HomeMy WebLinkAbout66-119RESOLUTION 66-119 AUTHORIZING CONDEMNATION OF EASEMENTS FOR STREET PURPOSES FOR THE WIDENING OF EIGHTH STREET FROM FAIRVIEW STREET TO 560 FEET WEST OF BRISTOL STREET WHEREAS, the rapid expansion of the Civic Center area of the City of Santa Ana and the continuing increase in east-west traffic volume has made it necessary to widen Eighth Street to provide for the present and prospective demands of said increasing traffic; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby find and determine that the public interest and necessity require that Eighth Street be widened on the north and south sides from Fairview Street to a point 560 feet west of Bristol Street and does require that said City do have and acquire easementf for street purposes in, over, through, and across certain real property in the City of Santa Ana, County of Orange, State of California, said easements being described as follows: ~ARCEL 1: An easement for street purposes over the Northerly 15.00 feet of the Southerly 40.00 feet of the West 55.00 feet of the East 355.00 feet of the South 200.00 feet of the following: Beginning at an iron pin 517.20 feet West of old corner stake, an iron pin in the center of Eighth Street (formerly Hickey Street) and Hawley Street; thence North 850.26 feet to iron pin; thence West 277.00 feet to iron pin at grant line in the center of King Street; thence South 27½° West 948.30 feet to iron pin in the center of Eighth Street (formerly Hickey Street); thence 711.80 feet to the point of beginning. ~..ARCEL 2: An easement for street purposes over the Northerly 15.00 feet of the Southerly 40.00 feet of the West 76.00 feet of the East 180.00 feet of the South 200.00 feet of that portion of the land allotted to Jacob Ross in decree of partition of the Rancho Santiago de Santa Ana, recorded in Book A of Judgments of the 17th Judicial District Court of Los Angeles County, California, described as follows: Beginning at an iron pin 517.20 feet West of the old corner stake and iron pin at the center line intersection of Eighth Street (formerly Hickey Street) and Hawley Street; thence North 850.26 feet to an iron pin; thence West 277.00 feet to an iron pin on the grant line and center line of King Street; thence South 27° 30' 00" West 948.03 feet to an iron pin at its intersection with the said center line of Eighth Street; thence East 711.08 feet to the point of beginning. PARCEL 3: An Easement for street purposes over the North 15.00 feet of the South 40.00 feet of the West 52.00 feet of the East 104.00 feet of the South 200.00 feet of that portion of land allotted to Jacob Ross in decree of partition of the Rancho Santiago de Santa Ana, recorded in Book B of Judgmentsjof the 17th Judicial District Court of Los Angeles County, California, described as follows: Beginning at an iron pin 517.20 feet W~st of an old corner sta~e and iron pin in the center of Eighth Street (formerly Hickey Street) and Hawley Street; thence North 850.26 feet to an iron pin; thence West 277.00 feet to an iron pin on the Grant line in the center of King Street; thence South 27° 13' West 948.30 feet to an iron pin in the center line of Eighth Street (formerly Hickey Street); thence East 717.15 feet to the point of beginning. -1- PARCEL 4: PARCEL 5: PARCEL 6: An easement for street purposes over the Southerly 15.00 feet of that portion of the land allotted to Jacob Ross in decree of partition of the Rancho Santiago de Santa Ana, recorded in Book B of Judgments of the 17th Judicial District Court of Los Angeles County, California, described as follows: Beginning at a point in the center line of Hickey Street (now known as Eighth Street) said point being located 458.60 feet South 89° 52' 00" West from the center line intersection of Hawley Street and said Hickey Street; thence South 89° 52' 00" West 58.60 feet along the center line of said Hickey Street; thence North 0° 33' 00" East 150.00 feet along a line parallel with the center line of said Hawley Street; thence North 89° 52' 00" East 58.60 feet along a line parallel with the center line of said Hickey Street; thence South 0° 33' 00" West 150.00 feet along a line parallel with the said center line of Hawley Street to the point of beginning. Excepting therefrom that portion included in Hickey Street. An easement for street purposes over the Southerly 40.00 feet of the East half of that portion of the Jacob Ross Allottment in the Rancho Santiago de Santa Ana, described as follows: Beginning at a point in the Westerly extension of the center line of Hickey Street (now known as Eighth Street), 220.00 feet West of the intersection of the center lines of Hickey and Hawley Streets; thence North parallel to the center line of Hawley Street, 150.00 feet; thence West parallel with the extended center line of Hickey Street, 180.00 feet; thence South parallel with Hawley Street, 150.00 feet to the extended center line of Hickey Street, thence