ON APPEAL APPLICATION NO. 50 FILED BY EDWIN R.
WELLINGTON IV
WHEREAS, after hearing on notice, the Zoning Administrator
denied a Variance on Variance Application No. 1568, filed by EDWIN
R. WELLINGTON IV, which said Variance was requested to build a new
retail market building in the R-1 District; and
WHEREAS, Appeal Application No. 50 was duly filed with the
City Council appealing the denial of the Variance by the Zoning
Administrator; and
WHEREAS, after hearing before the City Council; after careful
consideration of the statements contained in and the materials
accompanying the application; the testimony offered at the hearing;
examination of all the facts established; and after determining that
the use applied for by the Variance Application meets the requirements
of Section 9250.8 of the Santa Ana Municipal Code, it has been
determined that the Variance should be granted, subject to certain
conditions.
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the
City of Santa Ana hereby grants Appeal Application No. 50 and grants
a Variance on Variance Application No. 1568 to permit the construction
of a new retail market at 1190 South Sullivan Street in the R-1
District, subject to conditions as follows:
1. That the owner dedicate to the City a property line
spandrel with a 25-foot radius at the corner of Sullivan
and McFadden Streets.
2. That the owner dedicate to the City of Santa Ana all
vehicular access rights from this property to McFadden
Street. NOTE: Access can be determined and approved
prior to dedication.

3. That the owner place curb, gutter and sidewalk and
pave to edge of existing pavement on Sullivan and
McFadden Streets. The new curb and gutter is to be
placed 20 feet East of the centerline on Sullivan
Street and 32 feet South of the Construction centerline
on McFadden Street. The curb return will have a 35-foot
radius.
4. That all engineering for the above improvements be done
by the owner's engineer and submitted to the Department
of Public Works for approval.
5. That all the required dedication be made prior to issu-
ance of building permit.
6. That a 6-foot high solid concrete block wall be constructed
for the full distance along the East and South boundaries
of the proposed parking lot.
7. That all other conditions be complied with prior to
issuance of a utilities release by the Building Department.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 18th day
