RESOLUTION NO. 60-255 APPROVING MAP AND DECLARING
INTENTION TO VACATE PORTIONS OF McFADDEN AVENUE
WEST OF FAIRVIEW STREET
WHEREAS, it appears that McFadden Avenue should be
realigned between Sullivan Street and the Santa Ana River Channel,
and after engineering studies and agreements on exchange of rights
of way, the Public Works Department has recommended that portions
of McFadden Avenue right of way be vacated where the same lies
outside of the new street alignment.
NOW, THEREFORE, BE IT RESOLVED: That the City Council
hereby adopts the map attached hereto and orders that the same
be filed with the original of this Resolution in the office of the
Clerk of the Council and reference is hereby made to said map for
particulars and exact location and extent of the rights of way
proposed to be vacated. The City Council hereby declares its in-
tention to vacate for street purposes those portions of ~4cFadden
Avenue in the City of Santa Aha, County of Orange, State of Call-
fornia, described as:
PARCEL 1:
A strip of land 84 feet in width, the center line of
which is described as follows:
Commencing at the common corner of Section 14, 15, 22
and 23, in Township 5 South, Range t0 West, San Bernardino
Base and Meridian and running thence North 0° 47' 20"
West along the East line of said Section 15, said East
line being the center line of Sullivan Street, 1322.68 feet
to the true point of beginning; thence South 89° 22' 28"
West 1679.21 feet to the beginning of a tangent curve
concave Northerly having a radius of 1000.00 feet; thence
Westerly along the arc of said curve through a central
angle of 27° 30' 00" 479.97 feet to a tangent line; thence
North 63° 7' 32" West along said tangent line to the
Easterly right of way line of the former Newbert Protection
District right of way for the channel of the Santa Ana
River. Said 84 foot wide strip of land being bounded
Westerly by said Easterly right of way line of the former
Newbert Protection District. Said 84 foot wide strip of
land being bounded Easterly by a line which is 42 feet
Southerly measured at right angles and parallel with the
following described line: commencing at the common corner
of Section 14, 15, 22 and 23, in said Township and Range,
and running thence North 0° 47' 20" West along the East
line of said Section 15, 1322.68 feet; thence South

89° 22' 28" West 1~79.21 feet to the beginning of a
tangent curve concave Northerly having a radius of
1000 feet; thence Westerly along the arc of said curve
through a central angle of 44° 04' 26" an arc distance
of 769.23 feet to a tangent line; thence North 46: 33'
06" West along said tangent line to said Easterly right
of way line of the former Newbert Protection District.
PARCEL 2:
A strip of land two feet in width bounded Northerly by a
line which is 42 feet Northerly measured at right angles
and parallel with the following described line:
Commencing at the common corner of Sections 14, 15, 22
and 23, in Township 5 South, Range 10 West, San Bernardino
Base and Meridian and running thence North 00° 47' 20"
West along the East line of said Section 15, said East
line being the center line of Sullivan Street, 1322.68
feet to the true point of beginning; thence South 89° 22'
28" West 1679.21 feet to the beginning of a tangent
curve concave Northerly having a radius of 1000.00 feet;
thence Westerly along the arc of said curve through a
central angle of 27° 30' 00" an arc distance of 479.97
feet to a tangent line; thence North 63° 07' 32" West
along said tangent line to the Easterly right of way line
of the former Newbert Protection District right of way
for the channel of the Santa Ana River. Bounded Southerly
by a line which is 40 feet Northerly measured at right
angles and parallel with the following described line:
commencing at the common corner of Sections 14, 15, 22 and
23, in said Township and Range, and running thence North
00° 47' 20" West along the East line of said Section 15,
a distance of 1322.68 feet; thence South 89° 22' 28" West
1679.21 feet to the beginning of a tangent curve concave
Northerly having a radius of 1000.00 feet; thence Westerly
along the arc of said curve through a central angle of
44° 04' 28" an arc distance of~9.23 feet to a tangent line;
thence North 45° 33' 05" West along said tangent line to
said Easterly right of way line of the former Newbert
Protection District. Bounded Easterly b~ the West line of
Kellogg Street as sho%rn on a map of a re-plat of Santa Ana
Acres recorded in Book 5, Page 8, Miscellaneous Maps,
Records of Orange County, California.
PARCEL 3:
Commencing at the intersection of the center line of
Fairview Avenue with the center line of Kellogg Street as
shown on a map of a re-plat of Santa Ana Acres recorded
in Book 5, Page 8, Miscellaneous Maps, Records of Orange
County, California, and running thence North 00° 47' 20"
West along said center line of Kellogg Street 54.00 feet;
thence South 89° 22' 28" West 30.00 feet to the true
point of beginning, said true point of beginning being a
point on the West line of Kellogg Street; thence North
89° 22' 28" East 2.03 feet to the beginning of a tangent
curve concave Northwesterly having a radius of 25.00
feet; thence Easterly and Northerly along the arc of
said curve through a central angle of 90~ 09' 48" an arc
distance of 39.34 feet to a tangent line; thence South
00° 47' 20" East 2.00 feet to the beginning of a tangent
curve concave Northwesterly having a radius of 25.00 feet;

thence Southerly and Westerly along the arc of said
curve through a central angle of 90° 09' 48" an arc
distance of 39.34 feet to a tangent line; thence South
89° 22' 28" West 2.03 feet; thence Worth 00° 47' 20"
West 2.00 feet to the true point of beginning.
BE IT FURTHER RESOLVED: '~hat JanuarF 3, 1961, at the
hour of 7:30 P.~4. in the Council Chambers, City Hall, Third and
Main Streets, Santa Ana, California, is hereby fixed as the time
and place for hearing all persons interested in or objecting to
said proposed street vacation.
The City Council declares its intention to proceed with
this street vacation under the provisions of the Street Vacation
Act of 1941 (Sections 8300 through 8374 of the California Streets
and Highways Code).
'l~ne Clerk of the Council is ordered to publish this Resolution
in the manner prescribed by law for the publicat'ion of Ordinances
of the City, and the Director of Public Works is ordered to post
notices of street vacation conspicuously along the line of said
street, stating the passage of this Resolution of Intention to Vacate
and the time and place of hearing thereof. Said notices shall be
posted not more than 300 feet apart and at least three shall be so
posted. Both publication and posting shall be completed at least
10 days before the date of said hearing.