East 180.00 feet to the point of beginning. EXCEPTING THEREFROM the Easterly 90.00 feet thereof. ALSO EXCEPTING THEREFROM the interest in the South 25.00 feet of said land which was reserved for street purposes, by John Thomas English and wife, in deed recorded April 28, 1925 in Book 574, page 349, Deeds. ALSO EXCEPTING from said 40.00 feet, any portion previously dedicated for street purposes. An easement for street purposes over the Southerly 40.00 feet of the West half of that portion of the Jacob Ross Allottment in the Rancho Santiago de Santa Ana, described as follows: Beginning at a point in the Westerly extension of the center line of Hickey Street (now known as Eighth Street) 220.00 feet West of the intersection of the center lines of Hlckey Street and Hawley Street; thence North parallel to the center line of Hawley Street, 150.00 feet; thence West parallel with the extended center line of Hickey Street, 180.00 feet; thence South parallel with Hawley Street, 150.00 feet to the extended center line of Hickey Street; thence East 180.00 feet to the point of beginning. EXCEPTING THEREFROM the Easterly 90.00 feet thereof. An easement for street purposes over the Northerly 10.00 feet of Lot 10 of Tract NO. 1744, as shown on a map recorded in Book 56, page 17, of Miscellaneous Maps, records of Orange County, California. An easement for street purposes over the Northerly 10.00 feet of Lot 9 of Tract No. 1744 as shown on the map recorded in Book 56, page 17, of Miscellaneous Maps, records of Orange County, California. An easement for street purposes over the Southerly 18.00 feet of the Northerly 38.00 feet of the West 50.00 feet of that portion of the Julian Chavez Allottment of the Rancho Santiago de Santa Aha, described as follows: Beginning at a point in the center line of West Eighth Street, distant thereon 301-2/3 feet West of the center line of English Street, said point being the southwest corner of a certain parcel of land conveyed to James Lucas by deed dated March 5, 1941 and recorded in Book 1080, page 497, of Official Records; thence westerly along the center line of West Eighth Street, 200-1/3 feet, more or less, to a point which is distant thereon 220 feet Easterly from the center line of Hawley Street; thence Southerly, parallel with said center line of Hawley Street, 362.00 feet to the most Southerly line of the land conveyed to L. L. Beeman and wife, by deed dated February 28, 1935, and recorded in Book 733, page 498, Official Records; thence Easterly along said Southerly line 200-1/3 feet to the Southwest corner of the parcel of land conveyed to James Lucas by deed mentioned above; thence Northerly along the Westerly line of said land conveyed to Lucas 362.00 feet to the point of beginning. Included within the following described strip of land 80.00 feet in width, the center line of said strip being described as follows: Beginning at the intersection of the center line of Eighth Street, 55.00 feet in width, with the center lane of Raitt Street, 60.00 feet in width, thence South 89° 52' 00" West along said center line of Eighth Street 78.40 feet; thence Northwesterly to a point in a line parallel with and distant 30.00 feet Easterly measured along said center line of Eighth Street from the Northerly prolongation of the center line of Daisey Avenue, 50.00 feet in width, said point being distant Northerly along said parallel line 10.00 feet from said center line of Eighth Street; thence South 89° 52' 00" West parallel with said center line of Eighth Street to the beginning of a tangent curve concave Southerly having a radius of 1,500.00 feet, said beginning of said tangent curve being distant South 89° 52' 00" West measured along said parallel line 94.56 feet from the intersection with the Northerly prolongation of the center line of Townsend Street, 50.00 feet in width; thence Westerly along said tangent curve through a central angle of 4° 40" 43" an arc distance of 122.49 feet to the beginning of a tangent reverse curve concave Northerly having a radius of 15.00 feet; thence Westerly along said tangent curve through a central a~gle of 4° 39' 58" an arc distance of 122.16 feet to a point in the center line of Eighth Street distant South 89° 52' 00" West 30.00 feet measured along said center line from the intersection of said center line of Eighth Street with the center line of English Street 60.00 feet in width. An easement for street purposes over a spandrel shaped parcel of land bounded Northerly by the North line of Lot 45 Of Tract No. 1318 as shown on a map recorded in Book 40, page 24, of Miscellaneous Maps, records of Orange County, California, bounded Westerly by the West line of said Lot 45 and bounded Southeasterly by the arc of a curve concave Southeasterly having a radius of 25 feet and tangent to said Northerly and Westerly boundaries. An easement for street purposes over a spandrel shaped par- cel of Land bounded Northerly by the North line