HomeMy WebLinkAbout66-045RESOLUTION 66-45 OF TH~ CITY OF SANTA ANA OFFERING TO PURCHASE THREE PARCELS OF TAX DEEDED PROPERTY ASS'T WHEREAS, the Tax Collector of Orange County, California, is about to sell three certain parcels of real property within the City of Santa Ana, a municipal corporation, which said real property is needed by the City of Santa Ana for street purposes; and WHEREAS, the City of Santa Ana is a taxing agency, the taxes of which City are collected by the County of Orange through the offices of the County Tax Collector, and unpaid taxes resulting in the tax sales of the properties herein specifically referred to have resulted in part from taxes levied by said City on said specific parcels of real property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: That said City objects to the proposed sales of said specific parcels of real property for the reason that each parcel is needed by the City of Santa Ana for street purposes and should not be sold to private ownership; that a sale to private ownership would require said City to proceed by an action in eminent domain to acquire said property for public street purposes. BE IT FURTHER RESOLVED: That the Mayor and the Clerk of the Council are hereby authorized and directed to execute the Agreement on behalf of the City; a copy of said Agreement between the City and the Board of Supervisors of the county of Orange for purchase of said three parcels of real property by the City is attached hereto and incorporated herein by reference. BE IT FURT}LER RESOLVED: That the City agrees to pay the price shown on Exhibit A of said Agreement and set opposite the description of the parcel of real property in each case, and, in addition, to pay the cost of giving notice of said Agreement as provided for in Section 3800 of the California Revenue and Taxation Code. That as provided in Section 3800 of the Revenue and~Taxation Code, the cost of giving the notice of this Agreement shall be paid by the City of Santa Aha; 2. That the Board of Supervisors of the County of Orange agrees to sell to the City of Santa Ana all or any portion of the property described in Exhibit "A", attached hereto and made a part hereof, which shall not have been redeemed as provided in the Revenue and Taxation Code, upon payment by said City to the tax collector of said County the sum set forth in said Exhibit after the description of the property and designated "PURCHASE PRICE", within ten (10) days after this Agreement ~comes effective. 3. That as provided by Section 3808 of the Revenue and Taxation Code, the City will pay the "purchase price" to the County tax -1- collector and the City will not share in the distribution of the payment.
