
agrees that design services shall be included under this joint .funding
agreement.

The CITY acknowledges that funds being provided by COUNTY are funds
received by the County of Orange pursuant to the state and local Fiscal
Assistance Act of 1972, public Law 92-512., and that expenditure of these
funds must be in accordance with said law and regulations issued by
agencies of the federal government. CITY further acknowledges that when
such funds are used on any construction project for which twenty five
percent (25 p) or more of the costs are paid out of revenue funds,

prevailing wages must be paid in accordance with the Davis —Bacon Act,
as amended, 40 U.S.C. 276(a) and'276(a) (7), and in compliance with
labor standards as specified by the Secretary of Labor. CITY further
agrees that any federal funds which are expended improperly by the
CITY shall be refunded to the COUNTY. CITY shall perform administration
and audit functions required by the Davis —Bacon Act.
No person shall, on the basis of race, color, national origin,
or sex, be excluded from participation in or be denied the benefits
of, or be subject to discrimination under, any program or activity
funded in whole or in part with funds made available under this
agreement.
IX
CITY agrees the facility to be provided under this contract must
be retained for social service njirposes, along with the level of
operation and maintenance adequate to insure the maximum utilization
of the facility by the public for social services purposes and that
the use of the property shall be granted to all residents of the County
on the same conditions that residents of CITY use the property and if
the facility ceases to be used for said, purposes by CITY, and such
cessation is not approved by the Board of Supervisors, CITY shall repay
to COUNTY the sum contributed by the C0UPJTY under this agreement.
X
CITY agrees that $90,000 shall be used exclusively for planning and
implementing services to assist in the transportation needs of Senior
Citizens to and from the Center.
IN WITNESS WHEREOF the parties hereto.have executed this Agreement -
this day and year first above written.
