HomeMy WebLinkAbout61-270RESOLUTION NUMBER 61'270p£P~ITTING THE PACIFIC ELECTRIC RAILWAY TO LAY' ITS RAILROAD TRACK TO RUN ITS CARS ACROSS OLD TALBERT ROAD IN THE CITY OF SANTA ANA Ihe City Council of the City of Santa Aha does resolve as followss Section ls The right is hereby granted to the Pacific Electric Railway to lay its railroad track to run its cars across Old Talbert Road in the City of Santa Ana over the following described portion of Old Talbert Roads A strip of land seventeen (17) feet in width in the'right of way of Old /albert Road, the center line of which is described as followss Beginning at a point in the Northerly line of Talbert Road, in the City of Santa Ana~ County of Orange, State of California~ said point being Westerly thereon, measured along said Northerly line, 900.41 feet from the center line of Green- ville Street; thence along a 20° curve, concave to the Southwest, 87.75 feet to the Southerly line of said Talbert Road, said point being Westerly thereon, measured along said Southerly line, 828.54 feet from the center line.of said Greenville Street. S~ction 2~ The said right is granted upon condition that the said grantee or its successor or assigns shall do the following at their own expenses (a.) Replace all existing street improvements removed in constructing the original tracks in accordance with the $tandards of the Municipal Code. (b.) That culverts be provided in accordance with City Standards at both the North and 5outh flow lines along Old Talbert under the proposed railroad tracks. (c.) Install any of the following crossing protection devices at anytime the Public Utilities Commission of the State of California deems them necessary~ Automatic flashing lights and/or fixed signs. (d.) Install the necessary detection devices on the tracks including all necessary wiring to connect the spur track with the crossing protection electrical system to be provided when Fairy%aw Street is extended across the Pacific Electric R~ilway Costa Mesa Line tracks. (e.) Replace all improvements removed due to change in elevation or alignment of the tracks by the railroad. (f.) Provide for the following at such time as the street is altered by the changing of its elevation or alignment or increase of its width~ Raise, lower and/or alter any existing tracks as may be necessary, both inside and outside the limits of the crossing. e Prepare any existing tracks to receive pavement such as necessary replacement or installation of ties, rails and ballast, 3. Relocate any existing cross arms, automatic signals or other railroad equipment as may be necessary. (g.) Provide for the maintenance of plants or pavement within the track area. (NOTE~) Track area is the area between~the two rails of a track and two feet outside thereof) and between track areas if the distance between the center lines of adjacent tracks is less than fourteen feet. (h.) Provide for the maintenance of any protective devices installed for the crossing with the exception of advance warning signs and pavement markings. (i.) Prepare all drawings, maps and documents necessary for application to the Public Utilities Commission of the State in accordance with State law for the establishment of the crossing. Section 3t It is expressly understood that the City of Santa Aha in making the grant of this permit, expressly reserves the right to improve, alter or repair all of said street or any part thereof, and to lay sewers or pipes or conduits for water or other purposes therein; such work to be done by the City so as to obstruct or in~ure the tracks as little as possible. It is further understood that this permit is especially granted upon all and each of the possessions and conditions herein contained; and if the grantee or its assigns shall fail in any particular to comply therewith or with any of them, then in that case all rights to this permit shall be thereby forfeited and this grant be null and void and that nothing herein contained shall be construed in any manner as granting an exclusive franchise.
