Public Works Agency www.santa-ana.org/pw Item # 17 City of Santa Ana 20 Civic Center Plaza, Santa Ana, CA 92701 Staff Report January 21, 2025 TOPIC: Rousselle Street Flood Protection Project AGENDA TITLE Approve an Appropriation Adjustment and Award a Construction Contract to Mike Bubalo Construction Co., Inc. for the Rousselle Street Flood Protection Project (Project No. 23-6627) (Non -General Fund) RECOMMENDED ACTION Approve an appropriation adjustment to recognize $831,000 in prior year fund balance in the Federal Clean Water Protection Fund, Prior Year Carryforward revenue account (No. 05717002-50001) and appropriate the same amount into the Federal Clean Water Protection Enterprise, Improvements Other Than Building expenditure account (No. 05717640-66220). (Requires five affirmative votes.) 2. Approve an amendment to the Fiscal Year 2024-25 Capital Improvement Program to add $831,000 of Federal Clean Water Protection Enterprise funding for the Rousselle Street Flood Protection Project (No. 23-6627). 3. Approve the Project Cost Analysis for a total estimated construction delivery cost of $5,139,259, which includes $4,113,259 for the construction contract, $615,000 for contract administration, inspection, and testing, and $411,000 project contingency for unanticipated unforeseen work. 4. Award a construction contract to Mike Bubalo Construction Co., Inc., the lowest responsible bidder, in the amount of $4,113,259, for construction of the Rousselle Street Flood Protection Project, for a term beginning January 21, 2025 and ending upon project completion, and authorize the City Manager to execute the contract. 5. Determine that, pursuant to the California Environmental Quality Act, the recommended actions are exempt from further review. Categorical Exemption Environmental Review No. ER-2024-57 was filed with the Orange County Clerk - Recorder for the project. Rousselle Street Flood Protection Project January 21, 2025 Page 2 GOVERNMENT CODE §84308 APPLIES: No DISCUSSION The City experiences significant flooding of roadways during intense rain events, which can have negative impacts on vehicle and pedestrian travel, business operations, and can cause property damage. The City's 2018 Storm Drain Master Plan recommended numerous stormdrain system improvements citywide in order to facilitate storm flows and reduce flooding. The Public Works Agency has successfully sought grant opportunities to fund such projects and was awarded $4,675,000 from the Prop 68 Floodplain, Management, Protection, and Risk Awareness (FMPRA) grant program for the Rousselle Street Flood Protection Project. This project features the upgrade of existing stormdrain infrastructure along Rousselle Street, from Warner Avenue to St. Gertrude Place, which will connect to the newly constructed stormdrain on Warner Avenue (Exhibit 1). The project also includes new drought -tolerant landscaping along the Maple Bike Trail, interpretive signage, asphalt paving, new curb -ramps, new curbs and gutters, striping, and stormwater treatment devices. The goal of the project is to increase the capacity of the City's stormdrain system in the Delhi Channel Watershed to better facilitate storm flows. Public Outreach and Contractor Participation This project was originally advertised for bid on October 22, 2024, with bids due on November 12, 2024. To provide an opportunity for local vendors to submit bids, the City notified 2,615 regional vendors via PlanetBids, many of which are Santa Ana based. Ten vendors requested bidding documents, and a total of ten bids were received. Bids were not received from any Santa Ana contractors. As legally required, a Notice Inviting Bids was advertised in the Orange County Register newspaper on October 23, 2024 and October 30, 2024. The project was also advertised in PlanetBids from October 22, 2024 through November 12, 2024. Bids were received electronically via PlanetBids on November 12, 2024. Mike Bubalo Construction Co., Inc. submitted the lowest responsive base bid in the amount of $4,058,259 (Exhibit 2). As specified in the bid documents, the lowest bid shall be determined by the Base Bid. A Bid Alternative item was also included in the project specifications for additional drought tolerant landscaping along the Maple Bike Trail (Exhibit 3). In the past five years, Mike Bubalo Construction Co., Inc. has not performed any work for the Public Works Agency. Based on the bid analysis and a contractor reference check, staff recommends awarding the construction contract to Mike Bubalo Construction Co., Inc., for the construction of the Rousselle Street Flood Protection Project (Exhibit 4). Proiect Delive To deliver a complete project, in addition to the construction contract, the estimated total project delivery cost includes a budget allocation for construction administration, inspection, and testing. Construction administration and inspection may be performed by either staff or consultants and includes construction management, inspection of the Contractor's work to ensure contract compliance, workmanship and quality, materials testing, and implementation of the labor requirements. Any of the allocated construction administration funds not spent are considered project savings and are returned to the respective fund balance upon close out of the project. As indicated in the Cost Analysis (Exhibit 5) and as summarized in the table below, the estimated total construction delivery cost of the project is $5,139,259. The