DEED TO OWNERS OF RECORD
WHEREAS, heretofore, the owners of property on the north side
of Warner Avenue, east of Hathaway Street, granted to the City an
easement for a water main and sewer pipe line over a portion of said
land, which easement is excess and of no further value to the City
because of change in the development plans of said property and
should be quitclaimed to the owners of record.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and the Clerk
of the Council are hereby authorized and directed to execute a deed
quitclaiming in severalty to THE VARIOUS OWNERS OF THE UNDERLYING FEE
AS THEIR RESPECTIVE INTERESTS MAY APPEAR OF RECORD the City's interest
in and to that certain property lying on the north side of Warner
Avenue, east of Hathaway Street, in the City of Santa Ana, County of
Orange, State of California, described as:
An easement 26.00 feet in width for water main and sewer pipe line
over that portion of the land allotted to F. W. Koll in Decree of
Partition of the Rancho Santiago de Santa Ana recorded in Book B
of Judgments of the Seventeenth Judicial District Court of
California, in the city of Santa Ana, County of Orange, State of
California, said easement lying 10.00 feet West and 16.00 feet
East of the following described line:
Beginning at a point in the center line of Warner Avenue, said
point being located 746.55 feet West from the intersection of said
center line with the center line of Grand Avenue running thence
North 520.00 feet along a line parallel with the said center line
of Grand Avenue to the end of the easement hereby granted.
EXCEPTING therefrom the South 52.00 feet included in Warner Avenue.
This deed is given for the purpose of quitclaiming all right, title
and interest of the grantor herein in and to all rights of way,
easements and rights acquired in that certain deed recorded in
Book 6458, page 24, Official Records of said County.
Passed and Adopted by the City Council of the City of Santa
Ana at its regular meeting held on the 20th day of June, 1966.
