AUTHORIZING COhDE~NATION OF CERTAIN REAL PROPERTY
FOR THE PURPOSE OF WIDENING FIFTH STREET A~D
DECLARING THE NECESSITY THEREFOR
WHEREAS, FIFTH STREET as it now exists, East of the Santa Aha River, is
inadequate in width %o accomodate the flow of traffic presently using said
street;
NOW THEREFORE BE IT RESOLVED: that the City Council of the City of Santa Aha
does hereby find and determine that public interest and' necessity require that
Fifth Street be widened and improved on the North and South sides, and further
require that said City do have, take and acquire easements for street purposes
over, through and across certain lands in the City of Santa Aha, County of Orange,
State of California, described as:
PARCEL
The Southerly 12.00 feet of Lot 1, Tract Number 1091, as shown on a map
thereof recorded in Book 39, page 4, Miscellaneous Maps, Records of said
Orange County.
PARCEL lA.
An irregular shaped parcel of land bounded westerly by the westerly line
of the Rancho Santiago De Santa Aha, Julian Chares Allotment, City of
Santa Aha, County of Orange, State of California; bounded Southerly by
the center line of Fifth Street; bounded Easterly by the West line and
its Southerly prolongation of said Lot 1, of Tract Number 1091; bounded
Northerly by a line parallel with and 42.00 feet Northerly, measured at
right angles from the following described line:
Commencing at the Southeast corner of Section 10, Township 5 South,
Range 10 West, San Bernardino Base and Meridian, and running thence North
00° 06' 45" West 1243.69 feet along the center line of Sullivan Street to
the center line of Fifth Street and to the true point of beginning; thence
South 89° 28' 45" West along the center line of Fifth Street 332.45 feet to
the beginning of a tangent curve concave Northerly having a radius of 1200.00
feet; thence Northwesterly along the arc of said curve through a central
angle of 11e 38' 20" an arc distance of 243.76 feet to a tangent line; thence
North 78° 52' 55" West 85.00 feet, more or less, to maid west line of The
Rancho Santiago De Santa Aha. Excepting that portion previously granted for
Street purposes.
pARCEL lB.
A strip of land bounded Northwesterly by said West line of The Rancho Santiago
De Santa Aha; bounded Southerly by the center line of Fifth Street; bounded
Northerly by a line parallel with and 491.34 feet Northerly, measured along
the West line and its Southerly prolongation of said Lot 1 of Tract Number
1091, from the center line of Fifth Street; bounded Southeasterly by a line
parallel with and 32.00 feet Southeasterly, measured at right angles, from
said West line of the Rancho Santiago De Santa Aha. Excepting that portion
previously granted for Street purposes.
PARCEL lC.
A spandrel shaped parcel of land bounded Southerly by the Northerly line of
Parcel lA, bounded Northwesterly by the Southeasterly line of Parcel lB,
bounded Northeasterly by the arc of a curve concave Northeasterly, having a
radius of 25.00 feet and tangent to said Southerly and Northwesterly
boundaries.
PARCEL 2.
The South 12.00 feet of Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12 and 13
in Block "C" of Tract Number 633, in the City of Santa Aha, County of Orange,
State of California, as per map recorded in Book 19, Page 13 of Miscellaneous
Maps, in the Office of the County Recorder of said County.
PARCEL 3.
Beginning at the point of intersection of the center line of Fifth Street and
the center line of Sullivan Street; thence South along the center line of
Sullivan Street 42.00 feet; thence East along a straight line, parallel with
said center line of Fifth Street 544.14 feet; thence North 42.00 feet to a
point in said center line of Fifth Street; thence West 544.14 feet, more or
less to the point of beginning. Excepting those portions previously granted
for street purposes.
PARCEL 3A.
A spandrel shaped parcel of land bounded on the North by the South line of
Parcel 3; bounded on the West by the East line of Sullivan Street; 60.00
feet wide and bounded Southeasterly by the arc of a curve concave Southeasterly,
having a radius of 25.00 feet, and tangent to said North and West boundaries.
PARCEL 4.
Beginning at the point of intersection of the center lines of Fifth Street and
King Street (said King Street being 50.00 feet wide and bearing North 27° 30'
East) as shown on a map thereof recorded in Book 2, Page 9, Records of Surveys,
Records of Orange County, California and running thence Northeasterly along said
center line of King Street 235.63 feet; thence Northwesterly 100.00 feet,
measured at right angles to said center line of King street, to a line which is
parallel with and distant 100.00 feet Northwesterly from said center line of
King Street; thence Southwesterly along said parallel line 255.43 feet to said
center line of Fifth Street; thence Southeasterly along said center line of
Fifth Street 101.94 feet to the point of beginning. Excepting those portions
previously granted for street purposes.
PARCEL 5.
An irregular shaped parcel of land bounded Easterly by the West line of Parcel 4;
bounded Southerly by the North line of that certain 20.00 foot easement for road
purposes granted to the County of Orange, State of California by a Deed recorded
September 27, 1955 in Book 3225 Page 175, Official Records of said Orange County
and bounded Northerly by a line parallel with and 42.00 feet Northerly measured

