AMENDMENT TO AGREEMENT �
THIS AMENDMENT, made and entered into this � -Z day of
1977, by and between the CITY OF SANTA ANA, a municipal
corporation, hereinafter referred to as "CITY," and the COUNTY OF ORANGE,
a political subdivision of the State of California, hereinafter referred
to as "COUNTY," to that certain Agreement made and entered into between
the parties hereto dated February 5, 1974.
WITNESSETH:
WHEREAS, the parties made and entered into that certain Agreement
dated February 5, 1974, concerning Prentice Park Zoo, and entered into
modifications to said Agreement dated August 5, 1975 and April 6, 1976;
and
WHEREAS, vandalism at Prentice Park Zoo has necessitated better
security and a change in construction plans; and
WHEREAS, the parties desire to amend the sections of said
Agreement pertaining to project scope and to completion date;
NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE MUTUAL PROMISES,
COVENANTS, AND CONDITIONS HEREINAFTER SET FORTH, THE PARTIES AGREE AS
FOLLOWS:
1. The second paragraph in the recital to the Agreement is
amended to read as follows:
"WHEREAS, the CITY has requested that one of these revenue
sharing and matching fund projects be the further development of Prenti
Park Zoo and that the funds shall be used for security lighting and
fencing for the Zoo."
2. Paragraph IV of the Agreement is amended to read as follows:
"For the purpose of this Agreement, Prentice Park Zoo shall
be completed no later than July 31, 1977, and all funds receiv d under

I this contract shall be disbursed or encumbered on or before that date."

2 3. Paragraph VI of the Agreement is amended to read as follows:
3j "CITY agrees that for development projects,planning and design
4lservices and all other development overhead shall not be included in this

5�joint funding agreement. The CITY acknowledges responsibility for the
i
6�design of development projects and agrees that plans and specifications
I
7Ishall be approved by the COUNTY prior to advertising for bids. CITY agree
8lthat the specific type of development projects funded by this agreement
9lshall involve security lighting and fencing for the Zoo."
10 4. In all other particulars, said Agreement of February 5, 1974,
11 as modified on August 5, 1975 and April 6, 1976, shall remain in full
12force and effect and is hereby confirmed and ratified in all particulars.
131 IN WITNESS WHEREOF, the parties hereto have executed this Amendment
