HomeMy WebLinkAbout66-106RESOLUTION 66-106 ADDING CONDITIONS TO CONDITIONAL USE PERMIT GRANTED BY THE PLANNING COMMISSION ON APPLICATION FOR CONDITIONAL USE pERMIT NO. 66-7 FILED BY MARTIN ROSTON WHEREAS, after public hearing on notice the Planning Commission granted a Conditional Use Permit on Application No. 66-7 filed by MARTIN ROSTON to permit the establishment and operation of a nursery school in an R-1 District at 1143 'Memory Lane, Santa Ana, California, subject to certain conditions; and WHEREAS, Appeal Application No. 179 was filed by R. L. SUBRIAR appealing the decision of the Planning Commission to grant said Conditional Use Permit to establish and operate said nursery school with less than the required parking area and requesting the matter be presented ~ the City Council; and WHEREAS, the City Council, after public hearing on notice, has determined that said Conditional Use Permit should be granted subject to the conditions hereinbelow set out. NOW, THEREFORE, BE IT RESOLVED: That the decision of the Planning Commission to grant a Conditional Use Permit on Application No. 66-7 to permit the establishment of a nursery school in an R-1 District at 1143 Memory Lane, Santa Ana, California, is hereby upheld, but that the following conditions shall apply in the granting of said Conditional Use Permit: That the applicant submit a revised plot plan showing the building addition on the easterly side of the lot. Said plan to be approved by the Planning Department, and development be according to plan. That there be not more than 30 children and that one paved and marked off-street parking space be provided for each 10 children. (To City standards) 3. That the proposed paving match the existing paving. That a 6-foot high solid block wall be constructed along the east property line; said wall shall be reduced to 4 feet within the required front yard. 5. That garage be widened to minimum of 18 feet or parking spaces be otherwise provided. 6. That the hours of operation be limited to those hours between 9 A.M. and 3 P.M. 7. Approval will be made subject to compliance with Title 19. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE ISSUANCE OF A N3ILDING PERMIT: That an easement be provided for Memory Lane for a width of 50 feet, center line to property line, for street purposes and vehicular access rights, except at approved drives. NOTE: Access can be determined and approved prior to dedication. 9. That the subdivider submit street improvement plans for Memory Lane. 10. That all elevations be on 1958 Orange County Survey Datum. -1- 11. That all plans and surveys for the required improvements be completed by the owner's engineer and submitted to the Depart- ment of Public Works for approval. THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO ISSUANCE OF UTILITIES RELEASE BY THE DEPARTMENT OF BUILDING SAFETY AND HOUSING: 12. That the owner provide sanitary sewer facilities to meet with the approval of the Department of Public Works. 13. That the owner place curb, gutter and sidewalk and pave up to the edge of existing pavement on Memory Lane. The new curb and gutter to be placed 42 feet north of the center of Memory Lane.
