INTENTION TO VACATE CERTAIN RIGHT OF WAY
ON THE SOUTH SIDE OF AVALON AVENUE, EAST OF
HATHAWAY STREET, RESERVING AN EASEMENT
TI-~REIN FOR PUBLIC UTILITIES, AND GIVING
NOTICE OF HEARING THEREON
WHEREAS, a request for the vacation of certain right of way on the South
side of Avalon Avenue, East of Hathaway Street, herein described, has been
received by the City Council, and the Department of Public Works and the Planning
Commission have recommended that a public hearing be set on the question of
said vacation;
NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby
approves the map attached hereto and orders the same filed with the original of
this Resolution in the office of the Clerk of the Council, and reference is hereby
made to said map for the exterior boundaries of said right of way proposed to be
vacated.
The City Council declares its intention to proceed under the provisions
of the Street Vacation Act of 1941 (Sections 8500 through 8374 of the California
Streets and Highways Code) to vacate that certain right of way, 30 feet in width,
on the south side of Avalon Avenue, east of Hathaway Street and RESERVING
THEREIN an easement for utility structures for the Pacific Telephone Company
and the Southern California Edison Company. Said right of way proposed to be
vacated lies in the City of Santa Ana, County of Orange, State of California
and is described as:
Beginning at the Southwest corner of Lot i of Tract 4528 as
shown on a map thereof, recorded in Book 162, pages 3 and
4, Miscellaneous Maps, records of Orange County, California
thence North 0° 09' 19" West 119.80 feet along the West line
of said Lot 1 to the beginning of a tangent curve concave
Southeasterly and having a radius of 15.00 feet; thence
Northeasterly along said curve through a central angle of
90° 08~ 40TM an arc distance of 23.60 feet to a tangent line;
thence South 89° 59' 20" West 45.11 feet along said tangent
line to the Northeast corner of Lot 57 of Tract 5910 as shown
on a map thereof, recorded in Book 217, pages 49 and 50,
Miscellaneous Maps, records of Orange County, California;
thence South 0° 09' 19" East and along the East line of said
Lot 57 and its Southernly prolongation a distance of 134.83
feet; thence South 89O 58' 59" East 30.00 feet to the point
of beginning.
RESERVING an easement and right of way to construct, lay, install,
use, maintain, alter, add to, repair, replace, inspect and/or
remove, at any time and from time to time, aerial and underground
electric lines and communication lines, consisting of poles, guys,
and markers and other fixtures and appliances, for conveying
electric energy to be used for light, heat, power, telephone and/or
other related uses, in, on, over, under and through that certain
real property in the City of Santa Ana, County of Orange, State of
California, described as follows:
The Southerly 6.00 feet and the Westerly 6.00 feet of the above
described property.
BE IT FURTHER RESOLVED: That these proceedings are taken subject
to the reservations and exceptions next hereinabove set out.
BE IT FURTHER RESOLVED: That October 3rd, 1966, at the hour of
7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets, Santa
Ana, California, is hereby fixed as the time and place for hearing all persons
interested in or objecting to said proposed street vacation.
The Clerk of the Council is hereby ordered to publish this Resolution
once in The Register, and the Director of Public Works is ordered to post notices
of street vacation conspicuously along the line of said street, stating the passage
of this Resolution of Intention to Vacate and the time and place of hearing thereon.
Said notices shall be posted not more than 300 feet apart and at least three (3)
such notices shall be posted. Both publication and posting shall be completed
at least ten (10) days before the date of hearing.
PASSED AND ADOPTED by the City Council of the City of Santa Ana at its
regular meeting held on the 6th day of Sept-,~her 19 66