Commencing at the Southeast corner of Section 10, Township 5 South, Range
10 West, San Bernardino Base and Meridian and running thence North 00° 06e 45"

Fifth Street and to the true point of beginning; thence South 89° 28' 45" West
along the center line of Fifth Street 332.45 feet to the beginning of a tangent
curve concave Northerly having a radius of 1200.00 feet; thence Northwesterly
along the arc of said curve through a central angle of i1° 38' 20" an arc
distance of 243.76 feet to a tangent line; thence North 78° 52' 55" West 216.04
feet to the beginning of a tangent curve concave Southerly having a radius of
1200.00 feet; thence Westerly along the arc of said curve through a central

or less, to the West line of that certain territory designated as "Bernstein
Fifth Street Annex" annexed to the City of Santa Ann by Ordinance Number NS-213
dated October 1, 1956.

A strip of land bounded Easterly by the East line of that certain territory
designated as "Bernstein Fifth Street Annex" annexed to the City of Santa Aha
by Ordinance Number NS-213 dated October 1, 1956; bounded Westerly by the
West line of said "Bernstein Fifth Street Annex"; bounded Northerly by the
North line of said "Bernstein Fifth Street Annex" and bounded Southerly by a
line parallel with and 42.00 feet Southerly~ measured at right angles from
the following described line~

A strip of land bounded Westerly by the East line of parcel 6; bounded
Northerly by the North line of that certain territory designated as "Fifth
at King Annex" annexed to the City of Santa Aha by Ordinance Number NS-92
dated April 4~ 1955; bounded Easterly by a line which bears South 23° 23'
West and runs through a point on the center line of Fifth Street; said
point being South 73° 33e 15" East 85.65 feet from a bolt marking the
Westerly end of the first course described in the Deed to the County of
Orange, Recorded June 5, 1931, in Book 232, page 327 of Deeds; bounded
Southerly by a line parallel with and 42.00 feet Southerly, measured at
right angles from the following described lines
Commencing at the Southeast corner of Section 10~ Township 5 South~

BE IT FURTHER RESO~VEDt That the City Attorney is hereby ordered and
directed to bring an action in the name of said City in the Superior Court
of the State of California in and for the County of Orange to condemn said
property necessary to be taken, as herein ordered and described, and to do
all things necessary to prosecute said action to final determination.
B~ IT FURTHER RESOLVED: That the public interest, necessity and
convenience require and it is hereby ordered that the City of Santa A~a, a
Municipal Corporation, Plaintiff in the condemnation action ordered herein,
take immediate possession and use of the property herein ordered to be
acquired upon complying with the requirements of the law applicable thereto,
that the City Attorney report to the Director of Finance the amount of
money required thereof, and that the Director of Finance shall deposit said
amount with the Clerk of the Court.
BE IT FURTHER RESOLV~D~ That the said action for condemnation of said
property so to be acquired shall be taken in accordance with the provisions
of the Code of Civil Procedure and Constitution of the State of California
relating to eminent domain.
PASSED AhO ADOPTED by the City. Council of the City of Santa Aha at its
regular meeting held on the~%h day of J1~18 1960.
