CERTAIN RIGHT OF WAY ON THE SOUTH SIDE OF AVALON
AVENUE, EAST OF HATHAWAY STREET, RESERVING AN
EASEMENT THEREIN FOR PUBLIC UTILITIES
WHEREAS, on September 6, 1966, the City Council adopted
Resolution 66-126 declaring intention to vacate certain right of
way on the south side of Avalon Avenue, east of Hathaway Street,
herein described, and to reserve therein public utility easement;
and
WHEREAS, on October 3rd, 1966, public hearing was duly held
on said street vacation on posted notices and the publication of
said Resolution 66-126.
NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby
finds that that certain right of way on the south side of Avalon
Avenue, east of Hathaway Street, is unnecessary for present or
prospective street purposes and does hereby make its order abandoning
and vacating for street purposes and does hereby make its order
abandoning and vacating for street purposes that certain right of way
in the City of Santa Aha, County of Orange, State of California,
described as:
Beginning at the Southwest corner of Lot 1 of Tract 4528 as
shown on a map thereof, recorded in Book 162, pages 3 and 4,
Miscellaneous Maps, records of Orange County, California; thence
North 0° 09' 19" West 119.80 feet along the West line of said
Lot 1 to the beginning of a tangent curve concave Southeasterly
and having a radius of 15.00 feet; thence Northeasterly along
said curve through a central angle of 90° 08' 40" an arc distance
of 23.60 feet to a tangent line; thence South 89~ 59' 20" West
45.11 feet along said tangent line to the Northeast corner of
Lot 57 of Tract 5910 as shown on a map thereof, recorded in
Book 217, pages 49 and 50, Miscellaneous Maps, records of Orange
County, California; thence South 0~ 09' 19" East and along the
East line of said Lot 57 and its Southerly prolongation a
distance of 134.83 feet; thence South 89° 58' 59" East 30.00 feet
to the point of beginning,
RESERVING an easement and right of way to construct, lay, install,
use, maintain, alter, add to, repair, replace, inspect and/or
remove, at any time and from time to time, aerial and undergrouhd
electric lines and communication lines, consisting of poles, guys,
and markers and other fixtures and appliances, for conveying
electric energy to be used for light, heat, power, telephone and/or
other related uses, in, on, over, under and through that certain
real property in the City of Santa Ana, County of Orange, State
of California, described as follows:
The Southerly 6.00 feet and the Westerly 6.00 feet of the above
described property.
PASSED ~ND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 3rd day of October, 1966.
