INTENTION TO VACATE A PORTION OF NORTH GA~SEY
STREET, SOUTH OF SEVENTEENTH STREET
~E~EAS, SALE~A F. TUCKER, J~4ES B. TUCi~R, ~--~., and
BARBARA TUC~ER LASHBROOK have petitioned the City Council to
vacate that portion of North Garnsey Street located South of
Seventeenth Street; and
WHEREAS, SALENA F. TUCKER, J~.dES B. TUCKER, JR., and
BARBAi~A TUCKER LASHBROOK are the owners of all of the property
adjoining said Street to the East and South, and it is understood
that said owners hold an option to purchase the property adjoining
the street to the West, and state that they will be the owners of
said property prior to the c~upletion of the abandorm'~ent proceedings;
and
?~HER~AS, after study, the City Council has dete~ined that
the street is unnecessary for present and future pmrposeS and that
it serves no purpose as dedicated.
~!OW, THEREFORE, BE IT RESOLVED: 'l~lat the City Council hereby
adopts ~he map attached hereto and orders that the same be filed
with the original of this Resolution in the office of the Cler]~ of
the Council and reference is hereby made to said map for particulars
and exact location and extent of the right-of-way proposed to be
vacated.
The Cit~ Council hereby declares its intention to vacate for
street purposes that portion of North Garnsey Street in the City of
Santa Ana, County of Orange, State of California, described as:
Beginning at a point on the South line of Seventeenth
Street as widened to $0 feet by final decree of condemnation
rendered January tl, 1932, in Case No. 27242 in the Superior
Court of California in and for the County of Orange, Which
point is South 0° 1t' 47" West 40 feet from a point in the
North line of Section 12, Township 5 South, Range 10 West,
S. B. B. & ~., 250.55 feet East of the intersection of said
North line with the center line of Flower Street as shown
on a map of Tract No. 74~. recorded in Book 30, Page 9 of
iliscellaneous ~4aps, records of Orange County; thence South

0° 11' 47~' West, 120.00 feet; thence East parallel to the
South line of said Seventeenth Street 53.00 feet; thence
~orth 0° 11' 47'~ East, 120.00 feet to a point in the South
line of said Seventeenth Street; thence West along said
line 53.00 feet to the point of beginning; excep%ing the
North 10 feet thereof.
BE IT FURTHER RESOLVED: ~hat Jan~16~ , 1961, at
the hour of 7:30 P.~4. in the Council Chambers, City Hall, %~ird and
Hain Streets, Santa Aha, California, is hereby fixed as the time
and place for hearing all persons interested in or objecting to
said proposed street vacation.
The City Council declares its intention to proceed with
this street vacation under the provisions of the Street Vacation
Act of 1941 (Sections ~300 through ~3374 of the California Streets
and Highways Code).
:l~he Clerk of the Council is ordered to p~Dlish this Resolution
in the manner prescribed by law for the publication of Ordinances
of the City, and the Director of Public Works is ordered to post
notices of street vacation conspicuously along the line of said
street, stating the passage of this Resolution of Intention to Vacate
and the time and place of hearing thereof. Said notices shall be
posted not more than 300 feet apart and at least three shall be so
posted. Both publication and posting shall be completed at least
10 days before the date of said hearing.
