REUTER AND GRANTED BY THE PLANNING COMMISSION SUBJECT
TO CERTAIN CONDITIONS; BUT MODIFYING TWO CONDITIONS
IMPOSED BY THE PLANNING COMMISSION AND ADDING ONE
NEW CONDITION
WHEREAS, after hearing the Planning Commission granted
Variance Application No. 1527 filed by E. A. and Pauline R. Reuter
to permit the establishment of a new and used car retail sales plant
together with accessory garage repair activities on certain property
located at the Northeast corner of Fruit Street and Grand Avenue,
Santa Ana, California, in the R-3 District, subject to certain
conditions; and
WHEREAS, Appeal Application No. 36 was duly filed with the
City Council appealing the granting of the Variance by the Planning
Commission; and
WHEREAS, after a hearing before the City Council it has been
determined that said Variance should be granted subject to certain
conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana hereby denies Appeal Application No. 36 and approves
the granting of said Variance subject to conditions as follows:
That 55 off-street parking spaces be provided for
exclusive use as employee and customer parking in
accordance with ordinance requirements, and that
said parking spaces be shown in a revised plot plan.
That a street right of way of 45 feet, measured
Easterly from and at right angles to the center line
of Grand Avenue as recommended by the Department of
Public Works be incorporated in a revised plot plan.

That a 5 foot detailed landscaping plan along the
entire Grand Avenue and Fruit Street frontage,
except the driveways, be incorporated into a revised
plot plan, and that said landscaping shall be
installed and shall be maintained in an orderly and
well-groomed manner.

That an 18 inch Ornamental block or slump stone wall
be placed along Grand Avenue to the rear of the
landscaping except at driveway entrances.
That all signs conform to C-5 District requirements.
That all types and sizes of Buildings and structures
be detailed in a revised plot plan.
That all flood lights be reflected away from any
nearby residences.
That the painting, body work and heavy mechanical work
of the body shop be located adjacent to or as near as
possible to the North property line but no closer than
50 feet to the East property line.
That the buildings housing the paint shop, the body
shop and the heavy mechanical repair shop be so
constructed as to reduce all noises and fumes to a
minimum. The method to be used for said noise and fume
reduction shall be approved by the Director of Building
and Safety and the Planning Director.
That there be no storage of wrecked vehicles on the
premises.
That all parking areas, aisles and driveways be
concrete or asphalt and appropriately marked.
That the development be in accordance with the submitted
rendering.
That all of the above conditions be, where applicable,
incorporated into a revised plot plan and submitted to
the Planning Director for his approval.
That the owner dedicate to the City a street easement
for the full width of the property involved in this
Variance along Grand Avenue, a strip of land 45 feet
in width, measured East of and at right angles to the
center line of Grand Avenue. This easement is to
include a 25 foot proper~y line radius at the corner
of Grand Avenue and Fruit Street.
That the owner dedicate to the City of Santa Ana all
vehicular access rights to this property from Grand
Avenue. NOTE: Access can be determined and approved
prior to dedication.
That the owner place curb, gutter and sidewalk and pave
to the existing pavement on Grand Avenue. The new curb
and gutter shall be placed 37 feet East of the center
line of Grand Avenue. Said improvements shall be in
accordance with City standards.
That for the full width of the property bordering on
Fruit Street the owner place curb, gutter and sidewalk
and pave to the center line on said Fruit Street. The
new curb and gutter shall be placed 18 feet North of
and at right angles to the center line of Fruit Street.

That all engineering for the above improvements be
performed by the owner's engineer and submitted to
the Department of Public Works for approval.
19.
That all requested deeds be prepared by a competent
title company on a City deed form and submitted to
the Department of Public Works.
20.
That the owner's engineer submit a runoff study for
a storm of a ten (10) year frequency. This study is
to indicate flow quantities and method of handling
runoff.
21.
That the applicant and/or property owner enter into
an agreement with the City providing that said
Variance shall remain in effect so as to permit used
car sales, auto parts sales, paint and body repairs,
and mechanical repairs only so long as the new car
sales use is continued, and that said Variance is
granted primarily for the new car sales use. Said
agreement shall further provide that whensoever in the
future the new car sales use is terminated then said
Variance shall terminate and the ancillary uses, to-
wit: used car sales, paint and body shop and heavy
mechanical repairs, shall terminate in total within a
period of ninety (90) days from the time said Variance
is terminated. It is understood that the said ninety
(90) day period is allowed only as a period of grace
in which to terminate the said ancillary uses so as to
facilitate said termination with a minimum of
inconvenience.
22.
That all of the above conditions be complied with prior
to issuance of a utilities release by the Building
Department.
PASSED AND ADOPTED by the City Council of the City of Santa