project continues these parameters of the CEQA guidelines and Categorical Exemption Environmental Review No. ER-2024-57 was filed with the Orange County Clerk -Recorder for the project (Exhibit 6). FISCAL IMPACT As indicated in the Cost Analysis, the estimated total construction delivery cost of the project is $5,139,259. All funds are available for expenditure in Fiscal Year 2024-2025. Any remaining balances not expended at the end of the fiscal year will be carried forward into Fiscal Year 2025-2026. The proposed contract authorizes staff a maximum of 10% in contingencies for construction contract change orders. Staff will return to City Council for authorization and appropriation of additional contingency if necessary. With approval of the requested appropriation adjustment, a portion of the accumulated fund balance will be appropriated for spending in the Federal Clean Water Protection Enterprise, Improvements Other Than Building (No. 05717640-66220). The spendable portion of the fund balance is estimated to be $6,957,265 at June 30, 2025, which is sufficient to allow for the recommended appropriation of $831,000. The funds will be budgeted and available for this item in the accounts below. CITY agrees to pay and CONTRACTOR agrees to accept in full payment to complete the WORK OF IMPROVEMENT the sum total amount not to exceed Four Million One Hundred Thirteen Thousand Two Hundred Fifty -Nine Dollars and No Cents ($4,113,259.00), as set forth and identified in the BID PROPOSAL, which is attached hereto and incorporated herein as Exhibit "A", and in accordance with Section 2-7.1 of the Greenbook: Standard Specifications for Public Works Construction. CONTRACTOR agrees to complete the WORK OF IMPROVEMENT within the time specified in the Time for Completion of Improvements section of the BID PROPOSAL (Exhibit "A") including commencing construction within the timeframe therein specified after issuance of a Notice to Proceed. 5. The CONTRACTOR will pay, and will require all subcontractors to pay, all employees on the WORK OF IMPROVEMENT a salary or wage at least equal to the prevailing salary or wage established for such work as set forth in the wage determinations for this work in accordance with applicable State and Federal law. 6. If applicable, the CONTRACTOR shall adhere to the CITY'S Community Workforce Agreement (CWA), a pre -hire collective bargaining agreement, which establishes the labor relations policies and procedures for CONTRACTOR to follow in the crafts persons employed to complete the WORK OF IMPROVEMENT as more fully described in the CWA. CONTRACTOR shall, after award of this Contract, furnish two bonds to be approved by the CITY, one in the amount of One Hundred Percent (100%) of the Contract price, to guarantee the faithful performance of the work (Performance Bond), and one in the amount of One Hundred Percent (100%) of the Contract price to guarantee payment of all claims for labor and materials furnished (Payment Bond). This Contract shall not become effective until such bonds are supplied to and approved by the CITY. 8. CONTRACTOR shall, prior to the release of the performance and payment bonds or the retention payment, furnish a warranty performance and payment bond (Warranty Bond). Said Warranty Bond shall also be required as a condition of project acceptance. For projects up to Five Hundred Thousand Dollars ($500,000), the Warranty Bond amount shall be the greater of Ten Thousand Dollars ($10,000) or Twenty Percent (20%) of the final contract price. For projects above Five Hundred Thousand Dollars ($500,000), the Warranty Bond amount shall be the greater of One Hundred Thousand Dollars ($100,000) or Ten Percent (10%) of the final contract price. 9. CONTRACTOR shall, after award of this Contract, furnish Certificates of Liability Insurance and Worker's Compensation Insurance as outlined in the General Provisions, to be approved by the CITY. 10. INDEMNIFICATION. To the fullest extent allowed by law, CONTRACTOR and its Subcontractors hereby agree to defend, indemnify, and hold harmless CITY, its City Council, boards and commissions, officers, agents, employees, representatives and volunteers (hereinafter collectively referred to as "Indemnitees"), through legal counsel acceptable to CITY, from and against any liability, claims, actions, costs, damages or losses, including reasonable costs and attorney's fees, for injury, including death to any person or damage to any property, arising directly or indirectly from, or in any manner relating to, any of the following: (i) Performance or nonperformance of the Work of Improvement by CONTRACTOR or its Subcontractors of any lower tier; (ii) Performance or nonperformance by CONTRACTOR or its Subcontractors of any lower tier, of any of the obligations under the Contract Documents; Page 2 of 4 (iii) The construction activities of CONTRACTOR or its Subcontractors of any lower tier, either on the project site or on other properties; (iv) The payment or nonpayment by CONTRACTOR of any of its Subcontractors of any lower tier, for Work of Improvement performed on or off the project site; and (v) Any personal injury, property damage or economic loss to third persons related to and arising from the performance or nonperformance by CONTRACTOR or its Subcontractors of any lower tier, of the Work of Improvement. (vi) The indemnity obligations of Subcontractors provided by this Section shall be included in all subcontract documents issued by CONTRACTOR.
