Good Afternoon Honorable Mayor and Council, We are reaching out to request clarity on whether the project in question is subject to City of Santa Ana's Community Workforce Agreement (CWA). Given the lowest bidder's proximity to the threshold, we believe it is not only appropriate but also responsible for City of Santa Ana to implement the CWA for this project. Additionally, could you confirm whether change orders are permitted on this project, and if so, whether there is a limit on the amount for these orders? Our concern is that the current bid will inevitably meet or surpass the City's criteria for triggering the CWA. We support the City's Community Workforce Agreement program because of the rigorous compliance standards it establishes. In our experience, contractors are far less likely to violate Public Works standards when there is additional oversight on a project. Joint Labor Management Committees, such as the Center for Contract Compliance, work closely with Public Agencies and their labor compliance programs, ensuring that projects are completed successfully, on time, and in full accordance with all regulatory requirements. This collaborative approach not only upholds the integrity of public works but also safeguards the interests of our communities. Implementing this agreement will ensure that the project aligns with the City's commitment to responsible contracting, local workforce development, and the broader economic benefits for our community. Excluding the CWA could lead to missed opportunities for promoting employment and ensuring project quality. We appreciate your attention to this matter and hope that the city will make the responsible decision of implementing the CWA for the "Santa Ana Wellness Plaza" project. Your city contracts with OC Animal Care (OCAC), which kept COVID restrictions well into 2023. They blocked your access to dog kennels. They finally ran a pilot program on visitor access in 2023. In fact, there were a few days within the last two months where only THREE Animal Care Attendants were working caring for HUNDREDS of dogs. Monica should be ashamed of her continuing failure to staff this position and also for lying about staffing levels at the shelter. Her failures negatively affect the ability to provide basic care for the dogs, handle adoption visits, and the myriad other duties performed by the ACAs. Let's clarify: volunteers are not staff and we are limited in the tasks we can perform (feeding is staff only, volunteers are not allowed to run big dog play groups, volunteers are not allowed to handle adoption visits with members of the public, and we have other restrictions on what we can do at the shelter). In addition, OC Animal Care is a unionized worksite. Is Monica saying she doesn't have to hire people because she can just count volunteers as staff? This suggestion is unacceptable, as the unions would undoubtedly agree. Further, we can wholeheartedly tell you there are nowhere CLOSE to 400 volunteers who participate on a regular basis to even consider as daily support. We suspect she is counting some people who never even touch an animal, such as those volunteers who come in just to help with laundry or one-time volunteers who show up for a few hours to volunteer at the monthly Pet Food Pantry and are never seen again. However, Monica has a penchant for making up numbers. The consultants that developed the Strategic Plan know full well that the shelter has volunteers. First, I wish to thank the City of Santa Ana for its recent support of our concerns and for holding ConAm Management accountable for its apparent failure to comply with its legal agreements regarding Metro East Senior Park. Your efforts are making a welcome, positive difference. However, there is still much that needs to be done. I believe ConAm is incompetent, dismissive and does not do what they promise unless forced to do so. During my leasing process, I was shown one apartment and told it was available. I agreed to lease it and the unit number was written on a lease form. However, when I came in later to sign the 76 page lease, I was shown another apartment and told there "aren't any others". In other words, take it or leave it! I had little option since I had given notice at my previous residence and I was in the process of moving. I signed it, although I didn't have time to read it and I had not been shown the lease prior to signing. I was also told that there was no on -site parking available. I had to park over a half mile away at another parking lot and pay an additional $150 per month for it. I later learned that the lease clearly states on page 60 under STANDARD PARKING POLICIES, THE FOLLOWING, 10. An assigned parking space is provided at no charge with the Leased Premises. Residents are not authorized to switch oi- trade parking spaces. Further, in an effort to offer practical suggestions regarding unsupervised dog urination inside and outside of the apartments, I was told that housekeeping does a diligent job and can't be everywhere at once. (now congressman) Lou Correa intervened, Santa Ana officials compromised with an "overlay zone" that allowed these businesses to continue operating, even as developers built housing projects around them. A fair solution, it echoed neighboring Anaheim's up -zoning of the light -industrial Platinum Triangle. I hate this term, but this was a "win -win." Time goes on and now Santa Ana is governed by officials who embrace the latest planning trends. The city unveiled its Renaissance Plan at the beginning of a subprime-mortgage crisis and bursting housing bubble. Since then, housing prices have soared and the entire state is struggling with housing shortages. Hence, lawmakers passed myriad laws encouraging and subsidizing multi -family housing construction. The state has also pressured cities (including Santa Ana) that fall short of state -mandated housing goals. Meanwhile in 2017, then -Gov. Jerry Brown signed Senate Bill 1000, which promotes "environmental justice" by, as the attorney general's office explains, "requiring local governments to identify environmental justice communities ... in their jurisdictions and address environmental justice in their general plans." Basically, cities must mitigate pollution in poorer neighborhoods. ob Adams, president of Adams Iron, Inc. in Santa Ana. Now Santa Ana is back with a plan that echoes the Renaissance Plan. The rationales have changed, but the policies remain the same. With little outreach to business owners, City Council this year approved a moratorium on the approval, expansion or modification of any industrial uses in the SD-84 Transit Zone. And the city is working to permanently rezone the area. I've talked to business owners in the area, who have had minor ministerial permits and business changes rejected by city officials because of the moratorium. Even if the city lets them operate for the foreseeable future, a permanent zone change will destroy the improved value of the land. (By the way, residents in the "protected" Logan and Lacy neighborhoods fear the moratorium will drive up rental prices.) These businesses invested heavily in the properties since 2007, including construction of new buildings. If they can't sell for ongoing industrial uses, any sale price will be reduced to the price of raw land. According to owners I interviewed, this means drops in value of 25 percent to 75 percent. And the city is making it tough for them to keep operating as is. In an August letter, an attorney for Adams Iron Co. argued the city is holding up permit approvals even though the ordinance "does not authorize the city to put on hold permits for existing industrial uses." Santa Ana is taking a "draconian position" that extinguishes the company's vested rights — in violation of constitutional prohibitions on "'taking' or `damaging' of private property without payment of just compensation." Owner Bob Adams, who I featured in a photograph accompanying that old column, told me the previous overlay zone was "a promise by the city (to allow) all industrial businesses to remain and operate in perpetuity. Now after 48 years of investing, creating jobs and building a future for myself, my family and our employees, we are threatened to be eliminated by the city's actions." I certainly understand why he is "mad as hell." Nearby residents have complained about noise and nuisance issues, but those concerns can be mitigated without shuttering businesses. Most properties are tidy commercial structures, many with attractive newer buildings. This isn't the Rust Belt. These businesses provide hundreds of jobs and bolster the tax base. In its "historic" moratorium, the city references SB 1000. The environmental justice concept is bizarre in this instance. Generally that term refers to — and often legitimately — harm imposed on poorer neighborhoods as polluting industries encroach. But these businesses have been here for decades. The city is encroaching on them by encouraging new housing. It reminds me of when residents complain about cows and tractors after they move into a new subdivision built on a farm field. The city is finally meeting with the owners, but it needs to come up with a plan that respects these businesses' property rights. In the urbanist world that city planners envision, there's no reason residents and businesses can't coexist. This is also a reminder that nice - sounding and well-intentioned "justice" legislation can lead to far-reaching injustices once local officials gain new powers.
