HomeMy WebLinkAbout60-107RESOLUTION NO. 6,0-11~,,, AUTHORIZING EXECUTION OF A GRANT DEED AND A QUITCLAIM DEED TO ORANGE COAST HARDWOOD AND LUMBER COMPANY AND RESCINDING RESOLUTION NO. 60-45 WHEREAS, the City owns a small parcel of real property and has an interest in an adjoining parcel of real property in total area approximating 1920 square feet, which is too small for use as a building site, and upon reconm%endation of the City Manager the Council now determines and declares that said property can have real value only to an adjacent owner and in the hands of any other owner could be used for extortion and a nuisance value; and ~REAS, an adjacent owner has made an offer for said property and agreement was reached on the transfer of same when a possible cloud on one of said parcels was discovered and the trans- fer has been renegotiated, and the Council has determined to sell the same under the provisions of Santa Aha Municipal Code Section 2613. NOW, THEREFORE, BE IT RESOLVED: That the Mayor and the C~erk of the Council are hereby directed to execute for and on be- half of the City of Santa Ana that certain Grant Deed and that certain Quitclaim Deed granting and quitclaiming to Orange Coast Hardwood and Lumber Company, a Corporation, those two parcels of real property in the County of Orange, State of California, respectively described as: That portion of the Southwest quarter of the Northwest quarter of Section 30, in Township 5 South, Range 9 West, San Bernardino Base and Meridian, in the City of Santa Ana, described as follows: Beginning at a point in the Northerly line of Dyer Road, distant 169 feet Easterly from the center line of Main Street; thence Northerly parallel to said center line of Main Street, 50 feet; thence Easterly parallel to the Northerly line of Dyer Road, 40 feet; thence Southerly parallel to the said center line of Main Street, 50 feet to the Northerly line of said Dyer R~ad; thence Westerly along said Northerly line of Dyer Road 40 feet to the point of beginning; EXCEPTING THEREFROM the West 20 feet of the East 36 feet thereof. and That portion of the Southwest quarter of the Northwest quarter of Section 30, in Township 5 South, Range 9 West, San Bernardino Base and Meridian, in the City of Santa Ana, described as follows: Beginning at a point in the Northerly line of Dyer Road, distant 140 feet Easterly from the Easterly line of Main Street (as said street existed in 1930, being at that time, 66 feet in width); thence Northerly and parallel to said Easterly line of Main Street, a distance of 50 feet; thence Easterly and ~arallel to the Northerly line of Dyer Road, a distance of 20 feet; thence Southerly and parallel to said Easterly line of Main Street, a distance of 5 feet to the Northerly line of Dyer Road; thence Westerly along said Northerly line of Dyer Road, a dis- tance of 20 feet to the point of beginning. and to execute Amended Escrow Instructions to Security Title Insurance Company, Escrow No. 44569-C whereunder the City is to be paid a total sum of $500.00 for said properties. BE IT FURTHER RESOLVED: rescinded. That Resolution No. 60-45 is hereby PASSED AND ADOPTED by the City Council of the City of Santa Aha at its regular meeting held on the 6%h day of Jmms , 1960.
