RESOLUTION NO. 61-192 WHEREIN A DEED FOR STREET
RIGHT OF WAY OVER THREE PARCELS OF REAL PROPERTY
WAS ACCEPTED, AND ACCEPTING A CORRECTED DEED FOR
SAME SAID THREE PARCELS.
WHEREAS, heretofore, the City of Santa Aha entered into Escrow
Number 390820-LFM at the Orange County Title Company for the purchase
of certain real property and deposited in said Escrow the agreed
purchase price; and
WHEREAS, ANTONE and ANNA A. BORCHARD presented to the City two
deeds dated June 19, 1961, one granting a parcel of real property
containing 24.50 acres, more or less; and the other conveying an ease-
ment for street purposes over three parcels of real property; and
WHEREAS, said deeds were duly accepted by the City by Resolu-
tion No. 61-192; and
WHEREAS, said deed dated June 19, 1961, conveying the easement
for street purposes contained a material error in description and was
defective; and
WHEREAS, ANTONE BORCHARD and ANNA A. BORCHARD have presented to
the City a corrected deed dated August 20, 1961, conveying an easement
for street purposes over the aforesaid three parcels of real property.
NOW, THEREFORE, BE IT RESOLVED: That that portion of Resolution
No. 61-192,wherein the defective deed dated June 19, 1961, conveying
the easement for street purposes over the said three parcels of real
property was accepted, is hereby rescinded.
BE IT FURTHER RESOLVE~: That the City accepts said deed from
ANTONE BORCHARD and ANNA A. BORCHARD dated August 20, 1961, and
authorizes H. H. Foreman to execute such acceptance on the face of
said deed as the officer of the City thereunto duly authorized.
