Approve an appropriation adjustment reappropriating $596,328 in Fiscal Year 2017- 18 Highway Safety Improvement Program grant funds into the Federal Aid Safety Program, Federal Grant -Indirect revenue account, and appropriate the same amount into the Public Services Street Safety Projects, Improvements Other Than Building expenditure account. (Requires five affirmative votes) 2. Approve an appropriation adjustment recognizing $119,400 in Fiscal Year 2022-23 Highway Safety Improvement Program grant funds into the Federal Aid Safety Program, Federal Grant -Indirect revenue account, and appropriate the same amount into the Public Services Street Safety Projects, Improvements Other Than Building expenditure account. (Requires five affirmative votes) 3. Approve an amendment to the Fiscal Year 2022-23 Capital Improvement Program to include $213,959 in General Fund monies from Public Works Traffic /Transportation - Service Enhancements funding and an additional $119,400 in Highway Safety Improvement Program grant funds into the project's construction funds for the Traffic Signal Modifications Project for a total of $333,359. 4. Award a construction contract to International Line Builders, Inc., the second lowest responsible bidder, in accordance with the base bid in the amount of $734,930, for construction of the 1 st Street at Jackson Street and 5th Street at Euclid Street Traffic Signal Modification Project, for the term beginning August 16, 2022, and ending upon project completion, subject to non -substantive changes approved by the City Manager and City Attorney. Approve the Project Cost Analysis for a total estimated construction delivery cost of $929,687, which includes $734,930 for the construction contract; $121,264 for contract administration, inspection and testing; and a $73,493 project contingency for unanticipated or unforeseen work to be funded from Highway Safety Improvement Program grant funds. DISCUSSION The recommended actions are needed to proceed with the modification of two existing traffic signals which add left -turn arrow indications at the intersections of 1st Street at Jackson Street and 5th Street at Euclid Street (Exhibits 1 and 2). Once completed, these traffic signal improvements will increase safety for motorists and pedestrians at this intersection. The Public Works Agency was awarded a $726,128 Highway Safety Improvement Program (HSIP) grant for this project, which was recognized in the City Council -approved Fiscal Year 2017-18 Capital Improvement Program (CIP). A total of $129,800 was earmarked for Preliminary Engineering. The spending authorization for the remaining $596,328 in construction funding was received in April 2021. Staff is requesting City Council approval to recognize and re -appropriate this grant allocation for expenditure in Fiscal Year 2022-23. In June 2022, an additional $119,400 in HSIP grant funds was authorized, bringing the total HSIP grant funds available for the project to $715,728. The additional $119,400 in HSIP grant funds received has been allocated from additional available funds within the HSIP grant program administered by the State. Staff is requesting City Council approval to recognize and appropriate the additional grant allocation of $119,400 in construction phase grant funding for expenditure in Fiscal Year 2022-23. Upon approval of the requested appropriation adjustments and the existing project funds, the total funds available for construction will be $929,687, which is composed of $715,728 in grant funding and $213,959 in General Fund monies were budgeted and appropriated as part of the FY 2022-23 City budget in the Public Works Traffic /Transportation -Service Enhancements expenditure account. The proposed Capital Improvement Program amendment allows for these signalized intersection traffic safety enhancements to add the additional grant funds of $119,400 and local funds of $213,959 for construction in the capital improvements program (Exhibit 3). Public Outreach and Contractor Participation To provide an opportunity for local vendors to submit bids, a Notice Inviting Bids was advertised in the Orange County Register newspaper on October 26 and November 2, 2021. The project was also advertised on PlanetBids on October 26, 2021, and bids were received electronically via PlanetBids on November 16, 2021. The City notified a total of 355 regional vendors via PlanetBids and 26 vendors requested bidding documents. Traffic Signal Modification Project August 16, 2022 Page 3 Bid Results Summ A total of six bids were received, with the lowest bid deemed not responsive and all other bids being deemed responsive. La Puente $806,716 International Line Builders, Inc. submitted the second lowest responsive base bid in the amount of $734,930 (Exhibit 4). Based on the bid analysis and a contractor's reference check, staff recommends awarding the construction contract to International Line Builders, Inc., in the amount bid (Exhibit 5). International Line Builders, Inc. has performed quality work on several projects in the last five years, including replacing traffic signal heads and complete signal pole replacements. Staff is confident that this contractor will continue to perform and produce quality work for the City. Project Delivery To deliver a complete project, in addition to the construction contract, the estimated total project delivery cost includes construction administration, inspection, and testing, along with an allowance for contingencies to account for unexpected or unforeseen conditions. Construction administration and inspection include the following: construction management; implementation of the City's Community Workforce Agreement; inspection of the Contractor's work to ensure contract compliance, workmanship, and quality; and material testing. As indicated in the Cost Analysis (Exhibit 6) and as summarized in the table below, the estimated total construction delivery cost of the project is $929,687. Categorical Exemption Environmental Review No. ER- 2018-9 was filed for this project. FISCAL IMPACT Approval of the requested appropriation adjustments will provide $715,728 in HSIP grant funding for this project through the following transactions: • Reappropriate $596,328 in Fiscal Year 2017-18 Highway Safety Improvement Program grant funds into the Federal Aid Safety Program, Federal Grant -Indirect revenue account (No. 14717002-52001), and appropriate the same amount into the Public Services Street Safety Projects, Improvements Other Than Building expenditure account (No. 14717002-66220). • Recognize $119,400 in Fiscal Year 2022-23 Highway Safety Improvement Program grant funds into the Federal Aid Safety Program, Federal Grant -Indirect revenue account (No. 14717002-52001), and appropriate the same amount into the Public Services Street Safety Projects, Improvements Other Than Building expenditure account (No. 14717002-66220) All funds will be available for expenditure in Fiscal Year 2022-23. However, any remaining balances not expended at the end of the fiscal year will be carried forward into FY 2023- 24. This Contract shall not become effective until such bonds are supplied to and approved by the CITY. 8. CONTRACTOR shall, prior to the release of the performance and payment bonds or the retention payment, furnish a warranty performance and payment bond (Warranty Bond). Said Warranty Bond shall also be required as a condition of project acceptance. To the fullest extent allowed by law, CONTRACTOR and its Subcontractors hereby agree to defend, indemnify, and hold harmless CITY, its City Council, boards and commissions, officers, agents, employees, representatives and volunteers (hereinafter collectively referred to as "Indemnitees"), through legal counsel acceptable to CITY, from and against any liability, claims, actions, costs, damages or losses, including reasonable costs and attorney's fees, for injury, including death to any person or damage to any property, arising directly or indirectly from, or in any manner relating to, any of the following: (i) Performance or nonperformance of the Work of Improvement by CONTRACTOR or its Subcontractors of any lower tier; (ii) Performance or nonperformance by CONTRACTOR or its Subcontractors of any lower tier, of any of the obligations under the Contract Documents; Page 2 of 3 (iii) The construction activities of CONTRACTOR or its Subcontractors of any lower tier, either on the project site or on other properties; (iv) The payment or nonpayment by CONTRACTOR of any of its Subcontractors of any lower tier, for Work of Improvement performed on or off the project site; and (v) Any personal injury, property damage or economic loss to third persons related to and arising from the performance or nonperformance by CONTRACTOR or its Subcontractors of any lower tier, of the Work of Improvement. (vi) The indemnity obligations of Subcontractors provided by this Section shall be included in all subcontract documents issued by CONTRACTOR. Nothing in the Contract Documents shall be construed to give rise to any implied right of indemnity in favor of CONTRACTOR against CITY or any other Indemnitee.