of Lot 10 of Tract No. 2162, as shown on a map recorded in Book 65, page 38 of Miscellaneous Maps, records of Orange County, California bounded Easterly by the Easterly line of said Lot 10 and bounded Southwesterly by the arc of a curve concave Southwesterly, having a radius of 25 feet and tangent to said Northerly and Easterly boundaries. An easement for street purposes over that portion of Lot 59 of Fairlawn Park Tract, as shown on a map recorded in Book 4, Page 46, of Miscellaneous Maps, records of Orange County, California, described as follows: -4- PARCEL 18. PARCEL 19: PARCEL 20: PARCEL 21: Parcel 1. The Northerly 15.00 feet of said Lot 59. Parcel 2. A spandrel shaped parcel of land bounded on the North by the South line of Parcel 1, bounded on the East by the East line of said Lot 59 and bounded Southwesterly by the arc of a curve concave Southwesterly, having a radius of 25.00 feet and tangent to said North and East boundaries. An easement for street purposes over the Southerly 10 feet of Lot 24 of Tract 572, as shown on a map recorded in Book 18, at page 27, of Miscellaneous Maps, records of Orange County, California. An easement for street purposes over those portions of Lots 41 and 42 of Chandler's Addition to Santa Ana, as shown on a map recorded in Book 4, page 37, of Miscellaneous Maps, records of Orange County, California, described as follows: Parcel 1. The Northerly 15.00 feet of said Lots 41 and 42. Parcel 2. A spandrel shaped parcel of land hounded on the North by the Southerly line of Parcel 1, bounded on the West by the West line of said Lot 42, and bounded South- easterly by the arc of a curve concave Southeasterly, having a radius of 25.00 feet and tangent to said North and West boundaries. An easement for street purposes over the North 15.00 feet of the following described land: Lot 6 in Block "A" of Horace J. Pullen's Fifth Street Tract, as shown on a map thereof recorded in Book 4, Page 81 of Miscellaneous Maps, records of said Orange County, together with the North one-half of the alley adjoining said land on the South, as abandoned by Resolution No. 3788 of the City Council of the City of Santa Ana, a certified copy of said Resolution was recorded June 10, 1949, in Book 1857, Page 20 of Official Records. An easement for street purposes over that portion of the land allotted to Julian Chavez as described in the Final Decree of Partition of the Rancho Santiago de Santa Aha, which was entered September 12, 1868 in Book "B", page 410 of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California, described as follows: Parcel 1. Beginning at the intersection of the center line of Eighth Street (formerly Hickey Street) with the Easterly line of Raitt Street (formerly Artesia Street); thence Easterly along said center line of Eighth Street 300.00 feet to the intersection with the Northerly prolongation of the Easterly line of the land described in deed to the SantaAna Elementary School District recorded January 10, 1929 in Book 228, page 211 Official Records; thence Southerly along said prolongation 40.00 feet; thence westerly, parallel with said center line to Eighth Street, 300.00 feet to a point in -5- said Easterly line of Raitt Street, said point being distant Southerly along said Easterly line 40.00 feet from the point of beginning; thence northerly along said Easterly line 40.00 feet to the point of beginning. EXCEPTING THEREFROM that portion previously dedicated for street purposes. Parcel 2. A spandrel shaped parcel of land bounded Northerly by the Southerly line of Parcel 1 above described; bounded Westerly by said Easterly line of Raitt Street, and bounded Southeasterly by the arc of a curve concave Southeasterly having a radius of 25.00 feet and lying tangent to its Northerly and Westerly boundaries. BE IT FURTHER RESOLVED: That the City Attorney is hereby ordered to bring an action in the name of the City of Santa Aha to condemn said property necessary to be taken and to do all things necessary to prosecute said action to final determination; That the City of Santa Ana, a municipal corporation, is authorized and empowered to provide for the opening, extension, widening, construction, and maintenance of public streets and highways within the City; That said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury; That the public interest, necessity, and convenience require, and it is hereby ordered, that said City take immediate possession and use of the property herein ordered to be acquired upon compliance with the requirements of law applicable thereto as rights of way for public street; That said action in condemnation shall be taken in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain. at its ATTEST: CLERK OF THE COUNCIL PASSED AND ADOPTED by the ~ity Council of the City of Santa Ana regular meeting held on the 15th day of August, 1966. t mYO?' / STATE OF CALIFORNIA) COUNTY OF ORANGE ) CITY OF SANTA ANA ) SS I, DORIS M.
